        The     petitioner   is  working     as    a  Senior<\/p>\n
Superintendent in the Kerala State Water Transport<\/p>\n
Department. He aspires for promotion to the post of a<\/p>\n
Director. In the special rules for the Kerala State Water<\/p>\n
Transport Services (Administration Wing), the service<\/p>\n
shall consist of three categories.\n<\/p>\n
      Category-1 – Director<\/p>\n
      Category-2 – Personal Assistant to the Director<\/p>\n
      Category-3 – Works Manager<\/p>\n
      2. Method of appointment to the post of Director is<\/p>\n
by promotion of qualified persons in the service or by<\/p>\n
transfer from any other service. The petitioner contends<\/p>\n
that though the Senior Superintendent as such is not<\/p>\n
included in the state service of Water Transport<\/p>\n
Department, the post of Senior Superintendent must be<\/p>\n
treated as included in the service and therefore he must<\/p>\n
be treated as eligible for being considered for promotion<\/p>\n
to the post of Director. Learned counsel for the<\/p>\n

      petitioner Mr.Bose contends that he was working as a<\/p>\n
      Junior Superintendent. Thereafter he was promoted as<\/p>\n
      Senior Superintendent as evidenced by Ext.P2 order. He<\/p>\n
      contends that the post of Senior Superintendent is not<\/p>\n
      included in the subordinate service and therefore it must<\/p>\n
      be treated as equivalent to the post of Personal<\/p>\n
      Assistant. He further contends that there is no person<\/p>\n
      working as a Personal Assistant in the Water Transport<\/p>\n
      Department, at present, that the petitioner is the senior<\/p>\n
      most Superintendent and therefore he is entitled to be<\/p>\n
      considered as included in Category – II of the service. He<\/p>\n
      further refers to Ext.P4 communication sent by the then<\/p>\n
      Secretary of the Transport Department, reporting that<\/p>\n
      the petitioner, who       is the senior most senior<\/p>\n
      Superintendent    working    in   the   Regional    Office<\/p>\n
      Changanacherry, is eligible for promotion to the post of<\/p>\n
      Director. By Ext.P5 judgment, this Court directed the<\/p>\n
      Government to consider the claim of the petitioner and<\/p>\n
      others for promotion to the post of Director within a<\/p>\n
      period of two months from the date of judgment dated<\/p>\n

      7.3.2006. Apparently, even contempt proceedings had to<\/p>\n
      be initiated against the Government, when there was<\/p>\n
      delay in considering the claim of the petitioner.<\/p>\n
      Ultimately, the Government passed Ext.P7 order,<\/p>\n
      wherein it was found that the State Water Transport<\/p>\n
      Services (Admn. Wing) consists of the Director, Personal<\/p>\n
      Assistant to Director and Works Manager. Petitioner does<\/p>\n
      not belong to these categories and is therefore not in the<\/p>\n
      feeder category. It is, therefore, stated in Ext.P7 that<\/p>\n
      the petitioner is not eligible for promotion to the post of<\/p>\n
      Director.\n<\/p>\n
            3. Ext.P7 further proceeds to state that though the<\/p>\n
      special rules provide for appointment by transfer from<\/p>\n
      any other service, petitioner cannot be considered for<\/p>\n
      appointment by transfer as his `CR’ for the year 2006<\/p>\n
      (Upto 19.9.2006) reveals that he is not suitable for<\/p>\n
      appointment to a responsible post. Subsequently, by<\/p>\n
      Ext.P12, Government issued a circular stating that they<\/p>\n
      are looking for competent officers for the post of<\/p>\n
      Director, State Water Transport Department, who are<\/p>\n

      willing to be considered for appointment on a deputation<\/p>\n
      basis. Ext.P12 has been specifically challenged by the<\/p>\n
      petitioner in this writ petition. Petitioner has also sought<\/p>\n
      for a direction to the respondents not to implement<\/p>\n
      Ext.P12 so that the petitioner is to be appointed as a<\/p>\n
      Director.\n<\/p>\n
             4. The Writ petition was, originally, disposed of by<\/p>\n
      this Court by judgment dated 4.6.2007. It was ordered<\/p>\n
      by this Court that if there are eligible or suitable<\/p>\n
      candidates available for appointment by transfer, the<\/p>\n
      Government shall follow the said method, which is<\/p>\n
      permissible as per the special rules. It was further<\/p>\n
      observed that only in the absence of eligible or suitable<\/p>\n
      candidates for appointment by transfer, the post shall be<\/p>\n
      filled up by deputation as notified in Ext.P12. The Court<\/p>\n
      had also found that there is nothing illegal in Ext.P12.<\/p>\n
      State applied for a review of the said judgment and<\/p>\n
      review petition was allowed on 17.7.2007. This Court<\/p>\n
      referred to the counter affidavit filed in the writ petition,<\/p>\n
      wherein, it was specifically stated that the amendment<\/p>\n

      to the special rules is under active consideration of the<\/p>\n
      State   Government     and    until   the    formalities for<\/p>\n
      amendment are complied with, as an interim measure,<\/p>\n
      it was decided to fill up the post on deputation. The<\/p>\n
      application for review was allowed. Earlier judgment was<\/p>\n
      recalled and the writ petition was restored to file.<\/p>\n
            5. Subsequently, about 14 persons were called for<\/p>\n
      interview for appointment by deputation. Petitioner also<\/p>\n
      participated in that interview. Selection process for<\/p>\n
      deputation has not been finalised so far. In the<\/p>\n
      additional counter affidavit filed by the Government,<\/p>\n
      reference is made to the fact that the amendment to the<\/p>\n
      special rules is pending approval with the Government<\/p>\n
      and that in the draft special rules, it is proposed that the<\/p>\n
      requisite qualification prescribed for promotion to the<\/p>\n
      post of Director is a Degree from the recognized<\/p>\n
      University with MBA and preference will be given to<\/p>\n
      those   who    have   Post   Graduation      and   Technical<\/p>\n
      qualification.  Therefore, since a fairly comprehensive<\/p>\n
      amendment to the special rules was contemplated,<\/p>\n

      Government decided that pending amendment to the<\/p>\n
      special rules, they will fill up the post of Director on<\/p>\n
      deputation. As noted above, the Board interviewed 14<\/p>\n
      persons including the petitioner and the candidates were<\/p>\n
      assessed based on their provisional caliber, Management<\/p>\n
      ability, Corporate knowledge, Leadership and personality<\/p>\n
      and Communication ability. Five candidates were ranked<\/p>\n
      strictly based on merits. Select list has been circulated<\/p>\n
      for approval to the Minister for Transport and Chief<\/p>\n
      Minister. The decision, not to fill up the post of Director<\/p>\n
      on regular basis till the special rules are amended, was<\/p>\n
      taken at the highest level on 25.6.2006.\n<\/p>\n
             6. What has been, principally, challenged in the<\/p>\n
      writ petition is Ext.P12, by which, the Government<\/p>\n
      decided to call for applications from the interested<\/p>\n
      persons for appointment to the post of Director in the<\/p>\n
      State Water Transport Department on deputation. A<\/p>\n
      perusal of the additional counter affidavit filed by the<\/p>\n
      Government would show that a decision was taken by<\/p>\n
      the Government at the highest level not to fill up the<\/p>\n

      post of Director on regular basis pending amendment to<\/p>\n
      the special rules. The Government has the power to do<\/p>\n
      so under Rule 9Bof Part II of KS&SSR. It cannot be said<\/p>\n
      that there is anything illegal or arbitrary in the<\/p>\n
      Government deciding to do so. The power of the<\/p>\n
      Government to do so was considered and upheld by a<\/p>\n
      Bench of this court in Kerala State Housing Board v<\/p>\n
      Murali (1989 (2) KLT 28).\n<\/p>\n
             7. For all these reasons, I do not find that there is<\/p>\n
      anything illegal in Ext.P12 and the decision taken by the<\/p>\n
      Government to fill up the post of Director, State Water<\/p>\n
      Transport   Department     on   deputation.    Ext.P12   is,<\/p>\n
      therefore, upheld.\n<\/p>\n
            8. Learned counsel for the petitioner submits that<\/p>\n
      the    selection    proceedings    undertaken     by    the<\/p>\n
      Government for appointing a person to the post of<\/p>\n
      Director on deputation is illegal and is liable to be<\/p>\n
      interfered with on several grounds. In my view, the<\/p>\n
      validity of the same is not the subject matter of the<\/p>\n
      present writ petition. Contention of the petitioner, who<\/p>\n

      had also participated in the selection process, is left<\/p>\n
      open with liberty to assail the same, if so advised, and if<\/p>\n
      permissible. Subject to the above observation, I find no<\/p>\n
      merit in the writ petition and the same is dismissed.<\/p>\n
