JUSTICE J.P.SINGH, JUDGE.     \nDate: 23\/04\/2009 \n:J U D G M E N T :\n<\/pre>\n<p id=\"p_1\">A sample of tablet Serase-5, batch No. TS-103,<br \/>\nmanufactured by M\/S QP Pharmachemb Pvt. Ltd,<br \/>\nDerra Bassi (Punjab), bearing manufacturing date<br \/>\n6\/99 and expiry date 5\/2002, lifted by Mr. Parvez<br \/>\nAhmed Bhat, Drugs Inspector (HQ) from the<br \/>\npremises of M\/S New Suraj Transport Agency<br \/>\nSrinagar, from the consignment of M\/S Wani<br \/>\nTraders, Pharmaceutical Distributors, Gaw Kadal,<br \/>\nSrinagar, on its analysis, by the Central Indian<br \/>\nPharmacopoeia Laboratory Gaziabad, was found to<br \/>\nbe spurious in terms of its Report No. CIPL\/6031\/38<br \/>\ndated 14.01.2002.\n<\/p>\n<p id=\"p_1\">State through its Drugs Inspector (HQ)<br \/>\nSrinagar, filed a complaint in this regard, before<br \/>\nlearned Judicial Magistrate First Class (Sub<br \/>\nRegistrar) Srinagar, who on finding a prima facie<br \/>\ncase for commission of the offence punishable under<br \/>\n<span class=\"hidden_text\" id=\"span_1\">2<\/span><br \/>\n<a href=\"\/doc\/1403255\/\" id=\"a_1\">Section 27(c)<\/a> of the Drugs and <a href=\"\/doc\/1891720\/\" id=\"a_1\">Cosmetics Act<\/a>,<br \/>\nissued Process against the functionaries of M\/S QP<br \/>\nPharmachemb Pvt. Ltd, Derra Bassi (Punjab).<br \/>\nVijay Choudhary and Anil Berry, the Director<br \/>\nand the Managing Director of M\/S QP Pharmachemb<br \/>\nPvt. Ltd, Derra Bassi (Punjab), have approached this<br \/>\nCourt seeking quashing of the proceedings, or in the<br \/>\nalternative, the transfer of the complaint for its trial<br \/>\nby any Court of competent jurisdiction at Jammu.<br \/>\nPetitioners&#8217; learned counsel referred to the<br \/>\nprovisions of <a href=\"\/doc\/1403255\/\" id=\"a_2\">Section 33-G(4)<\/a> of the Act to urge that<br \/>\nin the absence of any notification by the<br \/>\nGovernment, learned Magistrate&#8217;s order, taking<br \/>\ncognizance of the offence punishable under <a href=\"\/doc\/1403255\/\" id=\"a_3\">Section<br \/>\n27(c)<\/a> of the Drugs and <a href=\"\/doc\/1891720\/\" id=\"a_4\">Cosmetics Act<\/a>, 1940, was<br \/>\nunwarranted and without jurisdiction. He next<br \/>\ncontended that the company had not been provided<br \/>\ninformation about the seizure of the Drug<br \/>\nmanufactured by it and had thus been deprived of its<br \/>\nright to get the sample re-examined by the Central<br \/>\nDrugs Laboratory. Pleading violation of the<br \/>\nprovisions of <a href=\"\/doc\/1403255\/\" id=\"a_5\">Section 23(4)<\/a> of the Act, learned<br \/>\ncounsel submitted that the proceedings initiated<br \/>\nagainst the petitioners need to be quashed.<br \/>\nYet another point urged by the learned counsel<br \/>\nis, that in the absence of any allegation in the<br \/>\ncomplaint, that the petitioners were in-charge of the<br \/>\nCompany at the time when the alleged offence was<br \/>\ncommitted, and were responsible to the Company for<br \/>\n<span class=\"hidden_text\" id=\"span_1\">3<\/span><br \/>\nthe alleged offence, initiation of process against the<br \/>\npetitioners was unwarranted.\n<\/p>\n<p id=\"p_2\">Supporting petitioners&#8217; alternative plea for<br \/>\ntransfer of the complaint, learned counsel submitted<br \/>\nthat it would be highly inconvenient and<br \/>\ncumbersome for the petitioners to spend four\/five<br \/>\ndays, on each and every date of hearing, to attend<br \/>\nthe Court at Srinagar, from their present location at<br \/>\nChandigarh, and in these circumstances, fair trial of<br \/>\nthe petitioners warrants transfer of the complaint<br \/>\nfrom the Court of Sub-Registrar Judicial Magistrate<br \/>\nIst Class, Srinagar to any Court of competent<br \/>\njurisdiction at Jammu.\n<\/p>\n<p id=\"p_3\">The case was heard in ex-parte as none had<br \/>\nappeared for the respondents to contest the petition.<br \/>\nI have considered the submissions of learned<br \/>\ncounsel for the petitioners and gone through the<br \/>\njudgments, cited by him in support of his<br \/>\nsubmissions.\n<\/p>\n<p id=\"p_4\">Petitioners&#8217; first plea that prosecution could not<br \/>\nhave been launched without previous sanction of the<br \/>\nAuthority specified under sub-section (4) of <a href=\"\/doc\/1403255\/\" id=\"a_6\">Section<br \/>\n33-G<\/a> of the Drugs and <a href=\"\/doc\/1891720\/\" id=\"a_7\">Cosmetics Act<\/a>, 1940, is found<br \/>\nto be misconceived, in that, this Section does not<br \/>\ncontemplate issuance of any Sanction before<br \/>\nlaunching of prosecution. Prior Sanction for<br \/>\nlaunching prosecution is, on the other hand,<br \/>\ncontemplated by <a href=\"\/doc\/1403255\/\" id=\"a_8\">Section 33-M<\/a> of the Act, which<br \/>\nwould have, however, no application to the facts of<br \/>\nthe present case because the prior Sanction<br \/>\n<span class=\"hidden_text\" id=\"span_2\">4<\/span><br \/>\ncontemplated by the Section pertains to the<br \/>\nprosecution of the offences appearing under Chapter<br \/>\nIV-A of the Act and not for the offence punishable<br \/>\nunder <a href=\"\/doc\/1403255\/\" id=\"a_9\">Section 27(c)<\/a>, which falls in Chapter IV of the<br \/>\nAct.\n<\/p>\n<p id=\"p_5\">His contention is accordingly rejected.<br \/>\nIn view of the material placed on records by the<br \/>\ncomplainant, I do not find any merit in petitioners&#8217;<br \/>\nother contentions too relating to the violation of the<br \/>\nprovisions of the Act, in so far as following of<br \/>\nprocedure prescribed in the Act for taking samples<br \/>\nand complying with other requirements of the Act,<br \/>\nbefore launching prosecution for commission of<br \/>\noffences punishable under Chapter IV of the Act, are<br \/>\nconcerned. This is so because the material placed<br \/>\non records by the complainant does not indicate any<br \/>\nprima facie violation of the provisions of the Act<br \/>\nwhich are required to be complied with before<br \/>\nlaunching of prosecution under the provisions of the<br \/>\nDrugs and <a href=\"\/doc\/1891720\/\" id=\"a_10\">Cosmetics Act<\/a>, 1940, and the petitioner<br \/>\nhas not placed any such material on records on the<br \/>\nbasis whereof his plea about the violation of the<br \/>\nprovisions of the Act may be sustained.<br \/>\nI, however, find substance in petitioners&#8217; last<br \/>\ncontention that neither is there any statement in the<br \/>\ncomplaint nor any material on records accompanying<br \/>\nthe complaint indicating that the petitioners were, incharge<br \/>\nof, and were, responsible to the Company,<br \/>\nfor the conduct of business of the Company, and<br \/>\nwere thus, as such, liable for commission of the<br \/>\n<span class=\"hidden_text\" id=\"span_3\">5<\/span><br \/>\noffence by the Company, in terms of <a href=\"\/doc\/1403255\/\" id=\"a_11\">Section 34<\/a> of<br \/>\nthe Drugs and <a href=\"\/doc\/1891720\/\" id=\"a_12\">Cosmetics Act<\/a>, 1940.\n<\/p>\n<p id=\"p_6\">For all what has been said above, I am of the<br \/>\nview that continuance of proceedings on the<br \/>\nrespondent&#8217;s complaint against the petitioners, in the<br \/>\nabsence of any allegation against them in the<br \/>\ncomplaint or appearing from the material on records,<br \/>\nof their being in-charge of, and responsible to the<br \/>\nCompany for the conduct of its business, would<br \/>\namount to abuse of the process of court.<br \/>\nAccordingly, allowing the petition, proceedings<br \/>\ninitiated on respondents&#8217; complaint against the<br \/>\npetitioners by learned Judicial Magistrate (Sub<br \/>\nRegistrar), Srinagar, are quashed.<br \/>\n(J.P.Singh)<br \/>\nJudge<br \/>\nJAMMU:\n<\/p>\n<p id=\"p_7\">23.04.2009<br \/>\nAnil Raina, Secy.\n<\/p>\n<p id=\"p_8\">\n","protected":false},"excerpt":{"rendered":"<p>Jammu High Court Vijay Chowdhary &amp; Anr vs State And Ors on 23 April, 2009 HIGH COURT OF JAMMU AND KASHMIR AT JAMMU. 561-A Cr P C No. 44 OF 2003 Vijay Chowdhary &amp; anr.
