Justice V.GIRI\n\n Dated :21\/05\/2009\n\n O R D E R\n                        V.GIRI, J\n                      -------------------\n                   W.P.(C).8304\/2009\n                      --------------------\n        Dated this the 21st day of May, 2009\n\n                      JUDGMENT\n<\/pre>\n<p>      Petitioner&#8217;s husband allegedly met with a serious<\/p>\n<p>accident. According to the petitioner, her husband is<\/p>\n<p>lying in a comatose state and therefore, unable to<\/p>\n<p>move about. She therefore, filed a petition under the<\/p>\n<p>Motor Vehicles Act, claiming compensation on behalf<\/p>\n<p>of her husband describing herself as next friend. The<\/p>\n<p>learned Tribunal conducted a preliminary enquiry, but<\/p>\n<p>has not so far directed the Original Petition to be<\/p>\n<p>numbered.     This Court called for a report from the<\/p>\n<p>MACT, Thiruvananthapuram             and by communication<\/p>\n<p>dated 8.4.2009,      it has been reported that        the<\/p>\n<p>medical certificate issued from the            Ananthapuri<\/p>\n<p>Hospital, Thiruvananthapuram,             produced by the<\/p>\n<p>petitioner did not reveal the condition of the injured;<\/p>\n<p>nor have records been produced to demonstrate the<\/p>\n<p>relationship between the petitioner and the injured.<\/p>\n<p>W.P.(C).8304\/2009<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>2.   Having heard learned counsel for the petitioner<\/p>\n<p>and learned Government Pleader and having perused<\/p>\n<p>the averments in the writ petition, I am of the view<\/p>\n<p>that it will be appropriate that the Tribunal directs<\/p>\n<p>numbering of the petition. Thereafter, petitioner<\/p>\n<p>could be called upon to produce all the materials to<\/p>\n<p>convince the Tribunal that the injured is disabled to<\/p>\n<p>the extent to which he is unable to prosecute the<\/p>\n<p>proceedings himself and requires the help of a next<\/p>\n<p>friend. Tribunal can also call upon the petitioner to<\/p>\n<p>produce      sufficient evidence to show that she is<\/p>\n<p>competent to represent the injured.     Obviously an<\/p>\n<p>enquiry would be necessary in this case and<\/p>\n<p>numbering of the petition need not be deferred till<\/p>\n<p>then.\n<\/p>\n<\/p>\n<p>3.
