RAMASWAMY, G.T. NANAVATI\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p id=\"p_1\">\t\t\t O R D E R<br \/>\n     Order  dated   2.8.1996  is   recalled.  Special  Leave<br \/>\nPetitions are restored.\n<\/p>\n<p id=\"p_1\">     Leave granted.  These appeals  by special\tleave  arise<br \/>\nfrom the  judgment of  the Division  Bench of the Punjab and<br \/>\nHaryana High  Court, dated  November 23,  1995 and  July 28,<br \/>\n1995 in C.W.P. Nos. 15828\/95  and 1479\/95 respectively.\n<\/p>\n<p id=\"p_2\">     The admitted  position is\tthat the respondents came to<br \/>\nbe appointed  as daily\twagers on contract basis to the post<br \/>\nof Clerk.  They filed  writ petition  in the  High Court for<br \/>\ntheir regularisation.  The High\t Court in the impugned order<br \/>\nhas directed  payment of wages on the principle of equal pay<br \/>\nfor equal  work and  also regularisation  of their services.<br \/>\nThus these appeals, by special leave.\n<\/p>\n<p id=\"p_3\">     The controversy  is no  longer res judicata. This Court<br \/>\nin <a href=\"\/doc\/499423\/\" id=\"a_1\">State  of Haryana  v. Piara\tSingh<\/a> [(1992) 4 SCC 118] has<br \/>\nlaid down  the guidelines for appointment by recruitment and<br \/>\nif need\t be by\tregularisation of  class IV  employees. As a<br \/>\nconsequence, any appointment made to the service shall be in<br \/>\naccordance with\t the statutory rules and also the guidelines<br \/>\nlaid down  thereunder. Therefore,  the appellant is directed<br \/>\nto  consider   their  cases   in  accordance  with  law\t and<br \/>\nguidelines  laid   down\t therein   for\tappointment  of\t the<br \/>\nrespondents to\tthe service  as per  law provided  they\t are<br \/>\notherwise eligible.  If they have become age-barred, age may<br \/>\nbe relaxed  for the period they have worked. On appointment,<br \/>\nfrom that  date they  will be  entitled to  equal pay on par<br \/>\nwith the regular clerks.\n<\/p>\n<p id=\"p_4\">     Shri Manoj Swarup, learned counsel for the respondents,<br \/>\ncontends  that\t the  post   held  by  the  respondents\t are<br \/>\ninterchangeable and  in fact  they have been interchanged to<br \/>\nenable them  to hold  the posts.  That contention  cannot be<br \/>\ngiven acceptance  for the  reason that since the respondents<br \/>\nwere appointed on contract basis on daily wages, they cannot<br \/>\nhave any  right to  a post  as\tsuch  until  they  are\tduly<br \/>\nselected and  appointed. Merely\t because they  are  able  to<br \/>\nmanage to  have the  posts interchange,\t they cannot  become<br \/>\nentitled to  the same pay-scale which the regular clerks are<br \/>\nholding by  claiming that  they are discharging their duties<br \/>\nas regular  employees. The  very object\t of selection  is to<br \/>\ntest  the   eligibility\t and   then  to\t make  selection  in<br \/>\naccordance with\t rules prescribed for recruitment. Obviously<br \/>\nthe respondents\t recruitment was not made in accordance with<br \/>\nthe rules.  This Court\thas also  pointed out  in  <a href=\"\/doc\/311082\/\" id=\"a_1\">State  of<br \/>\nHaryana &amp;  Ors. v. Jasmer Singh &amp; Ors. [JT<\/a> 1996 (10) SC 876]<br \/>\nin that\t behalf. If  any illegal  actions have been taken by<br \/>\nthe officer after recruitment, it would be a grave matter of<br \/>\nindiscipline by\t the officers and the higher authorities are<br \/>\ndirected to  look into\tthe matter and see that such actions<br \/>\nare rectified, but that would not be a matter for this Court<br \/>\nto give\t legitimacy to illegal acts done by the officers and<br \/>\nto grant  relief on the basis of wrong or illegal actions of<br \/>\nsuperior officers. The appropriate authority would look into<br \/>\nand take  suitable disciplinary\t action against\t the  erring<br \/>\nofficers and  submit the  report of the action taken and the<br \/>\nresult thereof to the Registry of this Court.\n<\/p>\n<p id=\"p_5\">     The appeals  are accordingly  allowed and the orders of<br \/>\nthe High  Court set  aside, but the directions that would be<br \/>\nfollowed are as indicated in the judgment. It is needless to<br \/>\nmention that they would take expeditious action in following<br \/>\nthe directions.
