Assistant Engineer and Mr. Rajul\n                                                        Verma, Junior Engineer.\n\nFirst Appeal:\nNo action was taken on complaints nor information was provided.\n\nOrder of the FAA:\nNot mentioned.\n\nGround of the Second Appeal:\nFalse information was provided by the PIO after lapse of 30 days.\n\nRelevant Facts<\/pre>\n<p id=\"p_1\"> that emerged during the Hearing on 21 January 2010:<br \/>\n&#8220;The following were present:\n<\/p>\n<p id=\"p_1\">Appellant: Mr. Rajendra Gupta;\n<\/p>\n<p id=\"p_2\">Respondent: Mr. Arun Kumar, Public Information Officer &amp; SE-II;\n<\/p>\n<p id=\"p_3\">        The RTI application was received by the PIO on 03\/08\/2009. The PIO did not give<br \/>\nany reply and the reply from the deemed PIO dated 09\/10\/2009 was sent to the Appellant<br \/>\nonly on 29\/10\/2009 acknowledging that illegal construction had been done and that action<br \/>\nwill be taken. The PIO informs that the property has been booked but any actual action like<br \/>\nsealing or demolition will be taken at some point in the future. The PIO states that the<br \/>\nperson responsible for the delay of 78 days is Mr. Rahul Verma, Junior Engineer. The RTI<br \/>\napplication was given to him on 12\/08\/2009 and he gave the information on 29\/10\/2009.&#8221;\n<\/p>\n<p id=\"p_4\">                                                                            Page no. 2 of 4<br \/>\n Commission&#8217;s Decision dated 21 January 2010:\n<\/p>\n<p id=\"p_5\">&#8220;The Appeal is allowed.\n<\/p>\n<p id=\"p_6\">       The information appears to have been provided.&#8221;\n<\/p>\n<p id=\"p_7\">Facts leading to Showcause:\n<\/p>\n<p id=\"p_8\">The issue before the Commission was of not supplying the complete, required information<br \/>\nby the deemed PIO Mr. Rahul Verma, Junior Engineer within 30 days as required by the<br \/>\nlaw. From the facts before the Commission it appeared that the deemed PIO Mr. Rahul<br \/>\nVerma, Junior Engineer was guilty of not furnishing information within the time specified<br \/>\nunder sub-section (1) of Section 7 by not replying within 30 days, as per the requirement of<br \/>\nthe <a href=\"\/doc\/671631\/\" id=\"a_1\">RTI Act<\/a>. Hence a showcause notice was issued to him, and he was directed give his<br \/>\nreasons to the Commission to show cause why penalty should not be levied on him on 23<br \/>\nFebruary 2010 at 11.00am.\n<\/p>\n<p id=\"p_9\">Relevant Facts emerging during Showcause Hearing on 23 February 2010:<br \/>\nThe following were present:\n<\/p>\n<p id=\"p_10\">Respondent: Mr. Rahul Verma, Junior Engineer (in EE-Building-II);\n<\/p>\n<p id=\"p_11\">        Mr. Mr. Rahul Verma states that he had joined MCD on 01\/06\/2009 and was<br \/>\nallotted the area which is a subject matter of this RTI Application on 08\/07\/2009. He states<br \/>\nthat he did not know about the procedures of the RTI Applications. He states that the<br \/>\nOffice Incharge (Building) Mr. Satpal Singh was not cooperating with him. Hence he<br \/>\ncould not provide the information. The RTI application has been received by the<br \/>\nDepartment on 03\/08\/2009 and Mr. Rahul Verma was given the application on 18\/08\/2009<br \/>\nby admission he has provided the information on 29\/10\/2009. The information should have<br \/>\nbeen provided by 03\/09\/2009. Thus there was a delay a delay of 56 days in providing the<br \/>\ninformation from 03\/09\/2009 to 29\/10\/2009 when the information was provided.\n<\/p>\n<p id=\"p_12\">Mr. Rahul Verma, Deemed PIO has not given any reasonable cause for not supplying the<br \/>\ninformation. The Commission warns him that incase of any future default the Commission<br \/>\nwill recommend very strict disciplinary action against him. The Commission is not<br \/>\noblivious of the fact that MCD officers are most reluctant in providing the information<br \/>\nwhen RTI queries seek information about unauthorized construction and encroachment.<br \/>\nThe Commission sees this as a fit case for levy of penalty under <a href=\"\/doc\/291269\/\" id=\"a_1\">Section 20(1)<\/a> of the RTI<br \/>\nAct. The Commission penalizes Mr. Rahul Verma Rs.250\/- per day for the delay of 56<br \/>\ndays i.e. Rs.250\/- X 56 days = Rs.14000\/-\n<\/p>\n<p id=\"p_13\">Decision:\n<\/p>\n<p id=\"p_14\">       The Commission finds this a fit case for levying of penalty under <a href=\"\/doc\/291269\/\" id=\"a_2\">Section 20(1)<\/a> of<br \/>\nthe RTI Act because no reasonable cause has been advanced for the delay in giving<br \/>\ninformation to the Complainant. Since the delay is of 25 days the Commission imposes a<br \/>\nPenalty of Rs. 14000\/- on Mr. Rahul Verma, deemed PIO\/JE under <a href=\"\/doc\/291269\/\" id=\"a_3\">Section 20(1)<\/a> of the<br \/>\nRTI Act at the rate of Rs. 250\/- per day.\n<\/p>\n<p id=\"p_15\">                                                                            Page no. 3 of 4<br \/>\n         The Commissioner, Municipal Corporation of Delhi, is directed to recover the<br \/>\namount of Rs.14000\/- from the salary of Mr. Rahul Verma and remit the same by a<br \/>\ndemand draft or a Banker&#8217;s Cheque in the name of the Pay &amp; Accounts Officer, CAT,<br \/>\npayable at New Delhi and send the same to Shri Pankaj K.P. Shreyaskar, Joint Registrar<br \/>\nand Deputy Secretary of the Central Information Commission, 2nd Floor, August Kranti<br \/>\nBhawan, New Delhi &#8211; 110066. The amount may be deducted at the rate of Rs.3500\/ per<br \/>\nmonth every month from the salary of Mr. Rahul Verma and remitted by the 10th of every<br \/>\nmonth starting from April 2010.
