No. I 45 of 2006 for the offences punishable under <a href=\"\/doc\/962373\/\" id=\"a_1\">Sections<br \/>\n\t363<\/a>, <a href=\"\/doc\/1146308\/\" id=\"a_2\">366<\/a>, <a href=\"\/doc\/697591\/\" id=\"a_3\">342<\/a>, <a href=\"\/doc\/482448\/\" id=\"a_4\">376<\/a> read with <a href=\"\/doc\/112749\/\" id=\"a_5\">Section 114<\/a>  of the Indian Penal Code.\n<\/p>\n<p id=\"p_1\">Having<br \/>\n\theard the learned counsel appearing for both the sides and looking<br \/>\n\tto the  fact that the applicant is  of a tender age of 20 years and<br \/>\n\tas per the submission of the learned counsel for the applicant, the<br \/>\n\tapplicant has solemnized the marriage with the prosecutrix and<br \/>\n\tlooking to the settlement dated 21st April, 2006 arrived<br \/>\n\tat between the parties which is  submitted along with the charge<br \/>\n\tsheet, coupled with the   fact that the investigation is over,<br \/>\n\tcharge sheet is filed and there are no antecedents of the applicant,<br \/>\n\tthe application is allowed.\n<\/p>\n<p id=\"p_2\">The<br \/>\n\t applicant   is  ordered  to  be  released on bail in connection<br \/>\n\twith Crime Register  No. I 45 of 2006 of Garbada Police Station,<br \/>\n\tDist : Panchmahals on his executing a  bond  of  Rs.5,000\/-(Rupees<br \/>\n\tFive Thousand only) with one surety of the like amount to the<br \/>\n\tsatisfaction of the trial Court and subject to the conditions that<br \/>\n\the shall,<\/p>\n<p id=\"p_3\">\t(a)\tnot<br \/>\ntake undue advantage of his liberty or \t\tabuse  his liberty;\n<\/p>\n<p id=\"p_4\">\t(b)\tnot<br \/>\nact in a manner injurious to the \t    interest of  the<br \/>\nprosecution;\n<\/p>\n<p id=\"p_5\">\t(c)\tmaintain<br \/>\nlaw and order ;\n<\/p>\n<p id=\"p_6\">\t(d)<br \/>\nmark his presence before Garbada  Police\t   \tStation, Dist Panchmahal<br \/>\n on every first day \t\tof the English Calendar month between 9-00<br \/>\n\t\ta.m. to  2-00 \t\tp.m.;\n<\/p>\n<p id=\"p_7\">\t(e)\tnot<br \/>\nleave the State of Gujarat without prior \t\tpermission of the Sessions<br \/>\nCourt concerned ;\n<\/p>\n<p id=\"p_8\">\t(f)\tfurnish\tthe<br \/>\naddress of his residence at the  \t\ttime of execution of the bond and<br \/>\nshall           \t\tnot change his residence without prior<br \/>\npermission  of this Court;\n<\/p>\n<p id=\"p_9\">\t(g)\tsurrender<br \/>\nhis Passport, if any, to  the\t    lower Court within a week ;\n<\/p>\n<p id=\"p_10\">If<br \/>\n\tbreach of  any  of  the  above conditions committed, the    Sessions<br \/>\n\t Judge concerned will be free to       issue warrant or take<br \/>\n\tappropriate action in the matter.\n<\/p>\n<p id=\"p_11\">Bail<br \/>\n\tbonds to be executed before  the  lower Court having jurisdiction to<br \/>\n\ttry the case.\n<\/p>\n<p id=\"p_12\">Rule<br \/>\n\tis   made  absolute  to    the    aforesaid extent.\n<\/p>\n<p id=\"p_13\"> (<br \/>\nD.N.PATEL, J. )<\/p>\n<p>*mithabhai<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Agabhai vs State on 9 November, 2011 Author: Dn Patel, Gujarat High Court Case Information System Print CR.MA\/12797\/2006 3\/ 3 ORDER IN THE HIGH COURT OF GUJARAT AT AHMEDABAD CRIMINAL MISC.APPLICATION No. 12797 of 2006 ========================================================= AGABHAI (RAISING) BHAVLABHAI ALIAS BHAUSING PARMAR &#8211;
