Justice P.Q.BARKATH ALI\n\n Dated :23\/04\/2010\n\n O R D E R\n                       P.Q.BARKATH ALI, J.\n                       --------------------------------\n                         B.A. No.2200 of 2010\n                       ---------------------------------\n                 Dated this the 23rd day of April, 2010\n\n                               O R D E R\n<\/pre>\n<p id=\"p_1\">       This is a bail application filed by the accused in the<\/p>\n<p>Sessions     Case  No.256\/2007        (Crime       No.278\/2005 of<\/p>\n<p>Vadakara Police Station) pending before the Additional<\/p>\n<p>District and Sessions Court, Vadakara under <a href=\"\/doc\/1290514\/\" id=\"a_1\">Section 439<\/a> of<\/p>\n<p>Code of Criminal Procedure.\n<\/p>\n<p id=\"p_1\">      2.    The allegation against the petitioner is that he<\/p>\n<p>has committed an offence punishable under <a href=\"\/doc\/1417508\/\" id=\"a_1\">Section 308<\/a><\/p>\n<p>read with <a href=\"\/doc\/37788\/\" id=\"a_2\">Section 34<\/a> I.P.C. The case was scheduled for<\/p>\n<p>trial on 1st February, 2010 and summons were issued to the<\/p>\n<p>witnesses. On that date accused was present. But as the<\/p>\n<p>witnesses were absent the case was adjourned to the next<\/p>\n<p>day ie., 2nd February, 2010 and NBW were issued to CWs1<\/p>\n<p>to 5. On that date CWs 6 to 14 were present. But as the<\/p>\n<p>accused was absent the case could not be proceeded with.<\/p>\n<p>Therefore the trial court cancelled his bail and warrant<\/p>\n<p>was issued against him.         As the warrant was returned<\/p>\n<p>unexecuted proceedings were initiated against sureties<\/p>\n<p>B.A. No.2200 of 2010<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                              2<\/span><\/p>\n<p>under <a href=\"\/doc\/1286551\/\" id=\"a_3\">Section 446<\/a> of Code of Criminal Procedure.<\/p>\n<p>Sureties produced the accused before trial Court on 16th<\/p>\n<p>March, 2010. The trial court rejected his bail application<\/p>\n<p>and remanded him to judicial custody.<\/p>\n<p id=\"p_2\">      3. It is alleged in the petition that due to illness he<\/p>\n<p>was unable to attend the lower court on 2nd Fbruary, 2010,<\/p>\n<p>that he produced Medical Certificate before trial court<\/p>\n<p>which was not considered and that therefore his absence<\/p>\n<p>before trial Court on 2nd February, 2010 may be excused<\/p>\n<p>and he may be released on bail.\n<\/p>\n<p id=\"p_3\">      4. Notice given to Public Prosecutor. Heard the<\/p>\n<p>learned counsel for the petitioner and the learned Public<\/p>\n<p>Prosecutor.\n<\/p>\n<p id=\"p_4\">      5. For the following reasons I am inclined to grant<\/p>\n<p>bail to the petitioner. He was on bail till 1st February,<\/p>\n<p>2010. He produced the Medical Certificate before Lower<\/p>\n<p>Court for his absence on 2nd February, 2010. Therefore I<\/p>\n<p>feel that his absence on that date was not wilful and can<\/p>\n<p>be excused. It follows and I hold that bail can be granted<\/p>\n<p>to petitioner.\n<\/p>\n<p id=\"p_5\">B.A. No.2200 of 2010<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                            3<\/span><\/p>\n<p id=\"p_6\">      6. In the result, the application is allowed. The<\/p>\n<p>petitioner shall be released on bail on executing a<\/p>\n<p>bond for Rs.25,000\/- with two solvent sureties for like<\/p>\n<p>sum each to the satisfaction of the lower court.
