NANAVATI\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p id=\"p_1\">\t\t\t O R D E R<br \/>\n     This writ petition under <a href=\"\/doc\/981147\/\" id=\"a_1\">Article 32<\/a> of the Constitution<br \/>\nhas been  filed challenging  the validity  of the Resolution<br \/>\ndated August 29, 1987 where under the respondent-Corporation<br \/>\nhad resolved to implement the roster system and promotion of<br \/>\nScheduled and  Tribes employer\tas per\tthe  directives\t and<br \/>\nResolution of  the Gujarat Government on January 31, 1976 to<br \/>\ngive effect  to the  policy of\treservation in promotions in<br \/>\nall Class-I,  Class-II and Class posts in grades or services<br \/>\nin which the element of direct recruitment, if any, does not<br \/>\nexceed 50%.  The decision  on the fitness or unfitness of an<br \/>\nOfficer\t would\t be  taken  by\tthe  departmental  Promotion<br \/>\ncommittee which\t would be  constituted by the Departments. A<br \/>\n100 point  roster as  per  percentages\tof  reservation\t for<br \/>\nScheduled Castes  and Scheduled\t Tribes,  to  determine\t the<br \/>\nnumber of  vacancies reserved  in a  year would be followed.<br \/>\nAccording to  the points  in the  roster, if  their are\t any<br \/>\nvacancies reserved  for each  of the  two classes  mentioned<br \/>\nseparate lists\twould be drawn up of the eligible candidates<br \/>\nfor each  of these  categories and  general  candidates\t and<br \/>\narranged in  order of  their inter-se  seniority in the main<br \/>\nlist. The  Scheduled Castes  and Scheduled  Tribes employees<br \/>\nshould be  adjudged by\tthe Departmental Promotion committee<br \/>\nseparately in regard to their fitness. In paragraph 4 of the<br \/>\nResolution, it\twas stated  that  these\t orders\t would\ttake<br \/>\neffect from January 1, 1976.\n<\/p>\n<p id=\"p_1\">     On\t April\t30,  1984,  the\t respondent-Board  passed  a<br \/>\nResolution that\t in <a href=\"\/doc\/68038\/\" id=\"a_1\">Article  16(4)<\/a> and\t<a href=\"\/doc\/1113850\/\" id=\"a_2\">Article 335<\/a>  of\t the<br \/>\nConstitution provision\thas been  made for  backward classes<br \/>\nfor  appointment   and,\t therefore,   their  should   be  no<br \/>\ndifficulty in  providing reservation in appointment to posts<br \/>\nto give\t the benefit  to the  backward classes; and that the<br \/>\npercentage of  reservation as  is  kept\t in  the  Government<br \/>\nservice would  be applicable  to the Corporation. As per the<br \/>\norders of  the Board, for every type of recruitment at every<br \/>\nstage or  service or  place, a\tseparate roster register, as<br \/>\nper the\t prescribed format,  is to  be Kept.  The Board\t had<br \/>\ngiven order  for filling  up the posts as per the percentage<br \/>\nfor  Scheduled\t Castes\t an   Schaduled\t Tribes.   But\t for<br \/>\nintroduction of\t roster system\tin the direct recruitment or<br \/>\npromotion the Corporation had not yet issued any orders. The<br \/>\nCorporation, therefore,\t resolved  to  give  effect  to\t the<br \/>\nobjectives of  the Government  and authorized  the  Managing<br \/>\nDirector to follow the roster system scrupulously as per the<br \/>\ndirections of  the Government  in IMPD,\t vide  letter  dated<br \/>\nSeptember 29,  1983 for\t class-I to class-IV employees which<br \/>\nare as under:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>     (1) For SC\/ST\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>     (i) For direct recruitment<br \/>\n     Class I  upto Sr. Executive&#8217;s level<br \/>\n     and Class II, II and IV employees.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>     (ii) For promotion<br \/>\n     Class I  upto Executive  level  and<br \/>\n     Class II, III and IV employees.<br \/>\n     (2) For  Socially and Educationally<br \/>\n     Backward\tClass\tand   Physically<br \/>\n     handicapped\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_3\"><p>     (i) For direct recruitment only<br \/>\n     Class I, Class II, Class III and<br \/>\n     Class IV employees.&#8221;<\/p><\/blockquote>\n<p id=\"p_2\">     Subsequently,  they   passed  the\timpugned  Resolution<br \/>\ngiving effect  to the  policy of  reservation and the roster<br \/>\nsystem w.e.f.  1.1.1976. The question is: from what date the<br \/>\nCorporation would give effect to the roster system?\n<\/p>\n<p id=\"p_3\">     It is  true, as  contended by  Shri P.S.  Poti  learned<br \/>\nsenior counsel\tfor the\t State, that  when the policy of the<br \/>\nGovernment envisaged  under <a href=\"\/doc\/68038\/\" id=\"a_3\">Article 16(4)<\/a> read with Articles<br \/>\n14 and\t16(1) and  335 is given effect to the reservation in<br \/>\ninitial requirement  and promotion  can\t be  made.  But\t the<br \/>\nquestion of  retrospectively the policy does not arise; what<br \/>\nis being done is to give effect to the constitutional policy<br \/>\nof providing  adequate\trepresentation\tto  the\t members  of<br \/>\nScheduled Castes  and Scheduled\t Tribes in  all\t Classes  of<br \/>\nservice or  posts where they are not adequately represented.<br \/>\ntherefore, the arbitrariness does not arise since it is part<br \/>\nof  the\t  scheme  of   the  constitution.   Unless  adequate<br \/>\nrepresentation\tis  given  to  the  employees  belonging  to<br \/>\nScheduled Castes  and Scheduled\t Tribes in  promotions also,<br \/>\nthe adequacy  to representation in all classes and grades of<br \/>\nservice, where\tthere is  no element  of direct\t recruitment<br \/>\ncannot be  achieved. Obvious, therefore, <a href=\"\/doc\/211089\/\" id=\"a_4\">Article 16(4-A)<\/a> was<br \/>\nbrought on the Constitution by Constitution (77th <a href=\"\/doc\/1210757\/\" id=\"a_5\">Amendment)<br \/>\nAct<\/a>, after the majority Judgment of this Court by a Bench of<br \/>\n9 Judges in <a href=\"\/doc\/151374\/\" id=\"a_6\">Indira Sawhney vs. Union of India &amp; Ors<\/a>. [(1992)<br \/>\nSupp. 3\t SCC 210].  The Preamble  of  the  Constitution\t and<br \/>\n<a href=\"\/doc\/1673816\/\" id=\"a_7\">Article 38<\/a> accord social and economic Justice as fundamental<br \/>\nrights to  all people in all institutions of national leave.<br \/>\n<a href=\"\/doc\/352126\/\" id=\"a_8\">Article 46<\/a>  enjoins the\t State to accord social and economic<br \/>\njustice\t to  the  Scheduled  Castes  and  Scheduled  Tribes.<br \/>\n<a href=\"\/doc\/867010\/\" id=\"a_9\">Article 51A<\/a>  enjoins every  citizen  to\t improve  excellence<br \/>\nindividually and  collectively so that the nation constantly<br \/>\nrises  to   higher  levels,   socially,\t  economically\t and<br \/>\nculturally. Right to development assured by the Constitution<br \/>\nis held\t to  be\t a  fundamental\t right.\t So  the  policy  of<br \/>\nreservation  in\t  the  preamble\t of  the  Constitution,\t the<br \/>\nfundamental rights  under Articles  14, 15(1), 15(4), 16(1),<br \/>\n16(4), 16(4A)  46 and  335 and the other related articles is<br \/>\nto give effect to the above constitutional objectives.\n<\/p>\n<p id=\"p_4\">     On the facts, it is not necessary for us to go into the<br \/>\nquestion of  retrospectivity   for the reason that after the<br \/>\naforesaid Resolution  and similar other Resolutions by other<br \/>\ninstitutions  came  to\tbe  passed,  followed  by  agitation<br \/>\ncarried on  by the  antireservationists in  the\t State,\t the<br \/>\nGujarat State Government had constituted as Expert Committee<br \/>\nto go  into the\t question which\t had made 11 recommendations<br \/>\nfor implementation.  One of  the recommendations made by the<br \/>\nsaid  committee\t  was  to  give\t effect\t to  the  policy  of<br \/>\nreservation prospectively.  The Government  had accepted the<br \/>\nrecommendation and agreed thus:\n<\/p>\n<blockquote id=\"blockquote_4\"><p>     &#8220;Orders for  implementation on  the<br \/>\n     recommendations  of   the\tSadhwani<br \/>\n<span class=\"hidden_text\" id=\"span_1\">     Committee Nos.  5, 6,  9, 10 and 11<\/span><br \/>\n     will have prospective effect.&#8221;<\/p><\/blockquote>\n<p id=\"p_5\">     Item 11  relates to  giving effect to the roster system<br \/>\nprospectively. In  that view  of the  matter, the Government<br \/>\nhaving conceded\t to the\t claims of  anti-reservationists and<br \/>\npassed the  resolution to  give\t effect\t to  the  policy  of<br \/>\nreservation in\tpromotions  prospectively,  the\t respondent-<br \/>\nCorporation was\t justified in  passing\tthe  Resolution\t for<br \/>\ngiving effect  to the  policy of reservation in all posts of<br \/>\nclasses I to IV from April 30, 1984. The subsequent impugned<br \/>\nResolution giving  effect to  the roaster  from\t January  1,<br \/>\n1976, there  for, would not be justified in the light of the<br \/>\nResolution passed  by the  Government  on  August  18,\t1985<br \/>\nreferred to earlier.\n<\/p>\n<p id=\"p_6\">     It is  seen that  pending writ  petition some  officers<br \/>\nbelonging to Scheduled Castes and Scheduled Tribes have come<br \/>\nto be  promoted. Since they are only marginal promotions, we<br \/>\ndo not\tlike to\t interfere with the promotions already made.<br \/>\nSubject to sustaining the promotions already, there shall be<br \/>\na direction  that the  Corporation would  keep operating the<br \/>\nroster w.e.f. April 30, 1984 and onwards.\n<\/p>\n<p id=\"p_7\">     The writ petition is disposed of accordingly. No costs.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India G.S.I.C.
