The learned Sessions Judge was further pleased to<br \/>\nconvict and sentence the accused for the offence punishable under<br \/>\n<a href=\"\/doc\/796352\/\" id=\"a_3\">Section 366<\/a> read with <a href=\"\/doc\/112749\/\" id=\"a_4\">Section 114<\/a> of the Indian Penal Code, to<br \/>\nundergo R.I. for 7 years and fine of Rs.3000\/-, in default, further<br \/>\nR.I. for two months.\n<\/p>\n<p id=\"p_1\">\tThe<br \/>\nbrief facts of the prosecution case are as under:\n<\/p>\n<p id=\"p_2\">2.\tThe<br \/>\nallegations levelled against the accused are that the accused &#8211;<br \/>\npresent appellant along with other accused have misguided the<br \/>\ndaughter of the complainant who was about 16 years and the accused<br \/>\nNo.1 gave fake promise for marriage. The main accused kept the<br \/>\ndaughter of the complainant with him for about 18 days and raped the<br \/>\ndaughter of the complainant and present appellant along with other<br \/>\naccused helped the accused No.1 in commission of the offence.<br \/>\nTherefore, the complaint for the offences punishable under <a href=\"\/doc\/619940\/\" id=\"a_5\">Sections<br \/>\n363<\/a>, <a href=\"\/doc\/796352\/\" id=\"a_6\">366<\/a>, <a href=\"\/doc\/1279834\/\" id=\"a_7\">376<\/a> and <a href=\"\/doc\/112749\/\" id=\"a_8\">114<\/a> of the Indian Penal Code being complaint C.R.<br \/>\nNo.I &#8211; 120 of 2005 before Jasdan Police Station against the<br \/>\nappellant along with other co accused.\n<\/p>\n<p id=\"p_3\">3.\tThereafter,<br \/>\nstatements of the witnesses were recorded, panchnama was drawn and<br \/>\naccused were arrested. Against the appellant, charge-sheet was filed<br \/>\nbefore the learned Judicial Magistrate First Class, Jasdan.<br \/>\nThereafter, as the case was exclusively triable by the Court of<br \/>\nSessions, the learned Judicial Magistrate First Class has committed<br \/>\nthe case to the Court of Sessions, which was numbered as Sessions<br \/>\nCase No.20 of 2006.\n<\/p>\n<p id=\"p_4\">4.\tThereafter,<br \/>\nthe charge was framed against the appellant. The appellant and other<br \/>\naccused pleaded not guilty and claimed to be tried.\n<\/p>\n<p id=\"p_5\">5.\tTo<br \/>\nprove the case against the appellant, the prosecution has produced<br \/>\ndocumentary evidence and also examined 8 witnesses before the trial<br \/>\nCourt.\n<\/p>\n<p id=\"p_6\">6.\tThereafter,<br \/>\nafter examining the witnesses, further statement of the appellant &#8211;<br \/>\naccused under <a href=\"\/doc\/767287\/\" id=\"a_9\">Section 313<\/a> of the Code of Criminal Procedure was<br \/>\nrecorded in which the appellant &#8211; accused has denied the case<br \/>\nof the prosecution.\n<\/p>\n<p id=\"p_7\">7.\tAfter<br \/>\nconsidering the oral as well as documentary evidence and after<br \/>\nhearing the parties, learned Presiding officer, 2nd Fast<br \/>\nTrack Court, Rajkot vide judgment and order dated 30.6.2006 held the<br \/>\nappellant &#8211; accused guilty to the charge levelled against him<br \/>\nunder <a href=\"\/doc\/619940\/\" id=\"a_10\">Sections 363<\/a>, <a href=\"\/doc\/796352\/\" id=\"a_11\">366<\/a> and <a href=\"\/doc\/112749\/\" id=\"a_12\">114<\/a> of the Indian Penal Code, as stated<br \/>\nabove.\n<\/p>\n<p id=\"p_8\">8.\tFeeling<br \/>\naggrieved and dissatisfied with the impugned judgment and order of<br \/>\nconviction and sentence passed by the learned Presiding Officer, 2nd<br \/>\nFast Track Court, Rajkot, the present appellant has preferred this<br \/>\nappeal.\n<\/p>\n<p id=\"p_9\">9.\tLearned<br \/>\nadvocate Mr. Gadhvi appearing on behalf of the appellant submitted<br \/>\nthat there were several contradictions between the documentary<br \/>\nevidence and oral evidence led by the witnesses and they were never<br \/>\nproved. Even though the learned Sessions Judge held guilty the<br \/>\nappellant for the offence alleged and convicted the appellant.<br \/>\nTherefore, the order impugned is required to be quashed and set aside<br \/>\nby allowing the appeal.\n<\/p>\n<p id=\"p_10\">10.\tThe<br \/>\nlearned APP Mr. H.L. Jani for the State strongly opposed the<br \/>\nsubmissions made by the learned advocate for the appellant. It was<br \/>\ncontended by learned APP that the judgment and order of the Sessions<br \/>\nCourt is just and proper and as per the provisions of law; the<br \/>\nSessions Court has properly considered the evidence led by the<br \/>\nprosecution and looking to the provisions of law itself it is<br \/>\nestablished that the prosecution has proved the whole ingredients of<br \/>\nthe evidence against the present appellant. Learned APP has also<br \/>\ntaken this Court through the oral as well  as the entire documentary<br \/>\nevidence.\n<\/p>\n<p id=\"p_11\">11.\tI<br \/>\nhave perused the judgment and order and reasons given by the learned<br \/>\nJudge also. I have perused the record of the case and also considered<br \/>\nthe submissions made by the learned advocates for the parties. After<br \/>\nthe considering the evidence, the learned Sessions Judge has held the<br \/>\nappellant guilty of the offences and sentenced the appellant. The<br \/>\nappellant was ordered to undergo R.I. as stated above.\n<\/p>\n<p id=\"p_12\">12.\tLearned<br \/>\nadvocate Mr. Gadhvi  for the appellant argued that he is not arguing<br \/>\nthis matter on merits, but arguing only on the quantum of punishment.<br \/>\nHe submitted that the date of the arrest of the appellant is<br \/>\n6.11.2005. Therefore, looking to the period undergone is one year,<br \/>\ntwo months and 49 days, the appellant has passed in jail and<br \/>\ntherefore, his undergone sentence may be treated as sentence. He also<br \/>\nadmitted that the present appellant is involved in the serious<br \/>\noffence, but considering the period undergone by him and he is not<br \/>\nmain accused, hence, this appeal is required to be considered on the<br \/>\nquantum of punishment.\n<\/p>\n<p id=\"p_13\">13.\tI<br \/>\nhave considered his submission about the quantum of punishment and<br \/>\nthe appellant is in jail from 6.11.2005 and, therefore, looking to<br \/>\nthe quantum of punishment, the sentence undergone by the appellant is<br \/>\nrequired to be considered as sentence. Learned APP Mr. Jani has no<br \/>\nobjection if the undergone period may be treated as sentence. He has<br \/>\nproduced jail report of the appellant, which is taken on record. Even<br \/>\nthe sentence which is imposed upon appellant is very harsh in nature<br \/>\nfor the offences under <a href=\"\/doc\/619940\/\" id=\"a_13\">Section 363<\/a>, <a href=\"\/doc\/796352\/\" id=\"a_14\">366<\/a> and <a href=\"\/doc\/112749\/\" id=\"a_15\">114<\/a> of the Indian Penal<br \/>\nCode.\n<\/p>\n<p id=\"p_14\">14.\tIn<br \/>\nview of the above, the Appeal is partly allowed. The judgment<br \/>\nand order dated 30.6.2006 passed by the learned Presiding Officer,<br \/>\n2nd Fast Track Court, Rajkot in Sessions Case No.20 of<br \/>\n2006, is hereby modified to the extent that the sentence, which the<br \/>\nappellant has undergone shall be treated as sentence. Rest of the<br \/>\njudgment of the learned Sessions Court  shall remain unaltered. Now,<br \/>\nthe appellant is on bail, therefore, bail bonds, if any, shall stands<br \/>\ncancelled.
