How many Commissioners are working in Central<br \/>\n               Information Commission, their names and Office address<br \/>\n               may kindly be provided.\n<\/p><\/blockquote>\n<p id=\"p_2\">2.             Besides Commissioners, how many employees, permanent \/<br \/>\ntemporary &amp; outsourced are employed in CIC? Please provide list. Also<br \/>\nprovide details of names and designations of officers posted with each\/<br \/>\nwhich Commissioner.\n<\/p>\n<p id=\"p_3\">        PS<br \/>\n\u2022              There is provision of penalty u\/s 20(1)(2) for non-supply of<br \/>\ninformation in time.\n<\/p>\n<p id=\"p_4\">\u2022              The information asked for is not exempt u\/s 8 and u\/s 8(1)(J)<br \/>\nany information which can be placed before Parliament cannot be denied<br \/>\nto any citizen.\n<\/p>\n<p id=\"p_5\">\u2022              U\/s 7(9) information has to be provided in the manner it is<br \/>\nsought by appellant.\n<\/p>\n<p id=\"p_6\">\u2022              U\/s 2(J)(i)(ii) appellant has right to inspect any records \/<br \/>\ndocuments and obtain certified copies of the same.<br \/>\n\u2022              U\/s 7(3)(a) appellant has to be provided details of charges<br \/>\ndemand additionally.\n<\/p>\n<p id=\"p_7\">         To this Shri Khemani received a response dated 18.12.08 point wise from<br \/>\nCPIO Shri Tarun Kumar, as follows:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>         Point No.1<br \/>\n         There are 7 Information Commissioners in the Central Information<br \/>\n         Commission at present. &#8211; (1) Shri A. N.Tiwari, (2) Shri M. M.<br \/>\n         Ansari, (3) Shri Satyanand Mishra (4) Shri M. L. Sharma. These all<br \/>\n         four Commissioners sit in 2nd floor of August Kranti Bhawan, Bhikaji<br \/>\n         Kama Place, New Delhi-110066 and remaining three Information<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                          1<\/span><br \/>\n      Commissioners (1) Shri O. P. Kejariwal (2) Smt. Annapurna Dixit<br \/>\n     (3) Shri Shailesh Gandhi sit in Block No. 4, Old J.N.U. Campus,<br \/>\n     Near Post Office, New Delhi-110067.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>     Point No. 2:\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_3\"><p>     Permanent staff gets frequent transfers. Therefore, no such record<br \/>\n     is maintained. The present posting of permanent staff is attached.<br \/>\n     No records are maintained in respect of Temporary \/ Outsourced\/<br \/>\n     Self employed staff. Under Secretaries and Consultants posted<br \/>\n     with the Information Commissioners, as designated officers are as<br \/>\n     under:\n<\/p><\/blockquote>\n<p id=\"p_8\">1.              With Shri A.N.Tiwari &#8211; Shri D.C.Singh, US\n<\/p>\n<p id=\"p_9\">2.              With Shri M.M.Ansari &#8211; Shri M.C.Sharma, U.S.\n<\/p>\n<p id=\"p_10\">3.              With Shri Satyanand Mishra, Shri Vijay Bhalla,<br \/>\nConsultant.\n<\/p>\n<p id=\"p_11\">4.              With Shri M. L.Sharma, Shri K.L. Dass Consultant\n<\/p>\n<p id=\"p_12\">5.              With Shri O. P. Kejariwal Shri G. Subramaniam, US\n<\/p>\n<p id=\"p_13\">6.              With Smt. Annapurna Dixit Shri K. G. Nayar, Consultant<br \/>\nand\n<\/p>\n<p id=\"p_14\">7.              With Shri Shailesh Gandhi, Shri S. L. Bhuttan,<br \/>\nConsultant.&#8221;\n<\/p>\n<p id=\"p_15\">      Aggrieved, Shri Khemani moved an appeal before the First Appellate<br \/>\nAuthority, Central Information Commission on 23.12.08 with the following plea:\n<\/p>\n<blockquote id=\"blockquote_4\"><p>       &#8220;About strength of staff at CIC and with different Commissioners.<br \/>\n       The application was given at CAPIO Deptt. of Posts on 10.11.2008,<br \/>\n       which was forwarded to PIO on 14.11.2008. The question about its<br \/>\n       receipt on 11.12.2008 cannot be admitted which might have<br \/>\n       occurred due to internal inefficiency.\n<\/p><\/blockquote>\n<p id=\"p_16\">1.     Regarding Point No. 1 the information as given is not correct, the<br \/>\nname of Shri Wajahat Habibullah does not appear here.\n<\/p>\n<p id=\"p_17\">2.     The detail of staff attached with Commissioners as provided is not<br \/>\nin correct order. The list of Temporary\/ Casual\/ Volunteer staff\/ assistance<br \/>\nas stated not to be maintained cannot be accepted, for an important Public<br \/>\nAuthority anybody or everybody cannot have access to the official files or<br \/>\nduties.&#8221;\n<\/p>\n<p id=\"p_18\">      Upon this, Shri Mohammed Haleem Khan, Secretary &amp; Appellate Authority<br \/>\nissued notice of hearing on 16.1.09 scheduled for 28.1.09. Although the matter<br \/>\nwas heard on 29.1.09 appellant had not received an order leading him to move a<br \/>\nsecond appeal before us on 9.2.09, asking for the following:\n<\/p>\n<blockquote id=\"blockquote_5\"><p>             &#8220;1.    The true information as applied.\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\" id=\"span_1\">                                        2<\/span><\/p>\n<blockquote id=\"blockquote_6\"><p>       2.     The PIO and FAA above named be directed to compensate<br \/>\n             your appellant for the cost of attending the hearing before<br \/>\n             the Commission.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_7\"><p>      3.     Penal action under <a href=\"\/doc\/562105\/\" id=\"a_1\">section 20<\/a> (1) &amp; (2) be initiated against<br \/>\n             the CPIO.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_8\"><p>      4.     In case CPIO fails to furnish the information then he should<br \/>\n             be directed to file an affidavit on NJ Stamp Paper recording<br \/>\n             the reasons thereof.&#8221;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_9\"><p>      Appellant Shri Khemani has also contended as below:<br \/>\n      &#8220;The PIO above named has not provided the true information; to<br \/>\n      hide the facts has stated that no records of Temporary\/ contract or<br \/>\n      volunteer workers are not maintained. In case this statement is<br \/>\n      true the PIO may be directed to submit an affidavit stating the<br \/>\n      above facts.&#8221;<\/p><\/blockquote>\n<p id=\"p_19\">      The appeal was heard on 16.6.10 with arrangement for videoconference<br \/>\nwith Aligarh. However, on that day, Shri Vinod Kumar Varshney appeared before<br \/>\nus at CIC chambers with a letter of authority from appellant Shri Vimal Kumar<br \/>\nKhemani dated 5.5.10, which has been placed on record.\n<\/p>\n<p id=\"p_20\">      Respondent JS Shri Tarun Kumar, CPIO displayed a received copy&#8217; of the<br \/>\nRTI application of 6.11.08 which carries the dated stamp of 11.12.08, as the date<br \/>\nof its delivery in the Commission. CPIO has in fact responded to the application<br \/>\nwithin a week. CPIO also submitted that a supplementary response had been<br \/>\nprovided to appellant with the complete list of Information Commissioners<br \/>\nincluding Chief Information Commissioner. The latter was conceded by Shri<br \/>\nVarshney, who, however, submitted that with regard to the staffing of the<br \/>\nCommissioner&#8217;s Offices the only information that was provided was that this<br \/>\nstaffing is constantly changing. What he needed was the staffing on the date that<br \/>\nhe had moved his application.\n<\/p>\n<p id=\"p_21\">      On the question of outsourced employees, it was the contention of CPIO<br \/>\nShri Tarun Kumar that the list of these employees is maintained by the<br \/>\nOutsource Agency.     The Commission, on the basis of the numbers and the<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">                                       3<\/span><br \/>\n categories involved, makes payment to that Agency every month, which Agency<br \/>\nthen is expected to maintain the records. He, however, clarified that when the<br \/>\nAgency&#8217;s period of engagement terminates, the complete record is taken over by<br \/>\nthe Commission so that the Commission remains in a position to actually access<br \/>\ninformation regarding employees available in the Commission, on a particular<br \/>\ndate.\n<\/p>\n<p id=\"p_22\">                               DECISION NOTICE<\/p>\n<p>        To satisfy appellant Shri Khemani that his application of 6.11.08 was<br \/>\nindeed received in this Commission only on 11.12.08, a copy of the stamped<br \/>\napplication will be provided to him. No such copy was sought in the first appeal,<br \/>\nwhich only complains of the delay in response. On the question of staffing of the<br \/>\noffices of each of the Information Commissioners, the plea of appellant is<br \/>\nallowed. CPIO Shri Tarun Kumar will now provide to Shri Vimal Khemani the<br \/>\ncomplete list of employees assigned to the Offices of each of the Information<br \/>\nCommissioners on the date that the application was made i.e. 6.11.08. Similarly,<br \/>\nsince CPIO Shri Tarun Kumar JS now has that information, as he has conceded<br \/>\nin the hearing, he will also provide a list of outsourced employees available on<br \/>\nthe above date in the Commission.\n<\/p>\n<p id=\"p_23\">        CPIO is further directed that even though it is not necessary that the<br \/>\nrecord of outsourced employees be maintained in the Commissions offices, it<br \/>\nmust be ensured that the control of this office on such information remains intact<br \/>\nand constant. Hence to bring the processes of administering this Commission<br \/>\ninto full compliance with the <a href=\"\/doc\/671631\/\" id=\"a_2\">RTI Act<\/a> 2005, CPIO is directed u\/s 19 (8) (a) that in<br \/>\nany agreement with the Outsource Agency, a clause will be required to be added<br \/>\nto ensure full that these records will be made available to the Commission<br \/>\nwhenever required, even during the existence of an ongoing contract of the<br \/>\nCommission with the Agency. To this extent the appeal is allowed. There will be<br \/>\nno costs.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_3\">                                        4<\/span><\/p>\n<p id=\"p_24\">        Announced in the hearing.
