DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 02\/12\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p id=\"p_1\">1.\t\t\tThis<br \/>\napplication is filed under <a href=\"\/doc\/1290514\/\" id=\"a_1\">Section 439<\/a> of the Code of Criminal<br \/>\nProcedure in connection with first information report registered<br \/>\nbeing CR No.I- 70 of 2010 with Kamlabaugh Police Station,  for the<br \/>\noffences punishable under <a href=\"\/doc\/1495318\/\" id=\"a_1\">Sections 344<\/a>, <a href=\"\/doc\/996413\/\" id=\"a_2\">347<\/a>, <a href=\"\/doc\/886598\/\" id=\"a_3\">365<\/a>, <a href=\"\/doc\/839778\/\" id=\"a_4\">380<\/a>, <a href=\"\/doc\/1865117\/\" id=\"a_5\">397<\/a>, <a href=\"\/doc\/1317063\/\" id=\"a_6\">465<\/a>, <a href=\"\/doc\/1985627\/\" id=\"a_7\">467<\/a>,<br \/>\n<a href=\"\/doc\/556166\/\" id=\"a_8\">468<\/a>, <a href=\"\/doc\/1466184\/\" id=\"a_9\">471<\/a>, <a href=\"\/doc\/455468\/\" id=\"a_10\">307<\/a> and <a href=\"\/doc\/1897847\/\" id=\"a_11\">120B<\/a> of the  Indian Penal Code.\n<\/p>\n<p id=\"p_1\">\t\tMr.  learned<br \/>\ncounsel appearing for the applicant, referring  to the FIR,  submits<br \/>\nthat  the manner in which the offence  is alleged to have been<br \/>\ncommitted about illegal confinement is unnatural. He submitted that<br \/>\nno civil proceedings have been filed for cancellation of  any of the<br \/>\ndocuments which arer alleged to have been forcibly signed. He further<br \/>\nsubmitted that the other co-accused has been enlarged as per order<br \/>\ndated 16.11.2010 passed in Criminal Misc. Application No.12344 of<br \/>\n2010 and, therefore, the present application may be allowed.\n<\/p>\n<p id=\"p_2\">\t\tLearned APP<br \/>\nresisted the application and submitted that the specific role has<br \/>\nbeen attributed to the applciant that he had taken the victim and<br \/>\nthereafter the victim was illegallyy confined.  Therefore,<br \/>\nconsidering the gravity of the offence this application may not be<br \/>\nentertained.\n<\/p>\n<p id=\"p_3\">3.\t\tHaving heard<br \/>\nlearned counsel for the parties and perusing the record of the case<br \/>\nand taking into consideration the facts of the case, nature of<br \/>\nallegations, role attributed to the accused and punishment prescribed<br \/>\nfor the alleged offences, I am inclined to enlarge the applicant on<br \/>\nbail.\n<\/p>\n<p id=\"p_4\">\t\tLearned counsel<br \/>\nfor the parties do not press for further reasoned order.\n<\/p>\n<p id=\"p_5\">4.\t\tIn the facts<br \/>\nand circumstances of the case, the application is allowed and the<br \/>\napplicant is ordered to be released on bail in connection with first<br \/>\ninformation report registered being  C.R. No.I &#8211; 70 of 2010 with<br \/>\nKamlabaugh Police Station on executing a bond of Rs.5,000\/- (Rupees<br \/>\nFive thousand only) with one surety of the like amount to the<br \/>\nsatisfaction of the trial Court and subject to the conditions that he<br \/>\nshall;\n<\/p>\n<p id=\"p_6\">not<br \/>\n\ttake undue advantage of liberty or misuse liberty;\n<\/p>\n<p id=\"p_7\">not<br \/>\n\tact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p id=\"p_8\">surrender<br \/>\n\tpassport, if any, to the lower court within a week;\n<\/p>\n<p id=\"p_9\">not<br \/>\n\tleave the State of Gujarat without prior permission of the Sessions<br \/>\n\tJudge concerned;\n<\/p>\n<p id=\"p_10\">mark<br \/>\n\tpresence at the concerned police station on the first Sunday of<br \/>\n\tevery month between 10.00 a.m. and 3.00 p.m. for three months only;\n<\/p>\n<p id=\"p_11\">furnish<br \/>\n\tthe present address of his residence to the I.O. and also to the<br \/>\n\tCourt at the time of execution of the bond and shall not change the<br \/>\n\tresidence without prior permission of this Court;\n<\/p>\n<p id=\"p_12\">\t\tThe<br \/>\nAuthorities will release the applicant only if not required in<br \/>\nconnection with any other offence for the time being.\n<\/p>\n<p id=\"p_13\">\t\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or take appropriate<br \/>\naction in the matter.\n<\/p>\n<p id=\"p_14\">\t\tBail<br \/>\nbond to be executed before the lower court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p id=\"p_15\"> At the trial, the trial court shall not be influenced by the<br \/>\nobservations of preliminary nature, qua the evidence at this stage,<br \/>\nmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p id=\"p_16\">\t\tRule<br \/>\nis made absolute to the aforesaid extent.
