Justice K.T.SANKARAN\n\n Dated :18\/01\/2010\n\n O R D E R\n                          K.T.SANKARAN, J.\n             ------------------------------------------------------\n                       B.A. NO. 7742 OF 2009\n             ------------------------------------------------------\n            Dated this the 18th day of January, 2010\n\n\n                                O R D E R\n<\/pre>\n<p id=\"p_1\">      This is an application for bail under <a href=\"\/doc\/1290514\/\" id=\"a_1\">Section 439<\/a> of the Code of<\/p>\n<p>Criminal Procedure. The petitioner is accused No.1 in Crime No.497<\/p>\n<p>of 2009 of Chandera Police Station, Kasaragod District.<\/p>\n<p id=\"p_1\">      2. The offence alleged against the petitioner is under <a href=\"\/doc\/770661\/\" id=\"a_1\">Section<\/p>\n<p>436<\/a> read with <a href=\"\/doc\/37788\/\" id=\"a_2\">Section 34<\/a> of the Indian Penal Code.<\/p>\n<p id=\"p_2\">      3. The prosecution case is that on 15.12.2009 at 2.45 AM, the<\/p>\n<p>accused persons set fire to Marar Smrithi Mandapam in Thrikaripur<\/p>\n<p>Village. The petitioner was arrested on 17.12.2009. He is in judicial<\/p>\n<p>custody since then.\n<\/p>\n<p id=\"p_3\">\n<p id=\"p_4\">      4. Taking into account the facts and circumstances of the<\/p>\n<p>case, the duration of the judicial custody undergone by the petitioner,<\/p>\n<p>the nature of the offence and the present stage of investigation, I am<\/p>\n<p>of the view that bail can be granted to the petitioner.<\/p>\n<p>B.A. NO. 7742 OF 2009<\/p>\n<p>                                     :: 2 ::\n<\/p>\n<p id=\"p_5\">\n<p id=\"p_6\">      5. The petitioner shall be released on bail on his executing<\/p>\n<p>bond for Rs.25,000\/- with two solvent sureties for the like amount to<\/p>\n<p>the satisfaction of the Judicial Magistrate of the First Class &#8211; I,<\/p>\n<p>Hosdurg, subject to the following conditions:<\/p>\n<blockquote id=\"blockquote_1\"><p>      a)     The petitioner shall report before the investigating officer<br \/>\n             between 9 A.M.       and 11 A.M. on all Mondays and<br \/>\n             Thursdays, till the final report is filed or until further<br \/>\n             orders;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>      b)     The petitioner shall appear before the investigating<br \/>\n             officer for interrogation as and when required;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>      c)     The petitioner shall not try to influence the prosecution<br \/>\n             witnesses or tamper with the evidence;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_3\"><p>      d)     The petitioner shall not commit any offence or indulge in<br \/>\n             any prejudicial activity while on bail;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_4\"><p>      e)     In case of breach of any of the conditions mentioned<br \/>\n             above, the bail shall be liable to be cancelled.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_5\"><p>      The Bail Application is allowed as above.<\/p><\/blockquote>\n<p id=\"p_7\">\n<p id=\"p_8\">                                                    (K.T.SANKARAN)<br \/>\n                                                           Judge<\/p>\n<p>ahz\/<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court K.Shahul Hameed vs The Station House Officer on 18 January, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 7742 of 2009() 1.
