These writ petitions raise the question of applicability of the<\/p>\n<p>  Right to <a href=\"\/doc\/1965344\/\" id=\"a_1\">Information Act<\/a>, 2005, hereinafter, the &#8216;<a href=\"\/doc\/671631\/\" id=\"a_1\">RTI Act<\/a>&#8216;, to<\/p>\n<p>  co-operative societies registered under the Kerala Co-<\/p>\n<p>  operative <a href=\"\/doc\/1700055\/\" id=\"a_2\">Societies Act<\/a>, 1969, for short, the &#8216;KCS Act&#8217;.<\/p>\n<p id=\"p_2\">2. The Registrar of Co-operative Societies issued circular<\/p>\n<p>  No.23\/06, taking the view that all co-operative societies<\/p>\n<p>  registered under the KCS Act, hereinafter, for short, the<\/p>\n<p>  &#8216;societies&#8217;, are under the administrative control of the<\/p>\n<p>  Registrar and therefore, public authorities for the purpose of<\/p>\n<p>  the <a href=\"\/doc\/671631\/\" id=\"a_3\">RTI Act<\/a>.    Directions were hence issued, requiring all<\/p>\n<p>  societies to discharge the obligations as public authorities<\/p>\n<p>WPC.18175\/06 &amp; con. Cases<\/p>\n<p>                             Page numbers<\/p>\n<p>  under the <a href=\"\/doc\/671631\/\" id=\"a_4\">RTI Act<\/a> and to follow the procedure stated therein.<\/p>\n<p>  The Information Officers in the Co-operative Department of<\/p>\n<p>  the State Government commenced acting on complaints of<\/p>\n<p>  non-consideration of requests for information made by<\/p>\n<p>  different persons to societies. These writ petitions are hence<\/p>\n<p>  filed, seeking to quash the aforesaid circular and for a<\/p>\n<p>  declaration that the <a href=\"\/doc\/671631\/\" id=\"a_5\">RTI Act<\/a> does not apply to societies<\/p>\n<p>  registered under the KCS Act. Certain actions taken by the<\/p>\n<p>  officers under the KCS Act and orders issued by the State<\/p>\n<p>  Information Commission touching the issue, in individual<\/p>\n<p>  cases, are also under challenge.\n<\/p>\n<p id=\"p_3\">\n<p id=\"p_4\">3. In its gist, the contention advanced by the petitioners is that<\/p>\n<p>  the societies are not public authorities as defined in <a href=\"\/doc\/277989\/\" id=\"a_6\">Section 2<\/a><\/p>\n<p id=\"p_5\">  (h) of the <a href=\"\/doc\/671631\/\" id=\"a_7\">RTI Act<\/a>, but are establishments over which, the<\/p>\n<p>  statutory provisions under the KCS Act and Kerala Co-<\/p>\n<p>  operative Societies Rules 1969, for short, the &#8216;KCS Rules&#8217;,<\/p>\n<p>  framed under that Act, apply, providing access to information<\/p>\n<p>  by recourse to those procedures. On behalf of the petitioners,<\/p>\n<p>WPC.18175\/06 &amp; con. Cases<\/p>\n<p>                               Page numbers<\/p>\n<p>  it is argued that societies are not established or constituted by<\/p>\n<p>  or under the Constitution; by any other law made by<\/p>\n<p>  Parliament; by any other law made by the State Legislature or<\/p>\n<p>  by notification issued or order made by the appropriate<\/p>\n<p>  Government and that they are not bodies owned, controlled or<\/p>\n<p>  substantially financed by funds provided by the appropriate<\/p>\n<p>  Government and hence, do not fall within the definition of<\/p>\n<p>  &#8220;public authority&#8221; under <a href=\"\/doc\/277989\/\" id=\"a_8\">Section 2<\/a> (h) of the <a href=\"\/doc\/671631\/\" id=\"a_9\">RTI Act<\/a>.       The<\/p>\n<p>  obligation to act in terms of <a href=\"\/doc\/13503\/\" id=\"a_10\">Section 4<\/a> (1) of the <a href=\"\/doc\/671631\/\" id=\"a_11\">RTI Act<\/a> is<\/p>\n<p>  confined only to &#8220;public authorities&#8221; as defined in that Act and<\/p>\n<p>  therefore, the Registrar of Co-operative Societies had acted<\/p>\n<p>  contrary to the statutory provisions and without authority, in<\/p>\n<p>  issuing the impugned circular, it is contended.<\/p>\n<p id=\"p_6\">4.Per contra, on behalf of the State of Kerala, the Registrar of<\/p>\n<p>  Co-operative Societies, the State Information Commission and<\/p>\n<p>  the contesting private respondents, it is argued that the<\/p>\n<p>  applicability of       <a href=\"\/doc\/671631\/\" id=\"a_12\">RTI Act<\/a> to societies cannot be excluded in<\/p>\n<p>  terms of the clear provisions contained in the <a href=\"\/doc\/671631\/\" id=\"a_13\">RTI Act<\/a> and that<\/p>\n<p>WPC.18175\/06 &amp; con. Cases<\/p>\n<p>                               Page numbers<\/p>\n<p>   the provisions available in the KCS Act and Rules thereunder<\/p>\n<p>   is no answer to exclude the applicability of the <a href=\"\/doc\/671631\/\" id=\"a_14\">RTI Act<\/a>. It is<\/p>\n<p>   further argued that there is no ambiguity in the <a href=\"\/doc\/671631\/\" id=\"a_15\">RTI Act<\/a> and<\/p>\n<p>   the same has to be interpreted to give effect to that Act. It is<\/p>\n<p>   further argued that at any rate, having regard to the definition<\/p>\n<p>   of &#8216;information&#8217; in <a href=\"\/doc\/277989\/\" id=\"a_16\">Section 2<\/a> (f) of the <a href=\"\/doc\/671631\/\" id=\"a_17\">RTI Act<\/a>, the access to<\/p>\n<p>   information in relation to societies cannot be denied.<\/p>\n<p>   Is the right to information in relation to co-<br \/>\n   operative societies available under the <a href=\"\/doc\/671631\/\" id=\"a_18\">RTI Act<\/a>?<\/p>\n<p id=\"p_7\">5. <a href=\"\/doc\/1979161\/\" id=\"a_19\">Section 3<\/a> of the RTI Act states that subject to the provisions of<\/p>\n<p>   that Act, all citizens shall have the right to information.<\/p>\n<p>   <a href=\"\/doc\/277989\/\" id=\"a_20\">Section 2<\/a> (f) of the <a href=\"\/doc\/671631\/\" id=\"a_21\">RTI Act<\/a> which defines &#8216;information&#8217; reads<\/p>\n<p>   as follows:\n<\/p>\n<p id=\"p_8\">\n<p>      &#8220;Information&#8221; means any material in any form,<br \/>\n      including       records, documents,   memos,    e-mails,<br \/>\n      opinions, advices, press releases, circulars, orders,<br \/>\n      logbooks,contracts, reports, papers, samples, models,<br \/>\n      data material held in any electronic form and<br \/>\n      information relating to any private body which can be<\/p>\n<p>WPC.18175\/06 &amp; con. Cases<\/p>\n<p>                             Page numbers<\/p>\n<p>      accessed by a public authority under any other law for<br \/>\n      the time being in force.\n<\/p>\n<p id=\"p_9\">\n<p id=\"p_10\">6.Going by the afore-quoted, information relating to any private<\/p>\n<p>  body, which can be accessed by a public authority under any<\/p>\n<p>  other law for the time being in force is information.         The<\/p>\n<p>  definition of the word &#8216;information&#8217; as provided in <a href=\"\/doc\/277989\/\" id=\"a_22\">Section 2<\/a> (f)<\/p>\n<p>  has also to be applied to the word &#8216;information&#8217; occurring in<\/p>\n<p>  that clause itself.      Therefore, information relating to any<\/p>\n<p>  private body which can be accessed by a public authority<\/p>\n<p>  includes all materials in      any form which are enumerated<\/p>\n<p>  before the use of the conjunction &#8216;and&#8217; before the word<\/p>\n<p>  &#8216;information&#8217; occurring in <a href=\"\/doc\/277989\/\" id=\"a_23\">Section 2<\/a> (f), in relation to private<\/p>\n<p>  bodies.\n<\/p>\n<p id=\"p_11\">\n<p id=\"p_12\">7.It is the contention of the petitioners themselves that the<\/p>\n<p>  provisions of the KCS Act and Rules empower access to<\/p>\n<p>  information, following those rules.    This is so, pithily because<\/p>\n<p>  the statutory powers under the KCS Act and KCS Rules are<\/p>\n<p>WPC.18175\/06 &amp; con. Cases<\/p>\n<p>                              Page numbers<\/p>\n<p> available to the Registrar of Co-operative Societies, appointed<\/p>\n<p> by the Government under <a href=\"\/doc\/1979161\/\" id=\"a_24\">Section 3<\/a> (1) of the KCS Act and to<\/p>\n<p> all other officers on whom the powers of the Registrar are<\/p>\n<p> conferred by the Government in exercise of statutory authority<\/p>\n<p> under <a href=\"\/doc\/1979161\/\" id=\"a_25\">section 3<\/a> (2) of that Act and to different officers in the<\/p>\n<p> hierarchy of the executive establishment on whom powers are<\/p>\n<p> conferred or delegated by or under the KCS Act and KCS<\/p>\n<p> Rules. Those authorities are, beyond doubt, public authorities<\/p>\n<p> for the purpose of the <a href=\"\/doc\/671631\/\" id=\"a_26\">RTI Act<\/a>, they being personnel of the<\/p>\n<p> government service establishment, which is established and<\/p>\n<p> constituted by or under the Constitution and the laws made by<\/p>\n<p> the State Legislature, including the Kerala Public Services<\/p>\n<p> Act, 1968.         Over and above that, different provisions in the<\/p>\n<p> KCS Act and Rules provide for audit, enquiry, supervision,<\/p>\n<p> inspection,        surcharge  proceedings,    power    to  compel<\/p>\n<p> production of documents etc. These provisions indisputably<\/p>\n<p> and unequivocally empower the different officers of the Co-<\/p>\n<p> operative Department in the Government to access information<\/p>\n<p>WPC.18175\/06 &amp; con. Cases<\/p>\n<p>                              Page numbers<\/p>\n<p>  as defined in <a href=\"\/doc\/277989\/\" id=\"a_27\">Section 2<\/a> (f) of the <a href=\"\/doc\/671631\/\" id=\"a_28\">RTI Act<\/a> in so far as they relate<\/p>\n<p>  to any co-operative society.\n<\/p>\n<p id=\"p_13\">\n<p id=\"p_14\">8.Unlike in the <a href=\"\/doc\/411331\/\" id=\"a_29\">Freedom of Information Act<\/a>, 2002, hereinafter<\/p>\n<p>  referred to as the `FOI Act&#8217; (which stands repealed as per<\/p>\n<p>  <a href=\"\/doc\/1443302\/\" id=\"a_30\">Section 31<\/a> of the RTI Act), in the <a href=\"\/doc\/671631\/\" id=\"a_31\">RTI Act<\/a>, &#8220;information&#8221; means<\/p>\n<p>  materials in any form, including the different types and modes<\/p>\n<p>  noticed in the definition of that term in <a href=\"\/doc\/1516599\/\" id=\"a_32\">Section 2(f)<\/a> and<\/p>\n<p>  information relating to any private body which can be accessed<\/p>\n<p>  by a public authority under any other law for the time being in<\/p>\n<p>  force. For the purpose of the FOI Act, going by <a href=\"\/doc\/1155447\/\" id=\"a_33\">Section 2(b)<\/a><\/p>\n<p>  thereof, &#8220;information&#8221; meant any material in any form relating<\/p>\n<p>  to the administration, operations or decisions of a public<\/p>\n<p>  authority. This change in the amplitude of the statute law<\/p>\n<p>  relating to the field of freedom, right and access to information<\/p>\n<p>  is noticed to conclude forthwith that even if societies are to<\/p>\n<p>  be treated only as private bodies, in view of the availability of<\/p>\n<p>  different provisions under various other laws in force,<\/p>\n<p>  including the KCS Act and the KCS Rules providing access to<\/p>\n<p>WPC.18175\/06 &amp; con. Cases<\/p>\n<p>                             Page numbers<\/p>\n<p>  information relating to any society by public authorities, such<\/p>\n<p>  accessible information would fall within the term &#8220;information&#8221;<\/p>\n<p>  for the purpose of the <a href=\"\/doc\/671631\/\" id=\"a_34\">RTI Act<\/a>.\n<\/p>\n<p id=\"p_15\">\n<p id=\"p_16\">9.Therefore, even if a co-operative society is a private body, any<\/p>\n<p>  person who desires to obtain any information in relation to a<\/p>\n<p>  society, is entitled to move the competent public authority and<\/p>\n<p>  such information in relation to a       society would then be<\/p>\n<p>  accessible through that public authority, unless the access to<\/p>\n<p>  such information is forbidden by the <a href=\"\/doc\/671631\/\" id=\"a_35\">RTI Act<\/a>.         Access to<\/p>\n<p>  information is therefore available to citizens in relation to all<\/p>\n<p>  co-operative societies, in terms of the <a href=\"\/doc\/671631\/\" id=\"a_36\">RTI Act<\/a>.<\/p>\n<p id=\"p_17\">     Are        the       co-operative     societies     &#8220;public<br \/>\n  authorities&#8221; for the purpose of the <a href=\"\/doc\/671631\/\" id=\"a_37\">RTI Act<\/a>, to be<br \/>\n  compelled to perform the statutory duties<br \/>\n  imposed through the provisions of the <a href=\"\/doc\/671631\/\" id=\"a_38\">RTI Act<\/a>,<br \/>\n  occurring in Chapter II of that Act, particularly<br \/>\n  <a href=\"\/doc\/13503\/\" id=\"a_39\">Sections 4<\/a> to <a href=\"\/doc\/641228\/\" id=\"a_40\">11<\/a> thereof?\n<\/p>\n<p id=\"p_18\">WPC.18175\/06 &amp; con. Cases<\/p>\n<p>                                Page numbers<\/p>\n<p id=\"p_19\">10. Since it was pointed out that <a href=\"\/doc\/1097458\/\" id=\"a_41\">Section 2(h)<\/a> of RTI Act, which<\/p>\n<p> defines &#8220;public authorities&#8221;, has been erroneously quoted in<\/p>\n<p> certain publications, that provision, as available in the Gazette<\/p>\n<p> of India is extracted hereunder:\n<\/p>\n<p id=\"p_20\">\n<blockquote id=\"blockquote_1\"><p>     &#8220;public authority&#8221; means any authority or body or<br \/>\n     institution         of self-government    established  or<br \/>\n     constituted-\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>             (a) by or under the Constitution;<\/p>\n<\/blockquote>\n<blockquote id=\"blockquote_2\"><p>             (b) by any other law made by Parliament;<\/p>\n<\/blockquote>\n<blockquote id=\"blockquote_3\"><p>             (c) by any other law made by State Legislature;<\/p><\/blockquote>\n<blockquote id=\"blockquote_4\"><p>             (d) by notification issued or order made by the<br \/>\n                  appropriate Government,<\/p>\n<p>     and includes any-\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_5\"><p>             (i) body owned, controlled or substantially<br \/>\n                 financed;<\/p><\/blockquote>\n<blockquote id=\"blockquote_6\"><p>             (ii) non-Government organisation substantially<br \/>\n                  financed,<\/p>\n<p>     directly or indirectly by funds provided by the<br \/>\n     appropriate Government;\n<\/p><\/blockquote>\n<p id=\"p_21\">WPC.18175\/06 &amp; con. Cases<\/p>\n<p>                              Page numbers<\/p>\n<p id=\"p_22\">11. The incidence of registration of a society under the KCS Act<\/p>\n<p> is that such registration shall render it a body corporate by the<\/p>\n<p> name under which it is registered, having perpetual succession<\/p>\n<p> and a common seal and with power to hold property, enter into<\/p>\n<p> contracts, institute and defend suits and other legal<\/p>\n<p> proceedings and to do all things necessary for the purpose for<\/p>\n<p> which it was constituted. This provision in Section 9 of the<\/p>\n<p> KCS Act read with the provisions in Chapter X of that Act<\/p>\n<p> would       show       that  societies   are not institutions  or<\/p>\n<p> establishments constituted under that Act.      <a href=\"\/doc\/671631\/\" id=\"a_42\">Sections 71<\/a> to <a href=\"\/doc\/671631\/\" id=\"a_43\">73<\/a><\/p>\n<p> provide for winding up of a society and the modalities therefor.<\/p>\n<p> The effect of cancellation of registration under <a href=\"\/doc\/671631\/\" id=\"a_44\">Section 74<\/a> is<\/p>\n<p> that the status as a corporate body is lost. The final authority<\/p>\n<p> of a society vests in the General Body of its members in terms<\/p>\n<p> of <a href=\"\/doc\/773502\/\" id=\"a_45\">Section 27<\/a> and the General Body constitutes a committee to<\/p>\n<p> be entrusted with the management of the affairs of the society<\/p>\n<p> in terms of Section 28 of the KCS Act. These provisions, put<\/p>\n<p> generally, would show that societies are not established or<\/p>\n<p> constituted by or under the KCS Act or Rules. Therefore, they<\/p>\n<p>WPC.18175\/06 &amp; con. Cases<\/p>\n<p>                             Page numbers<\/p>\n<p> do not fall under sub clauses (a) to (d) of clause (h) of <a href=\"\/doc\/277989\/\" id=\"a_46\">Section<\/p>\n<p> 2<\/a> of the RTI Act.\n<\/p>\n<p id=\"p_23\">\n<p id=\"p_24\">12.The question that then arises would be as to whether<\/p>\n<p> societies would fall under those governed by the expansive<\/p>\n<p> limb of <a href=\"\/doc\/277989\/\" id=\"a_47\">Section 2<\/a> (h) of the <a href=\"\/doc\/671631\/\" id=\"a_48\">RTI Act<\/a>, whereby, public authority<\/p>\n<p> includes any of those which fall under sub clause (i) and (ii) in<\/p>\n<p> the inclusive components of <a href=\"\/doc\/277989\/\" id=\"a_49\">Section 2<\/a> (h).<\/p>\n<p id=\"p_25\">13.Here, the argument on behalf of the petitioners is that the<\/p>\n<p> said portion of <a href=\"\/doc\/277989\/\" id=\"a_50\">Section 2<\/a> (h) is wrongly worded and as it now<\/p>\n<p> stands, admits of multifarious interpretations.     It is argued<\/p>\n<p> that the words &#8220;directly or indirectly by funds provided by the<\/p>\n<p> appropriate Government&#8221; in the last limb of <a href=\"\/doc\/277989\/\" id=\"a_51\">Section 2<\/a> (h) are<\/p>\n<p> essentially vague. It is pointed out that if those words are<\/p>\n<p> placed following sub clause (i), it would amount to reading that<\/p>\n<p> the definition of public authority envisages even control of<\/p>\n<p> bodies by funds provided by the appropriate Government. It is<\/p>\n<p> argued that this is plainly illogical. Next, it is argued that if<\/p>\n<p>WPC.18175\/06 &amp; con. Cases<\/p>\n<p>                             Page numbers<\/p>\n<p> the afore-quoted words really refer only to financing, the word<\/p>\n<p> &#8216;substantially&#8217; has no fixed meaning and in the absence of any<\/p>\n<p> yardstick being prescribed in the <a href=\"\/doc\/671631\/\" id=\"a_52\">RTI Act<\/a>, as regards the<\/p>\n<p> extent of financing envisaged by the legislature to rope an<\/p>\n<p> institution into that Act, there is every likelihood of abuse of<\/p>\n<p> power by the authorities under that statute by misuse of the<\/p>\n<p> provisions thereof.\n<\/p>\n<p id=\"p_26\">\n<p id=\"p_27\">14.Responding, on behalf of the Government and, in particular,<\/p>\n<p> the State Information Commission, it was pithily argued that<\/p>\n<p> having regard to the provisions commencing from <a href=\"\/doc\/1979161\/\" id=\"a_53\">Section 3<\/a> of<\/p>\n<p> the RTI Act and the rights and obligations created thereby,<\/p>\n<p> even if the question calls for a contextual construction, that<\/p>\n<p> needs to be done using the legislative prescription that the<\/p>\n<p> definition clause in <a href=\"\/doc\/277989\/\" id=\"a_54\">Section 2<\/a> of that Act applies only unless<\/p>\n<p> the context otherwise requires. It is contended that having<\/p>\n<p> regard to the purpose of the <a href=\"\/doc\/671631\/\" id=\"a_55\">RTI Act<\/a> and the goal sought to be<\/p>\n<p> achieved by the said piece of legislation, any deficiency which<\/p>\n<p> may be pointed out on a strict but apparently plain reading of<\/p>\n<p>WPC.18175\/06 &amp; con. Cases<\/p>\n<p>                             Page numbers<\/p>\n<p> the provisions of <a href=\"\/doc\/277989\/\" id=\"a_56\">Section 2<\/a> (h) in the definition clause by<\/p>\n<p> applying the punctuations, as          used in the statute, has<\/p>\n<p> necessarily to give way to a purposive construction; if<\/p>\n<p> required, by judicially punctuating the contents of <a href=\"\/doc\/277989\/\" id=\"a_57\">Section 2<\/a><\/p>\n<p id=\"p_28\"> (h).\n<\/p>\n<p id=\"p_29\">\n<p id=\"p_30\">15. The appropriate Government, going by <a href=\"\/doc\/277989\/\" id=\"a_58\">Section 2<\/a> (a) of the<\/p>\n<p> <a href=\"\/doc\/671631\/\" id=\"a_59\">RTI Act<\/a>, is the Central Government or the State Government,<\/p>\n<p> where       that term is used in relation to a public authority,<\/p>\n<p> which is established, constituted, controlled or substantially<\/p>\n<p> financed by funds provided directly or indirectly by the Central<\/p>\n<p> Government\/Union territory administration or by the State<\/p>\n<p> Government, as the case may be.\n<\/p>\n<p id=\"p_31\">\n<p id=\"p_32\">16.In People&#8217;s Union for <a href=\"\/doc\/110957682\/\" id=\"a_60\">Civil Liberties v. Union of India<\/a><\/p>\n<p> [(2003) 4 SCC 399], it was noticed that in the Constitution of<\/p>\n<p> our democratic Republic, among the fundamental freedoms,<\/p>\n<p> freedom of speech and expression shines radiantly in the<\/p>\n<p> firmament of Part III. This cherished freedom has grown from<\/p>\n<p>WPC.18175\/06 &amp; con. Cases<\/p>\n<p>                             Page numbers<\/p>\n<p> strength to strength in the post-independence era and has<\/p>\n<p> been constantly nourished and shaped to new dimensions in<\/p>\n<p> tune with the contemporary needs by the constitutional courts.<\/p>\n<p> Pointing out that <a href=\"\/doc\/438670\/\" id=\"a_61\">State of U.P. v. Raj Narain<\/a> [(1975)4 SCC<\/p>\n<p> 428] is, perhaps, the first decision which has adverted to the<\/p>\n<p> &#8220;right to information&#8221;, Mathew J was quoted &#8211; &#8220;The right to<\/p>\n<p> know, which is derived from the concept of freedom of speech,<\/p>\n<p> though not absolute, is a factor which should make one wary,<\/p>\n<p> when secrecy is claimed for transactions which can, at any<\/p>\n<p> rate, have no repercussion on public security&#8221; and that &#8220;in a<\/p>\n<p> government of responsibility like ours, where all the agents of<\/p>\n<p> the public must be responsible for their conduct, there can be<\/p>\n<p> but few secrets. The people of this country have a right to<\/p>\n<p> know every public act, everything that is done in a pubic way,<\/p>\n<p> by their pubic functionaries.&#8221;        <a href=\"\/doc\/112850760\/\" id=\"a_62\">In S.P.Gupta v. Union of<\/p>\n<p> India<\/a> [(1981) Suppl.SCC 87], the Apex Court noted that &#8220;the<\/p>\n<p> concept of an open government is the direct emanation from<\/p>\n<p> the right to know which seems to be implicit in the right of<\/p>\n<p> free speech and expression guaranteed under <a href=\"\/doc\/1378441\/\" id=\"a_63\">Article 19(1)(a)&#8221;<\/a><\/p>\n<p>WPC.18175\/06 &amp; con. Cases<\/p>\n<p>                              Page numbers<\/p>\n<p> and &#8220;therefore, disclosure of information in regard to the<\/p>\n<p> functioning of Government must be the rule and secrecy an<\/p>\n<p> exception&#8230;&#8230;..&#8221;.      It was emphasised that no democratic<\/p>\n<p> government can survive without accountability and the basic<\/p>\n<p> postulate of accountability is that the people should have<\/p>\n<p> information about the functioning of the Government. After<\/p>\n<p> referring to Raj Narain and S.P.Gupta (supra), the Apex<\/p>\n<p> Court made further reference in PUCL (supra) to <a href=\"\/doc\/716836\/\" id=\"a_64\">Dinesh<\/p>\n<p> Trivedi v. Union of India<\/a> [(1997)4 SCC 306] noticing that in<\/p>\n<p> modern constitutional democracies, it is axiomatic that citizens<\/p>\n<p> have a right to know about the affairs of the Government<\/p>\n<p> which, having been elected by them, seeks to formulate sound<\/p>\n<p> policies of governance aimed at their welfare and that like all<\/p>\n<p> other rights, even this right has recognised limitations and is,<\/p>\n<p> by no means, absolute.\n<\/p>\n<p id=\"p_33\">\n<p id=\"p_34\">17.We, the People of India have constituted ourselves into a<\/p>\n<p> democratic Republic; that Nation and her People, being<\/p>\n<p> governed by the Constitution of India. Democracy requires an<\/p>\n<p>WPC.18175\/06 &amp; con. Cases<\/p>\n<p>                             Page numbers<\/p>\n<p> informed citizenry and transparency of information that are<\/p>\n<p> vital to its functioning. Availability of information is necessary<\/p>\n<p> to contain corruption.      The instrumentalities which meddle<\/p>\n<p> with public funds or with the interest of the citizens are to be<\/p>\n<p> made accountable.           In actual practice, revelation of<\/p>\n<p> information is likely to conflict with other public interests,<\/p>\n<p> including efficient operations of the Governments, optimum<\/p>\n<p> use of limited fiscal resources and the preservation of<\/p>\n<p> confidentiality of sensitive information. It is necessary to<\/p>\n<p> harmonise these conflicting interests while preserving the<\/p>\n<p> paramount status of the democratic ideal. <a href=\"\/doc\/671631\/\" id=\"a_65\">The RTI Act<\/a> is<\/p>\n<p> enacted in this constitutional backdrop. The object sought to<\/p>\n<p> be achieved by that enactment is to provide for setting out the<\/p>\n<p> practical regime of right to information for citizens to secure<\/p>\n<p> access to information.      The purpose of that is to promote<\/p>\n<p> transparency and accountability in the working of every public<\/p>\n<p> authority. <a href=\"\/doc\/671631\/\" id=\"a_66\">The RTI Act<\/a> is a mode to access information. What<\/p>\n<p> may come out ultimately could be the assurance that all is<\/p>\n<p> well; or should be shocking revelations which may call for<\/p>\n<p>WPC.18175\/06 &amp; con. Cases<\/p>\n<p>                             Page numbers<\/p>\n<p> appropriate action. This again, would be a matter of concern<\/p>\n<p> for the citizenry.\n<\/p>\n<p id=\"p_35\">\n<p id=\"p_36\">18.As already noticed, the right to information and, therefore,<\/p>\n<p> the right of access to information are species of fundamental<\/p>\n<p> rights referable to the freedom of speech, enumerated in the<\/p>\n<p> Constitution as a fundamental right. This conceptualization is<\/p>\n<p> part of the law laid by the Apex Court in the precedents noted<\/p>\n<p> above. They are therefore part of the law of the land as<\/p>\n<p> emanating from the Constitution, that too, from Part III itself.<\/p>\n<p> Effectuation of the fundamental rights does not require any<\/p>\n<p> legislation. It inheres unitarily in every citizen and collectively<\/p>\n<p> in the citizenry, as a lot. Legislation can be to effect<\/p>\n<p> restrictions on the enjoyment of the fundamental rights; to the<\/p>\n<p> extent restrictions are permissible within the constitutional<\/p>\n<p> parameters. Or, legislations could provide for the free and<\/p>\n<p> orderly flow of the modality for the enjoyment of those rights.<\/p>\n<p> While the former is a restrictive covenant on the enjoyment<\/p>\n<p> and could affect only those who are entitled to enjoy, the latter<\/p>\n<p>WPC.18175\/06 &amp; con. Cases<\/p>\n<p>                             Page numbers<\/p>\n<p> class of legislative provisions are intended to provide the<\/p>\n<p> procedure to reach at the guaranteed fundamental rights,<\/p>\n<p> hassle-free.\n<\/p>\n<p id=\"p_37\">\n<p id=\"p_38\">19. Analysing the RTI Act with the aforesaid in mind, it can be<\/p>\n<p> seen that the provision in <a href=\"\/doc\/1979161\/\" id=\"a_67\">section 3<\/a> thereof that subject to the<\/p>\n<p> provisions of that Act, all citizens shall have the right to<\/p>\n<p> information, is the legislative recognition of the constitutional<\/p>\n<p> right of every citizen to information, including the right to<\/p>\n<p> access information. The provisions in the <a href=\"\/doc\/671631\/\" id=\"a_68\">RTI Act<\/a>, subject to<\/p>\n<p> which the citizen could enjoy the right to information, are laws<\/p>\n<p> amounting to restrictions made by the Parliament on the right<\/p>\n<p> to information and the right to access information, and<\/p>\n<p> therefore, restrictions on the freedom of speech. The<\/p>\n<p> legitimacy of any such restriction has to answer the<\/p>\n<p> constitutional touchstones. The authority to make such<\/p>\n<p> restriction is provided for and controlled by <a href=\"\/doc\/493243\/\" id=\"a_69\">Article 19(2)<\/a> of the<\/p>\n<p> Constitution. The said provision enumerates the grounds on<\/p>\n<p> which a restriction could be imposed by law on the citizens&#8217;<\/p>\n<p>WPC.18175\/06 &amp; con. Cases<\/p>\n<p>                             Page numbers<\/p>\n<p> fundamental right to freedom of speech and expression. The<\/p>\n<p> authorization to make law imposing reasonable restrictions on<\/p>\n<p> that fundamental right is confined to be only in the interests of<\/p>\n<p> the sovereignty and integrity of India, the security of the State,<\/p>\n<p> friendly relations with Foreign States, public order, decency or<\/p>\n<p> morality or in relation to contempt of court, defamation or<\/p>\n<p> incitement to an offence. Unlike in clause (6) of that Article<\/p>\n<p> which carves out the limits of legislative permissiveness to<\/p>\n<p> impose restrictions on the fundamental right to the freedom to<\/p>\n<p> practice any profession or to carry on any occupation, trade or<\/p>\n<p> business, clause (2) of <a href=\"\/doc\/1218090\/\" id=\"a_70\">Article 19<\/a> does not provide the interest<\/p>\n<p> of the general public as a ground on which the right to<\/p>\n<p> freedom of speech and expression could be curtailed. This<\/p>\n<p> distinction is well established. <a href=\"\/doc\/243002\/\" id=\"a_71\">See Sakal Papers (P) Ltd. V.<\/p>\n<p> Union of India<\/a> [AIR 1962 SC 305]. Unless justified under<\/p>\n<p> clause (2) of <a href=\"\/doc\/1218090\/\" id=\"a_72\">Article 19<\/a>, any restriction on the fundamental<\/p>\n<p> right guaranteed by <a href=\"\/doc\/1378441\/\" id=\"a_73\">Article 19(1) (a)<\/a> would be plainly violative<\/p>\n<p> of the freedom of speech and expression, a valuable and<\/p>\n<p> cherished fundamental right. The parliamentary presentment<\/p>\n<p>WPC.18175\/06 &amp; con. Cases<\/p>\n<p>                              Page numbers<\/p>\n<p> through the <a href=\"\/doc\/671631\/\" id=\"a_74\">RTI Act<\/a> is not a statutory conferment of a right<\/p>\n<p> that could be passed off as merely a statutory right. For,<\/p>\n<p> legislation       cannot   whittle  down  a  fundamental    right<\/p>\n<p> guaranteed under the Constitution.\n<\/p>\n<p id=\"p_39\">\n<p id=\"p_40\">20.Apart from the restrictions imposed by its provisions on the<\/p>\n<p> right to          information inclusive of the right to access<\/p>\n<p> information, which restrictions operate against the conferee of<\/p>\n<p> that fundamental right, namely, the citizen, the <a href=\"\/doc\/671631\/\" id=\"a_75\">RTI Act<\/a> is, as<\/p>\n<p> its preamble declares, enacted to provide the practical regime<\/p>\n<p> of right to information for citizens to secure access to<\/p>\n<p> information.\n<\/p>\n<p id=\"p_41\">\n<p id=\"p_42\">21. The aforesaid and the legislative declaration contained in<\/p>\n<p> <a href=\"\/doc\/1979161\/\" id=\"a_76\">Section 3<\/a> of the RTI Act that all citizens shall have the right to<\/p>\n<p> information, have to be borne in mind while interpreting the<\/p>\n<p> provision &#8220;substantially financed by funds provided directly or<\/p>\n<p> indirectly&#8221; in <a href=\"\/doc\/425882\/\" id=\"a_77\">Section 2(a)<\/a> and the provision &#8220;substantially<\/p>\n<p> financed, directly or indirectly by funds provided by the<\/p>\n<p>WPC.18175\/06 &amp; con. Cases<\/p>\n<p>                             Page numbers<\/p>\n<p> appropriate Government&#8221; as contained in <a href=\"\/doc\/277989\/\" id=\"a_78\">Section 2<\/a> (h), of the<\/p>\n<p> <a href=\"\/doc\/671631\/\" id=\"a_79\">RTI Act<\/a>.         &#8220;Provide&#8221; means to make ready before hand; to<\/p>\n<p> supply; to procure supplies, means or what may be desirable;<\/p>\n<p> make provision. When one proceeds to provide, the intention<\/p>\n<p> is not necessarily that he provides from himself or from his<\/p>\n<p> own bag exclusively. If you provide something that someone<\/p>\n<p> needs or wants, or if you provide them with it, you give it to<\/p>\n<p> them or make it available to them.           If you provide for<\/p>\n<p> someone, you support them financially and make sure that<\/p>\n<p> they have the things that they need.          If you provide for<\/p>\n<p> something that might happen or might need to be done, you<\/p>\n<p> make arrangements to deal with it.          The provisions under<\/p>\n<p> interpretation relate to those which are substantially financed<\/p>\n<p> by funds which are made available to them by the Government.<\/p>\n<p> It is sufficient that the funds reach a society as a result of the<\/p>\n<p> actions taken by the Government, thereby making available,<\/p>\n<p> the necessary finance that is required for the society for its<\/p>\n<p> activities.      The essence of the act of providing is the making<\/p>\n<p> available of what is required to be provided. In this view of the<\/p>\n<p>WPC.18175\/06 &amp; con. Cases<\/p>\n<p>                              Page numbers<\/p>\n<p> matter, &#8220;funds provided by the appropriate Government&#8221; is not<\/p>\n<p> necessarily providing funds from what belong to the<\/p>\n<p> appropriate Government, either exclusively or otherwise, but<\/p>\n<p> also those provisions which come through the machinery of<\/p>\n<p> the appropriate Government, including             by allocation     or<\/p>\n<p> provision of funds with either the concurrence or clearance of<\/p>\n<p> the appropriate Government.         This view emanates on a plain<\/p>\n<p> reading of the provision under consideration, having regard to<\/p>\n<p> the object sought to be achieved by the <a href=\"\/doc\/671631\/\" id=\"a_80\">RTI Act<\/a> and in this<\/p>\n<p> view, the said provision has to be read to take within its sweep<\/p>\n<p> all funds provided by the appropriate Government, either from<\/p>\n<p> its own bag or funds which reach the societies through the<\/p>\n<p> appropriate Government or with its concurrence or clearance.<\/p>\n<p> Not only do I find no ground to exclude this interpretation, but<\/p>\n<p> see much support for it.      If the legislative intention were not<\/p>\n<p> so, it was unnecessary to state in the <a href=\"\/doc\/671631\/\" id=\"a_81\">RTI Act<\/a> &#8220;. . . . . . .<\/p>\n<p> substantially financed . . . . . . . by funds provided by . . . . . .&#8221;.<\/p>\n<p> It would have been sufficient to state &#8220;. . . . . substantially<\/p>\n<p> financed by. . . . . . .&#8221;. The use of the words &#8220;by funds provided<\/p>\n<p>WPC.18175\/06 &amp; con. Cases<\/p>\n<p>                             Page numbers<\/p>\n<p> by&#8221; enlarges and dilates the scope of the words &#8220;substantially<\/p>\n<p> financed&#8221; in that provision. It has to be remembered that it<\/p>\n<p> would never be assumed that the legislature uses language<\/p>\n<p> superfluously. The courts will not treat any legislative usage<\/p>\n<p> as surplusage, but will look at the very use of the language by<\/p>\n<p> the legislature, as intentional of conveying the true and<\/p>\n<p> complete meaning of what the legislature intended to say. As<\/p>\n<p> stated by the Apex Court in <a href=\"\/doc\/1998529\/\" id=\"a_82\">Babaji Kondaji Garad v. Basik<\/p>\n<p> Merchants Coop. Bank Ltd<\/a>. [(1984) 2 SCC 50], the<\/p>\n<p> Legislature uses appropriate language to manifest its<\/p>\n<p> intentions.        Arming of citizenry with information is not a<\/p>\n<p> matter that should be trimmed, crippled, clipped or excluded.<\/p>\n<p> It ought to be permitted to be available wherever it could,<\/p>\n<p> except where it is impermissible. This is why even in the Act,<\/p>\n<p> which transformed the concept of freedom of information to<\/p>\n<p> be that of a right to information, clear and specific exceptions<\/p>\n<p> and exclusions are legislatively provided and they are the only<\/p>\n<p> prohibited zones insulated from access under the <a href=\"\/doc\/671631\/\" id=\"a_83\">RTI Act<\/a>.<\/p>\n<p> This object of the <a href=\"\/doc\/671631\/\" id=\"a_84\">RTI Act<\/a> has to be achieved and the<\/p>\n<p>WPC.18175\/06 &amp; con. Cases<\/p>\n<p>                             Page numbers<\/p>\n<p> interpretation adopted above is purposive, to give effect to the<\/p>\n<p> legislative intention of that statute.\n<\/p>\n<p id=\"p_43\">\n<p id=\"p_44\">22.Now, the question for immediate consideration is as to<\/p>\n<p> whether the inclusive component of the clause in <a href=\"\/doc\/277989\/\" id=\"a_85\">Section 2<\/a><\/p>\n<p> which defines public authority is vague and incapable of<\/p>\n<p> application and if so, whether this Court has to read it with<\/p>\n<p> appropriate punctuations to give effect to the intention of the<\/p>\n<p> legislature.\n<\/p>\n<p id=\"p_45\">\n<p id=\"p_46\">23.As regards grammar and punctuations, I deem it fit to quote<\/p>\n<p> Y.V.Chandrachud, C.J. &#8211; State of West Bengal v. Swapan<\/p>\n<p> Kumar Guha [(1982) 1 SCC 561].              A question arose<\/p>\n<p> regarding the statutory meaning of the expression Money<\/p>\n<p> Circulation Scheme defined in <a href=\"\/doc\/319931\/\" id=\"a_86\">Section 2(c)<\/a> of the statute that<\/p>\n<p> fell for consideration in that precedent.  Paragraph 5 of that<\/p>\n<p> judgment reads as follows:\n<\/p>\n<p id=\"p_47\">WPC.18175\/06 &amp; con. Cases<\/p>\n<p>                             Page numbers<\/p>\n<p>       &#8220;Grammar and punctuation are hapless victims of<br \/>\n       the pace of life and I prefer in this case not to go<br \/>\n       merely by the commas used in clause (c) because,<br \/>\n       though they seem to me to have been placed both<br \/>\n       as a matter of convenience and of meaningfulness,<br \/>\n       yet, a more thoughtful use of commas and other<br \/>\n       gadgets of punctuation would have helped make the<br \/>\n       meaning of the clause clear beyond controversy.<br \/>\n       Besides, how far a clause which follows upon a<br \/>\n       comma governs every clause that precedes the<br \/>\n       comma is a matter not free from doubt. I therefore<br \/>\n       consider it more safe and satisfactory to discover<br \/>\n       the true meaning of clause (c) by having regard to<br \/>\n       the substance of the matter as it emerges from the<br \/>\n       object and purpose of the Act, the context in which<br \/>\n       the expression is used and the consequences<br \/>\n       necessarily following upon the acceptance of any<br \/>\n       particular interpretation of the provision, the<br \/>\n       contravention      of which   is  visited  by   penal<br \/>\n       consequences.&#8221;\n<\/p>\n<p id=\"p_48\">\n<p id=\"p_49\">24.The primary intention of semicolon is to indicate a<\/p>\n<p> discontinuity of grammatical construction greater than that<\/p>\n<p> indicated by a comma but less than that indicated by a full<\/p>\n<p> stop.\n<\/p>\n<blockquote id=\"blockquote_7\"><p>        &#8220;The semicolon separates two or more clauses<\/p>\n<p>        which are of more or less equal importance and are<\/p>\n<p>        linked as a pair or series: Economy is no disgrace;<\/p><\/blockquote>\n<p id=\"p_50\">\n<p id=\"p_51\">        for it is better to live on a little than to outlive a<\/p>\n<p>WPC.18175\/06 &amp; con. Cases<\/p>\n<p>                              Page numbers<\/p>\n<p>        great deal.       The temperate man&#8217;s pleasures are<\/p>\n<p>        always durable, because they are regular, and all<\/p>\n<p>        his life is calm and serene, because it is innocent.<\/p>\n<p>        To err is human; to forgive, divine. Never speak<\/p>\n<p>        little of what you know; and whether you speak or<\/p>\n<p>        say not a word, do it with judgement&#8221;.\n<\/p>\n<p id=\"p_52\">\n<p> See Hart&#8217;s Rules as slightly abridged and provided in<\/p>\n<p> Fowler&#8217;s Modern English Usage, revised third edition by<\/p>\n<p> R.W.Burchfield.\n<\/p>\n<p id=\"p_53\">\n<p id=\"p_54\">25.Semi colon provided at the end of the word &#8220;financed&#8221; in<\/p>\n<p> clause (i) in the inclusive limb of <a href=\"\/doc\/277989\/\" id=\"a_87\">Section 2<\/a> (h) of the <a href=\"\/doc\/671631\/\" id=\"a_88\">RTI Act<\/a> is<\/p>\n<p> so placed only because of the coma used in that clause, after<\/p>\n<p> the word &#8220;owned&#8221;.          A semi colon is not used at the end of<\/p>\n<p> clause (ii) because no coma is used anywhere in that limb. The<\/p>\n<p> meaning sought to be conveyed by the legislative provision in<\/p>\n<p> hand is quite clear.        The term &#8220;fund&#8221; relates primarily to<\/p>\n<p> money. That, in turn, is relatable only to financing. In any<\/p>\n<p> concept of the matter, be it common parlance or technically<\/p>\n<p>WPC.18175\/06 &amp; con. Cases<\/p>\n<p>                             Page numbers<\/p>\n<p> administrative, the words &#8220;directly and indirectly by funds<\/p>\n<p> provided by the appropriate Government&#8221; relate only to the<\/p>\n<p> term &#8220;substantially financed&#8221; occurring in clauses (i) and (ii) of<\/p>\n<p> the expansive limb of the definition of public authority. As far<\/p>\n<p> as the words &#8220;body owned&#8221; and &#8220;controlled&#8221; occurring in the<\/p>\n<p> first limb are concerned, that usage is also beyond any shade<\/p>\n<p> of doubt.       That what is conceived and provided for by the<\/p>\n<p> legislation is that such owning or control is by the appropriate<\/p>\n<p> Government. If any person who is exceptionally well versed in<\/p>\n<p> the punctuation of English language needs, I may attempt to<\/p>\n<p> add a semi colon after the word &#8220;provided&#8221; in the last lap of<\/p>\n<p> the definition clause.     There is really no ambiguity in the<\/p>\n<p> matter and this judicial declaration as to the interpretation<\/p>\n<p> and construction of the definition of public authority as defined<\/p>\n<p> in clauses 2 (h) is only clarificatory of the position which is<\/p>\n<p> otherwise explicit, viz., that any body owned or controlled by<\/p>\n<p> the appropriate Government and any body substantially<\/p>\n<p> financed by funds provided by the appropriate government as<\/p>\n<p> also any non-government organisation substantially financed<\/p>\n<p>WPC.18175\/06 &amp; con. Cases<\/p>\n<p>                             Page numbers<\/p>\n<p> by funds provided by the appropriate Government would fall<\/p>\n<p> within the inclusive limb of the definition of public authority in<\/p>\n<p> <a href=\"\/doc\/1097458\/\" id=\"a_89\">Section 2(h)<\/a> of the RTI Act.\n<\/p>\n<p id=\"p_55\">\n<p id=\"p_56\">26. Societies are not government organisations.      <a href=\"\/doc\/277989\/\" id=\"a_90\">Section 2<\/a> (h)<\/p>\n<p id=\"p_57\"> (ii) of the <a href=\"\/doc\/671631\/\" id=\"a_91\">RTI Act<\/a> uses the term &#8220;Non-Government<\/p>\n<p> organisations&#8221;, one not defined in the Act. <a href=\"\/doc\/277989\/\" id=\"a_92\">Section 2<\/a> (h)(ii),<\/p>\n<p> therefore, refers to something that is not part of the<\/p>\n<p> Government; which is very true of a society, as pointed out<\/p>\n<p> even by the petitioners. If a society is substantially financed,<\/p>\n<p> directly or indirectly by funds provided by appropriate<\/p>\n<p> Government, it falls within the inclusive definition of &#8216;public<\/p>\n<p> authority&#8217;; within the expanse of that definition clause.<\/p>\n<p> Therefore, any co-operative society registered under the KCS<\/p>\n<p> Act is a non-government organisation and if it is substantially<\/p>\n<p> financed, directly or indirectly by funds provided by<\/p>\n<p> appropriate Government, it is a public authority for the<\/p>\n<p> purpose of <a href=\"\/doc\/277989\/\" id=\"a_93\">Section 2<\/a> (h) of the <a href=\"\/doc\/671631\/\" id=\"a_94\">RTI Act<\/a>.\n<\/p>\n<p id=\"p_58\">WPC.18175\/06 &amp; con. Cases<\/p>\n<p>                             Page numbers<\/p>\n<p id=\"p_59\">27. The word &#8220;substantial&#8221; has no fixed meaning. For the<\/p>\n<p> purpose of a legislation, it ought to be understood definitely by<\/p>\n<p> construing its context. Unless such definiteness is provided, it<\/p>\n<p> may be susceptible to criticism even on the basis of <a href=\"\/doc\/367586\/\" id=\"a_95\">Article 14<\/a><\/p>\n<p> of the Constitution. <a href=\"\/doc\/1179473\/\" id=\"a_96\">See Shree Meenakshi Mills Ltd. v.<\/p>\n<p> A.V.Viswanatha Sastri<\/a> (AIR 1955 SC 13 at page 18).           The<\/p>\n<p> word substantial means &#8211; of or having substance: being a<\/p>\n<p> substance: essential: in essentials: actually existing: real:<\/p>\n<p> corporeal, material: solid and ample: massy and stable: solidly<\/p>\n<p> based: durable: enduring: firm, stout, strong: considerable in<\/p>\n<p> amount: well-to-do: of sound worth. See the Chambers 20th<\/p>\n<p> Century Dictionary. In fact, the concept &#8220;substantial&#8221; has<\/p>\n<p> been understood in different shades and applied contextually.<\/p>\n<p> In relation to Section 100 of the Code of Civil Procedure, it<\/p>\n<p> was held that a substantial question of law means a question of<\/p>\n<p> law having substance, essential, real, important. It was<\/p>\n<p> understood as something in contradistinction to &#8211; technical, of<\/p>\n<p> no substance or consequence, or merely academic. <a href=\"\/doc\/1396621\/\" id=\"a_97\">See<\/p>\n<p> Santhosh Hazari v. Purushottam Tiwari<\/a> [(2001) 3 SCC<\/p>\n<p>WPC.18175\/06 &amp; con. Cases<\/p>\n<p>                              Page numbers<\/p>\n<p> 179]. &#8220;Substantial interest&#8221; in the context of the <a href=\"\/doc\/789969\/\" id=\"a_98\">Income Tax<\/p>\n<p> Act<\/a> was found to require a contextual construction, having<\/p>\n<p> regard to the succeeding expressions which enumerated what<\/p>\n<p> substantial interest really meant. <a href=\"\/doc\/208673\/\" id=\"a_99\">See R.Dalmia v. C.I.T<\/a>.<\/p>\n<p> [(1977) 2 SCC 467]. &#8220;Substantial portion of such goods&#8221;, an<\/p>\n<p> expression occurring in the <a href=\"\/doc\/1059693\/\" id=\"a_100\">Customs Act<\/a>, was understood to<\/p>\n<p> mean substantial portion of the goods, that have been<\/p>\n<p> imported keeping in view the quantity as well as the value of<\/p>\n<p> the goods that have been imported. <a href=\"\/doc\/1435608\/\" id=\"a_101\">See India Steemship Co.<\/p>\n<p> Ltd. v. Union of India<\/a> [(1998) 4 SCC 293]. Such a spectrum<\/p>\n<p> of substantial wisdom essentially advises that the provision<\/p>\n<p> under consideration has to be looked into from the angle of the<\/p>\n<p> purpose of the legislation in hand and the objects sought to be<\/p>\n<p> achieved thereby, that is, with a purposive approach. What is<\/p>\n<p> intended is the protection of the larger public interests as also<\/p>\n<p> private interests. The fundamental purpose is to provide<\/p>\n<p> transparency,          to contain   corruption and  to   prompt<\/p>\n<p> accountability. Taken in that context, funds which the<\/p>\n<p> Government deal with, are public funds. They essentially<\/p>\n<p>WPC.18175\/06 &amp; con. Cases<\/p>\n<p>                             Page numbers<\/p>\n<p> belong to the Sovereign, &#8220;We, the People&#8221;. The collective<\/p>\n<p> national interest of the citizenry is always against pilferage of<\/p>\n<p> national wealth. This includes the need to ensure complete<\/p>\n<p> protection of public funds. In this view of the matter, wherever<\/p>\n<p> funds, including all types of public funding, are provided, the<\/p>\n<p> word &#8220;substantial&#8221; has to be understood in contradistinction to<\/p>\n<p> the word &#8220;trivial&#8221; and where the funding is not trivial to be<\/p>\n<p> ignored as pittance, the same would be &#8220;substantial&#8221; funding<\/p>\n<p> because it comes from the public funds. Hence, whatever<\/p>\n<p> benefit flows to the societies in the form of share capital<\/p>\n<p> contribution or subsidy, or any other aid including provisions<\/p>\n<p> for writing off bad debts, as also exemptions granted to it from<\/p>\n<p> different fiscal provisions for fee, duty, tax etc. amount to<\/p>\n<p> substantial finance by funds provided by the appropriate<\/p>\n<p> Government, for the purpose of <a href=\"\/doc\/1097458\/\" id=\"a_102\">Section 2(h)<\/a> of the RTI Act.<\/p>\n<p id=\"p_60\">28.Now, it needs to be further examined as to whether the<\/p>\n<p> provisions of the KCS Act and the KCS Rules are relevant to<\/p>\n<p> decide whether the definition clause in <a href=\"\/doc\/277989\/\" id=\"a_103\">Section 2<\/a> (h) of the<\/p>\n<p>WPC.18175\/06 &amp; con. Cases<\/p>\n<p>                                 Page numbers<\/p>\n<p> <a href=\"\/doc\/671631\/\" id=\"a_104\">RTI Act<\/a> apply to co-operative societies. <a href=\"\/doc\/671631\/\" id=\"a_105\">Sections 43<\/a> to <a href=\"\/doc\/671631\/\" id=\"a_106\">52<\/a> in<\/p>\n<p> Chapter VI of the KCS Act, which, by virtue of <a href=\"\/doc\/671631\/\" id=\"a_107\">Section 54<\/a> of<\/p>\n<p> that Act, over-rides other laws, provide direct partnership of<\/p>\n<p> Government in societies; indirect partnership of Government<\/p>\n<p> in societies; constitution of principal and subsidiary state<\/p>\n<p> partnership         funds;    provision    for  agreement   between<\/p>\n<p> Government           and   Apex    Societies   to   regulate indirect<\/p>\n<p> partnership of Government in                societies, etc. They, in<\/p>\n<p> particular, the provisions in <a href=\"\/doc\/671631\/\" id=\"a_108\">Section 53<\/a> regarding loans and<\/p>\n<p> advances by governmental societies; guarantees of various<\/p>\n<p> nature etc. would necessarily show the inflow of the funds of<\/p>\n<p> the appropriate Government, which go into the financing of<\/p>\n<p> the societies.          Notifications are issued under <a href=\"\/doc\/671631\/\" id=\"a_109\">Section 40<\/a><\/p>\n<p> granting exemptions to the societies from payment of stamp<\/p>\n<p> duty chargeable under the Kerala Stamp Act and also from<\/p>\n<p> certain taxes. The societies are granted exemption from the<\/p>\n<p> provisions of the Employees Provident Fund &amp; <a href=\"\/doc\/269107\/\" id=\"a_110\">Miscellaneous<\/p>\n<p> Provisions Act<\/a>, 1952. More importantly, as already noticed, it<\/p>\n<p> needs to be borne in mind that what is required is<\/p>\n<p>WPC.18175\/06 &amp; con. Cases<\/p>\n<p>                             Page numbers<\/p>\n<p> &#8220;substantially financed directly or indirectly by funds provided<\/p>\n<p> by appropriate Government&#8221;. That does not require the funds<\/p>\n<p> of the Government, meaning thereby,        money over which the<\/p>\n<p> State Government may have title in the legal sense.           It is<\/p>\n<p> sufficient that the Government is a machinery, the intervention<\/p>\n<p> of which, is also necessary, for such funds being provided to,<\/p>\n<p> and thereby reaching a society for its activities. The<\/p>\n<p> Government have the statutory obligation under <a href=\"\/doc\/671631\/\" id=\"a_111\">Section 80<\/a> (1)<\/p>\n<p> of the KCS Act to classify societies in the State according to<\/p>\n<p> their type and financial position. This has been done as per<\/p>\n<p> the provisions of the KCS Rules.          Rule 15 provides for<\/p>\n<p> classification according to types and for the purpose of <a href=\"\/doc\/671631\/\" id=\"a_112\">Section<\/p>\n<p> 80<\/a> (1), societies are classified in terms of the provision of Rule<\/p>\n<p> 182 of the KCS Rules as shown in Appendix III to those Rules.<\/p>\n<p> The pay scales of the staff, except those which are prescribed<\/p>\n<p> in that Appendix, will be fixed by the Government from time to<\/p>\n<p> time.     Section 31 of the KCS Act provides that where the<\/p>\n<p> Government have subscribed to the share capital of an apex or<\/p>\n<p> a central society or have assisted indirectly in the formation or<\/p>\n<p>WPC.18175\/06 &amp; con. Cases<\/p>\n<p>                             Page numbers<\/p>\n<p> augmentation of the share capital of an apex or a central<\/p>\n<p> society or have guaranteed the repayment of principal and<\/p>\n<p> payment of interest on debentures issued by an apex or a<\/p>\n<p> central society or have guaranteed the repayment of principal<\/p>\n<p> and payment of interest on loans and advances to an apex or a<\/p>\n<p> central society, the Government shall have the right to<\/p>\n<p> nominate not more than 3 persons or 1\/3rd of the total number<\/p>\n<p> of members of the committee of such society, whichever is<\/p>\n<p> less, to be members of that society. A reading of that provision<\/p>\n<p> would essentially show that provisions are made by the<\/p>\n<p> Government for the said societies&#8217; finances. In so far as the<\/p>\n<p> different societies falling into different types under Rule 15 are<\/p>\n<p> concerned, the participation of government by providing<\/p>\n<p> financial assistance is easily discernible because, in all cases<\/p>\n<p> where there is funding of any nature, which require the<\/p>\n<p> concurrence or approval of the Government or Government<\/p>\n<p> department or if the funding by other agencies are extended<\/p>\n<p> with the involvement of the Government or Government<\/p>\n<p> departments in identifying the societies which are entitled to<\/p>\n<p>WPC.18175\/06 &amp; con. Cases<\/p>\n<p>                                Page numbers<\/p>\n<p> such financial assistance, it has to be treated that those<\/p>\n<p> societies are non-governmental organisations substantially<\/p>\n<p> financed, directly or indirectly by funds provided by the<\/p>\n<p> appropriate Government. This view will only give effect to,<\/p>\n<p> and further the intention of the legislature and the objects<\/p>\n<p> sought to be achieved by having the <a href=\"\/doc\/671631\/\" id=\"a_113\">RTI Act<\/a> in place.<\/p>\n<p id=\"p_61\">29. The uncontroverted contention in the counter affidavit is that<\/p>\n<p> the Government of Kerala have notified a scheme called<\/p>\n<p> Deposit Guarantee Scheme and constituted a corpus fund in<\/p>\n<p> terms of Section 57B of the KCS Act and that the Government<\/p>\n<p> have contributed amounts to this fund through budget<\/p>\n<p> provision.         It is also the averment that NABARD provides<\/p>\n<p> refinancing facilities to Co-operative Agricultural Credit<\/p>\n<p> structure in Kerala at concessional rate. During the financial<\/p>\n<p> year 2006-07 NABARD sanctioned 342.65 crores and Banks<\/p>\n<p> have withdrawn an amount of Rs.264.19 crores. During the<\/p>\n<p> financial year 2007-08 NABARD sanctioned 500 crores and the<\/p>\n<p> banks have withdrawn an amount of 405.60 crores. Even in<\/p>\n<p>WPC.18175\/06 &amp; con. Cases<\/p>\n<p>                                Page numbers<\/p>\n<p> relation to Primary Agricultural Credit Societies which do not<\/p>\n<p> receive assistance from NRC(LTO) funds of NABARD, the<\/p>\n<p> Government have approved a scheme and framed rules and<\/p>\n<p> provisions are made for payment of share capital contribution<\/p>\n<p> to Primary Agricultural Credit Societies and Farmers Service<\/p>\n<p> Co-operative Banks. These are among the decisions taken and<\/p>\n<p> applied by the Government to extend financial aid to the co-<\/p>\n<p> operative societies. All financial assistance and subsidies to<\/p>\n<p> Co-operative          Societies  are   disbursed to   co-operative<\/p>\n<p> institutions through Government Orders.         As per Agricultural<\/p>\n<p> Debt Relief Act, 2001, interest on agricultural loans issued to<\/p>\n<p> farmers were written off. These amounts were disbursed to<\/p>\n<p> the co-operative banks through Government orders. Exts.R1<\/p>\n<p id=\"p_62\"> (a) to R1(c) disclose the total amounts written off by the<\/p>\n<p> Government for years 2004 to 2006, which figures reflect the<\/p>\n<p> enormous facility extended under the Agricultural Debt Relief<\/p>\n<p> Act, 2001.          The Agricultural Debt Waiver Scheme is also<\/p>\n<p> applicable to the loans taken from co-operative institutions.<\/p>\n<p> The Government gives agricultural production cost incentive<\/p>\n<p>WPC.18175\/06 &amp; con. Cases<\/p>\n<p>                               Page numbers<\/p>\n<p> to farmers through co-operatives. Five percentage of principal<\/p>\n<p> amount of loans up to Rs.25,000\/- will be given to farmers as<\/p>\n<p> agricultural production cost incentive. During financial year<\/p>\n<p> 2006-07 and 2007-08, 7 crores in each year were disbursed as<\/p>\n<p> agricultural        production   cost    incentive.  With   these<\/p>\n<p> uncontrovered facts, it is beyond doubt that the societies are<\/p>\n<p> substantially financed by funds provided by the Government.<\/p>\n<p id=\"p_63\">30. A survey of the different Government Orders, Policy<\/p>\n<p> Documents etc. would show that apart from the share capital<\/p>\n<p> contribution to the District Co-operative Banks, to the Primary<\/p>\n<p> Agricultural Credit Co-operatives, to the Kerala State Co-<\/p>\n<p> operative Bank and capital involvement in Urban Co-operative<\/p>\n<p> Banks etc., there is contribution by way of subsidies in<\/p>\n<p> different sectors. Different other types of funding like outright<\/p>\n<p> grant       and selected funding are also made available to<\/p>\n<p> different sectors. None of the writ petitioners has a case that<\/p>\n<p> it does not enjoy any of these facilities. The petitioners cannot<\/p>\n<p> sustain a case that they are not substantially financed by the<\/p>\n<p>WPC.18175\/06 &amp; con. Cases<\/p>\n<p>                                Page numbers<\/p>\n<p> Government. Predominantly, the presumption has necessarily<\/p>\n<p> to be in favour of holding that all the societies are substantially<\/p>\n<p> financed by funds provided by the State Government. Such<\/p>\n<p> finance may trickle by any mode without even any contribution<\/p>\n<p> by the Government, from out of its own funds, over which it<\/p>\n<p> has title. The Government is the machinery through which the<\/p>\n<p> finance reaches the societies, either by way of credits,<\/p>\n<p> subsidies, exemptions, other privileges including writing off of<\/p>\n<p> bad debts, which would otherwise have to be paid back into<\/p>\n<p> public funds.           Having regard to the object sought to be<\/p>\n<p> achieved by the <a href=\"\/doc\/671631\/\" id=\"a_114\">RTI Act<\/a>, it is impermissible to presume to the<\/p>\n<p> contrary, particularly when transparency is a matter to be<\/p>\n<p> ensured even in the co-operative sector.          It needs to be<\/p>\n<p> remembered that the promotion of societies by the State,<\/p>\n<p> including by its legislative support, is with a view to provide<\/p>\n<p> for the orderly development of the co-operative sector by<\/p>\n<p> organising the co-operative societies as self governing<\/p>\n<p> democratic institutions to achieve the objects of equality,<\/p>\n<p> social justice and economic development, as envisaged in the<\/p>\n<p>WPC.18175\/06 &amp; con. Cases<\/p>\n<p>                             Page numbers<\/p>\n<p> Directive Principles of State Policy of the Constitution of India.<\/p>\n<p> <a href=\"\/doc\/671631\/\" id=\"a_115\">The RTI Act<\/a> has become operational propounding the need of a<\/p>\n<p> democracy to have an informed citizenry.               Containing<\/p>\n<p> corruption is absolutely essential for a vibrant democracy.<\/p>\n<p> Transparency and accountability in societies have necessarily<\/p>\n<p> to be provided for.         The legislative provision in hand,<\/p>\n<p> therefore, requires a purposive construction in the above<\/p>\n<p> manner.\n<\/p>\n<p id=\"p_64\">\n<p id=\"p_65\">31.For the aforesaid reasons, it is held that co-operative societies<\/p>\n<p> registered under the KCS Act are public authorities for the<\/p>\n<p> purpose of the <a href=\"\/doc\/671631\/\" id=\"a_116\">RTI Act<\/a> and are bound to act in conformity with<\/p>\n<p> the obligations in Chapter II of that Act.\n<\/p>\n<p id=\"p_66\">\n<p> Other incidental issues.\n<\/p>\n<p id=\"p_67\">\n<p id=\"p_68\">32.The question for decision in every other individual case of a<\/p>\n<p> society, in the event of any dispute, would be as to whether it<\/p>\n<p> is substantially financed by the State Government, in the light<\/p>\n<p>WPC.18175\/06 &amp; con. Cases<\/p>\n<p>                             Page numbers<\/p>\n<p> of what is stated above. That may have to be determined with<\/p>\n<p> reference to the financing of each society.     That question<\/p>\n<p> would arise for decision only when any co-operative society<\/p>\n<p> refuses to act as a public authority. In such event, any citizen<\/p>\n<p> whose right to information is legislatively conferred as per<\/p>\n<p> <a href=\"\/doc\/1979161\/\" id=\"a_117\">Section 3<\/a> of RTI Act would be entitled to trigger the duty of<\/p>\n<p> the State Information Commission in terms of clauses (b), (e)<\/p>\n<p> and (f) of <a href=\"\/doc\/1083556\/\" id=\"a_118\">Section 18<\/a> (1) of the <a href=\"\/doc\/671631\/\" id=\"a_119\">RTI Act<\/a>. In that context, the<\/p>\n<p> State Information Commission has every jurisdiction to<\/p>\n<p> adjudicate and decide on the question as to whether a<\/p>\n<p> particular co-operative society, against which a complaint is<\/p>\n<p> made under <a href=\"\/doc\/1083556\/\" id=\"a_120\">Section 18<\/a> (1), is a public authority for the<\/p>\n<p> purpose of <a href=\"\/doc\/277989\/\" id=\"a_121\">Section 2<\/a> (h). The mere fact that the <a href=\"\/doc\/671631\/\" id=\"a_122\">RTI Act<\/a> does<\/p>\n<p> not expressly prescribe any limits as to finance, to determine<\/p>\n<p> the scope of the word &#8220;substantially&#8221; in <a href=\"\/doc\/277989\/\" id=\"a_123\">Section 2<\/a> (h) does not<\/p>\n<p> give rise to any presumption of possible abuse of power. This<\/p>\n<p> is because, the State Information Commission, as already<\/p>\n<p> found, is the authority which can determine that issue on case<\/p>\n<p> to case basis. That power is with that high office, the quality<\/p>\n<p>WPC.18175\/06 &amp; con. Cases<\/p>\n<p>                             Page numbers<\/p>\n<p> of which is statutorily regulated. Declaration of law as made<\/p>\n<p> in this judgment would stand to aid as precedent, by law.<\/p>\n<p> Advertence to <a href=\"\/doc\/127781\/\" id=\"a_124\">Sections 12<\/a>, <a href=\"\/doc\/762785\/\" id=\"a_125\">15<\/a>, <a href=\"\/doc\/770453\/\" id=\"a_126\">16<\/a> etc. would show that the<\/p>\n<p> legislature has reposed the powers in such a manner that<\/p>\n<p> there could be really no room for any presumptive argument<\/p>\n<p> as to possible arbitrariness and apprehension of incompetence.<\/p>\n<p> Even with reference to the KCS Act, lots of yardsticks would be<\/p>\n<p> available. There is no ground for any such apprehension being<\/p>\n<p> recognised with any element of legitimacy.<\/p>\n<p id=\"p_69\">33.In so far as the contention that information is sought for by<\/p>\n<p> different individuals for no rhyme or reason is concerned, the<\/p>\n<p> answer is short but clear, and is found in <a href=\"\/doc\/1910806\/\" id=\"a_127\">Section 6<\/a> (2), which<\/p>\n<p> provides that an applicant making request for information<\/p>\n<p> shall not be required to give any reason for requesting the<\/p>\n<p> information or any other personal details except those that<\/p>\n<p> may be necessary for contacting him.\n<\/p>\n<p id=\"p_70\">WPC.18175\/06 &amp; con. Cases<\/p>\n<p>                              Page numbers<\/p>\n<p id=\"p_71\">34. Having found that co-operative societies are public<\/p>\n<p> authorities for the purpose of the <a href=\"\/doc\/671631\/\" id=\"a_128\">RTI Act<\/a>, another issue<\/p>\n<p> surface for consideration.        In some of the cases in hand,<\/p>\n<p> applications for information were submitted to the statutory<\/p>\n<p> authorities under the KCS Act and KCS Rules requiring them<\/p>\n<p> to summon information from the societies.            Instead of<\/p>\n<p> summoning information by exercising the authority under the<\/p>\n<p> KCS Act and KCS Rules, those officers have forwarded those<\/p>\n<p> requests to the societies requiring the societies to answer to<\/p>\n<p> queries. The definition of information in the <a href=\"\/doc\/671631\/\" id=\"a_129\">RTI Act<\/a> includes<\/p>\n<p> information         as  are accessible   through such statutory<\/p>\n<p> authorities. All such information as are accessible through the<\/p>\n<p> mechanism of the KCS Act and KCS Rules thus becomes<\/p>\n<p> information for the purpose of the <a href=\"\/doc\/671631\/\" id=\"a_130\">RTI Act<\/a>. Therefore, the<\/p>\n<p> provisions under the <a href=\"\/doc\/671631\/\" id=\"a_131\">RTI Act<\/a> themselves would be sufficient<\/p>\n<p> for reaching at such information. Hence, the question whether<\/p>\n<p> the authorities under the KCS Act and KCS Rules should have<\/p>\n<p> summoned the documents without requiring the societies to<\/p>\n<p> communicate the information, is too technical and should<\/p>\n<p>WPC.18175\/06 &amp; con. Cases<\/p>\n<p>                             Page numbers<\/p>\n<p> necessarily give way to the primary object of the <a href=\"\/doc\/671631\/\" id=\"a_132\">RTI Act<\/a>, viz.,<\/p>\n<p> to provide access to information.        Therefore, there is no<\/p>\n<p> illegality in any officer vested with powers under the KCS Act<\/p>\n<p> and KCS Rules forwarding the request obtained by them to the<\/p>\n<p> concerned societies with a request or direction to that society<\/p>\n<p> to provide information directly to the person who has sought<\/p>\n<p> for the information.\n<\/p>\n<p id=\"p_72\">\n<p id=\"p_73\">       For the aforesaid reasons, these writ petitions fail. They<\/p>\n<p>    are accordingly dismissed.
