Mehta, P.P. for the State.\n<\/p>\n<p id=\"p_3\">Mr. Manish Pithalia for the respondents no.2 and 3.<\/p>\n<p id=\"p_4\">                               &#8230;..\n<\/p>\n<p id=\"p_5\">     This D.B.Criminal Revision has been preferred by the<\/p>\n<p>complainant Uda s\/o Gautam being aggrieved against the<\/p>\n<p>acquittal of respondents no.2 and 3 who have been acquitted by<\/p>\n<p>the learned Addl. Sessions Judge, Nimbahera camp Badi-Sadari<\/p>\n<p>in Sessions Case No.4\/2006 by the judgment dated 22.7.2006.<\/p>\n<p id=\"p_6\">     Brief facts of the case are that the complainant-petitioner<\/p>\n<p>submitted an oral report at Police station, Badi-Sadri on<\/p>\n<p>14.1.2005 at 5.40 p.m. that in the evening at 4 p.m. on the<\/p>\n<p>same day he was in his agricultural field and his father was<\/p>\n<p>sitting at Bavaji-ka-Deora (a religious place). There, the accused<\/p>\n<p>Bheru Lal came and asked the complainant&#8217;s father Gautam why<\/p>\n<p>he has taken the dung of she-buffalo and started beating victim<\/p>\n<p>Gautam. Accused Bheru Lal&#8217;s son Uda also gave beating to victim<\/p>\n<p>Gautam. This incident was seen by some children who informed<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                                                         2<\/span><\/p>\n<p>                                          D.B.Cr.Revision Pet. No.1119\/<a href=\"\/doc\/1810372\/\" id=\"a_1\">07<br \/>\n                                                              Uda v. State<\/a><br \/>\nthe complainant. The complainant himself rushed to the place of<\/p>\n<p>incident and asked Udai Lal and Bheru Lal about the incident,<\/p>\n<p>then they told that the victim Gautam gave beating to his she-<\/p>\n<p>buffalo. At that time no other person was there. A case was<\/p>\n<p>registered under Sections 341 and 323\/34, <a href=\"\/doc\/1569253\/\" id=\"a_1\">IPC<\/a>. Subsequently,<\/p>\n<p>the victim died at 8 p.m. and thereafter, case was registered<\/p>\n<p>under <a href=\"\/doc\/1560742\/\" id=\"a_2\">Section 302<\/a>, <a href=\"\/doc\/1569253\/\" id=\"a_3\">IPC<\/a>. The prosecution produced witnesses<\/p>\n<p>who are PW-4 Suresh, PW-5 Uda @ Udai Lal, PW-6 Nathu Lal.<\/p>\n<p>PW-5 Uda and PW-6 Nathu Lal are the sons of victim whereas<\/p>\n<p>PW-4 Suresh is a boy of 15 years and who was grand-son of the<\/p>\n<p>victim. The trial court after going through all the evidence on<\/p>\n<p>record, observed that the only injury which was on the left side<\/p>\n<p>of the head of the victim was from blunt object and as per the<\/p>\n<p>prosecution case, it was by single blow of one lathi. One lathi<\/p>\n<p>was recovered from the accused but without having blood stains.<\/p>\n<p>The trial court held that the presence of all the three witnesses<\/p>\n<p>PW-4 Suresh, PW-5 Uda and PW-7 Nathu Lal have not been<\/p>\n<p>proved by the cogent and reliable evidence by the prosecution<\/p>\n<p>and none of the above witnesses saw the beating of the victim<\/p>\n<p>by the accused. The victim though died because of the injury on<\/p>\n<p>the head but that injury was minor injury and there was even no<\/p>\n<p>fracture of skull. The trial court also held that presence of the<\/p>\n<p>accused has not been proved by any reliable evidence by the<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                                                          3<\/span><\/p>\n<p>                                           D.B.Cr.Revision Pet. No.1119\/<a href=\"\/doc\/1810372\/\" id=\"a_4\">07<br \/>\n                                                               Uda v. State<\/a><br \/>\nprosecution.\n<\/p>\n<p id=\"p_7\">\n<p id=\"p_8\">     The allegation of prosecution is that one of the accused<\/p>\n<p>Udai Lal gave beating by his fist and legs, whereas accused Udai<\/p>\n<p>Lal is totally handicapped by one leg and cannot walk without the<\/p>\n<p>help of crutches . If he would have tried to beat any body, he<\/p>\n<p>himself must have fallen.\n<\/p>\n<p id=\"p_9\">\n<p id=\"p_10\">     The learned counsel for the petitioner tried to submit that<\/p>\n<p>as per the medical report, the victim died because of the injury<\/p>\n<p>which he suffered on the head and there are three witnesses<\/p>\n<p>who supported the prosecution case. May they be closest<\/p>\n<p>relatives of the victim but their statements clearly proved the<\/p>\n<p>commission of offence by the accused.\n<\/p>\n<p id=\"p_11\">\n<p id=\"p_12\">     After going through all the evidence on record, we are of<\/p>\n<p>the view that there is no possibility of taking a different view<\/p>\n<p>than taken by the trial court. However, in revisional jurisdiction<\/p>\n<p>even otherwise view if can be taken by the revisional court from<\/p>\n<p>the view taken by the trial court even then the conviction cannot<\/p>\n<p>be altered and if there is possibility of two views then the view<\/p>\n<p>taken in favour of the accused prevails. We are also of the view<\/p>\n<p>that name of Suresh was not mentioned in the FIR nor the<br \/>\n<span class=\"hidden_text\" id=\"span_2\">                                                                                  4<\/span><\/p>\n<p>                                                   D.B.Cr.Revision Pet. No.1119\/<a href=\"\/doc\/1810372\/\" id=\"a_5\">07<br \/>\n                                                                       Uda v. State<\/a><br \/>\n      complainant in the FIR stated that he himself saw the beating of<\/p>\n<p>      the victim. That fact is relevant because of the fact that there is<\/p>\n<p>      only one injury on the head of the victim who was of the age of<\/p>\n<p>      75 years. The place of incident is also not believed by the trial<\/p>\n<p>      court.\n<\/p>\n<p id=\"p_13\">\n<p id=\"p_14\">               In view of the above reason, we do not find any merit in<\/p>\n<p>      this revision petition.
