In this regard Appellant sought following information:\n   1.     Whether invigilator submits his report and Answer sheet in the office. Photocopy of\n          report submitted by the invigilator of the examination room in which Appellant's\n          daughter (Roll no. 27030283525) appeared on 08\/04\/2009.\n   2.     Appellant wanted to know to where Answer Sheet of English paper in which his\n          daughter appeared on 08\/04\/2009 at Sarvoday Vidalaya, Ghongha Mor, Sannoth, had\n          been sent.\n   3.     Photocopy of Attendance sheet of examination said above. Inform total no. of\n          students present and no. of students who were not present in examination said above.\n   4.     Name and Address of First Appellate Authority.\n\nPIO's Reply:\nPoint no. 1 -3: Appellant was informed by the PIO, NIOS that his RTI Application had been sent\nto Regional Director, Regional Office, National Institute of Open Learning, A-31, Institutional\nArea, Sector-62, Noida, and Appellant was informed by the PIO after receiving information.\nPoint no. 4: Address of FAA was informed to the Appellant.\n\nGrounds for First Appeal:\nInformation not provided.\n Order of the First Appellate Authority:\nNot enclosed.\nAppellant was called by the FAA on 17\/09\/2009. Appellant mentioned that requested information\nwas not provided.\n\nGrounds for Second Appeal:\nInformation not provided\n\nRelevant Facts<\/pre>\n<p id=\"p_1\"> emerging during Hearing:\n<\/p>\n<p id=\"p_1\">The following were present<br \/>\nAppellant: Mr. Raj Kumar;\n<\/p>\n<p id=\"p_2\">Respondent: Absent;\n<\/p>\n<p id=\"p_3\">        The First Appellate Authority is guilty of dereliction of duty since he had not passed any<br \/>\norder in the matter.\n<\/p>\n<p id=\"p_4\">        The PIO Ms. Anitha Nair has sent a letter to the Commission claiming that the grievance<br \/>\nof the Appellant has been resolved. The appellant states that no information as sought by him has<br \/>\nbeen provided so far. The PIO&#8217;s letter also does not appear to give any evidence of the<br \/>\ninformation having been provided to the Appellant.\n<\/p>\n<p id=\"p_5\">Decision:\n<\/p>\n<p id=\"p_6\">The appeal is allowed.\n<\/p>\n<p id=\"p_7\">       The PIO is directed to provide the complete information to the appellant before<br \/>\n15 February 2010.\n<\/p>\n<p id=\"p_8\">The issue before the Commission is of not supplying the complete, required information by<br \/>\nthe PIO within 30 days as required by the law.\n<\/p>\n<p id=\"p_9\">From the facts before the Commission it is apparent that the PIO is guilty of not furnishing<br \/>\ninformation within the time specified under sub-section (1) of Section 7 by not replying within<br \/>\n30 days, as per the requirement of the <a href=\"\/doc\/671631\/\" id=\"a_1\">RTI Act<\/a>. It appears that the PIO&#8217;s actions attract the penal<br \/>\nprovisions of <a href=\"\/doc\/1369783\/\" id=\"a_1\">Section 20<\/a> (1). A show cause notice is being issued to her, and she is directed give<br \/>\nher reasons to the Commission to show cause why penalty should not be levied on her.\n<\/p>\n<p id=\"p_10\">She will give her written submissions showing cause why penalty should not be imposed on her<br \/>\nas mandated under <a href=\"\/doc\/1369783\/\" id=\"a_2\">Section 20<\/a> (1) before October, 2009. She will also submit proof of having<br \/>\ngiven the information to the appellant.\n<\/p>\n<p id=\"p_11\">She will present herself before the Commission at the above address on 08 March 2010 at<br \/>\n11.30am alongwith her written submissions showing cause why penalty should not be imposed<br \/>\non her as mandated under <a href=\"\/doc\/1369783\/\" id=\"a_3\">Section 20<\/a> (1). She will also submit proof of having given the<br \/>\ninformation to the appellant.
