No information provided by the PIO.\n   2. Information obtained by respective Departments are contradictory.\n\nOrder of the First Appellate Authority (FAA):\nNot on record.\n\nGround of the Second Appeal:\n   3. No information provided by the PIO.\n   4. Each Department is shrugging responsibility.\n   5. Threats from the affected party and his corrupt links.\n   6. Information obtained by respective Departments are contradictory.\n\nRelevant Facts<\/pre>\n<p id=\"p_1\"> emerging during Hearing on 23 May 2011:\n<\/p>\n<p id=\"p_1\">The following were present<br \/>\nAppellant: Mr. Harish Chander;\n<\/p>\n<p id=\"p_2\">Respondent: Mr. A. D. Biswas, PIO &amp; Sr. Town Planner;\n<\/p>\n<p id=\"p_3\">        &#8220;The Appellant had filed the RTI application with the Chief Minister&#8217;s Office who had transferred it to<br \/>\nAdditional Dy. Commissioner MCD(HQ), PIO Irrigation and Flood Control Department (HQ) and PIO DC(West)<br \/>\nRevenue Department. Additional Dy. Commissioner MCD(HQ) further transferred RTI application on 21\/12\/2010<br \/>\nto Assistant Commissioner (West Zone) and PIO Town Planning Department. From evidence produced by the<br \/>\nAppellant it appears that he has received information from PIO Irrigation and Flood Control Department and PIO<br \/>\nTown Planning Department in which it has been stated that the issue of encroachment and ownership of the public<br \/>\nland does not fall under their jurisdiction. It appears that PIO Assistant Commissioner (West Zone) and PIO<br \/>\nDC(West) Revenue Department, Rampur, Delhi have not sent any information to the Appellant.&#8221;\n<\/p>\n<p id=\"p_4\">Commission&#8217;s Decision dated 23 May 2011:\n<\/p>\n<p id=\"p_5\">The Appeal was allowed.\n<\/p>\n<p id=\"p_6\">       &#8220;The PIOs of Assistant Commissioner (West Zone) MCD and DC(West) Revenue Department,<br \/>\nRampur, Delhi are directed to provide the information available as per records to the Appellant before 15<br \/>\nJune 2011.\n<\/p>\n<p id=\"p_7\">The issue before the Commission is of not supplying the complete, required information by the PIO<br \/>\nAssistant Commissioner (West Zone) MCD and PIO DC(West) Revenue Department, Rampur, Delhi<br \/>\nwithin 30 days as required by the law.\n<\/p>\n<p id=\"p_8\">From the facts before the Commission it is apparent that the PIOs are guilty of not furnishing information within<br \/>\nthe time specified under sub-section (1) of Section 7 by not replying within 30 days, as per the requirement of the<br \/>\n<a href=\"\/doc\/671631\/\" id=\"a_1\">RTI Act<\/a>. It appears that the deemed PIOs actions attract the penal provisions of <a href=\"\/doc\/1369783\/\" id=\"a_1\">Section 20<\/a> (1). A showcause<br \/>\nnotice is being issued to them, and they are directed give their reasons to the Commission to show cause why<br \/>\npenalty should not be levied on them.\n<\/p>\n<p id=\"p_9\">PIO Assistant Commissioner (West Zone) MCD and PIO DC(West) Revenue Department, Rampur, Delhi will<br \/>\npresent themselves before the Commission at the above address on 16 June 2011 at 02.30PM alongwith their<br \/>\nwritten submissions showing cause why penalty should not be imposed on them as mandated under <a href=\"\/doc\/1369783\/\" id=\"a_2\">Section 20<\/a><br \/>\n(1). They will also bring the information sent to the appellant as per this decision and submit speed post<br \/>\nreceipt as proof of having sent the information to the appellant.&#8221;\n<\/p>\n<p id=\"p_10\">Relevant Facts emerging during the showcause Hearing on 16 June 2011:<br \/>\nThe following were present<br \/>\nAppellant: Mr. Harish Chander;\n<\/p>\n<p id=\"p_11\">Respondent: Mr. S. K. Mittal, Executive Engineer &amp; Deemed PIO;\n<\/p>\n<p id=\"p_12\">        &#8220;The respondent states that the information being sought is about an alleged encroachment in Narsing<br \/>\nGarden, A-Block, RZ 102-104, Khayala. This is an unauthorized colony and hence only the Revenue Department<br \/>\ncan provide the status of the land and the lay out plan if any to the MCD. The Commission had directed<br \/>\nPIO\/DC(West) Rampura to appear before the Commission today but he has not appeared. He has also not sent any<br \/>\nexplanation for not presenting himself before the Commission.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                                                                                      Page 2 of 3<\/span><\/p>\n<p id=\"p_13\"> Therefore the Commission is issuing a summons to PIO\/DC(West) Revenue Department Rampura to appear<br \/>\nbefore the Commission with the information and his explanation why penalty under <a href=\"\/doc\/291269\/\" id=\"a_3\">Section 20(1)<\/a> should not be<br \/>\nimposed on him on 06 July 2011 at 04.30PM.&#8221;\n<\/p>\n<p id=\"p_14\">Adjunct Decision dated 16 June 2011:\n<\/p>\n<p id=\"p_15\">        &#8220;Dy. Commissioner (West) is directed to present himself before the Commission with the information and<br \/>\nexplanation on 06 July 2011 at 04.30PM&#8221;\n<\/p>\n<p id=\"p_16\">Relevant Facts emerging during the showcause Hearing on 06 July 2011:<br \/>\nThe following were present<br \/>\nAppellant: Mr. Harish Chander;\n<\/p>\n<p id=\"p_17\">Respondent: Mr. Ajay Rawal, PIO &amp; SDM(Patel Nagar), O\/o the Dy. Commissioner (West);\n<\/p>\n<p id=\"p_18\">         There is no clarity about the land that the Appellant is seeking information about. The Appellant alleges<br \/>\nthat the Land is public land and is being encroached. He states that he had made multiple complaints about the<br \/>\nencroachment on public land but no government office is willing to take any action. From the careless and<br \/>\nnonchalant attitude being adopted by MCD, Revenue Department and Flood Control Department. Since it appears<br \/>\nthat this is public land the Commission directs SDM(Patel Nagar) to carry out the demarcation of the said land<br \/>\nbefore 30 July 2011. The Commission will hold SDM(Patel Nagar) responsible for getting the demarcation done<br \/>\nand informing the Appellant about the owner of the Land.
