    This is an appeal preferred against the<\/p>\n
judgment and decree passed by the Subordinate<\/p>\n
Judge, Palakkad in O.S.317\/93.           The suit is one<\/p>\n
for return of advance amount and damages.            It is<\/p>\n
the case of the plaintiff that the plaintiff and<\/p>\n
defendants have entered into an agreement for<\/p>\n
sale on 22.3.93 for purchase of 72= cents of dry<\/p>\n
land and one acre of paddy land for a total<\/p>\n
consideration of Rs.2,75,000\/- and towards the<\/p>\n
sale  consideration     Rs.40,000\/-         was   paid  as<\/p>\n
advance  and  as   per     the    stipulation      in  the<\/p>\n
agreement the document has to be registered on<\/p>\n
or before 3.5.93. There is also a stipulation in<\/p>\n
the agreement that if the plaintiff commits<\/p>\n

default, is liable to pay to the defendant the<\/p>\n
amount paid as advance plus another Rs.40,000\/-.<\/p>\n
According      to  the  plaintiff,  defendants have<\/p>\n
committed the breach, hence the suit.<\/p>\n
      2.   On   the  other   hand defendants   would<\/p>\n
contend it was the plaintiff who had committed<\/p>\n
breach of the contract and therefore he is not<\/p>\n
entitled      to   any  amount   and  as   per  the<\/p>\n
stipulations in the document the defendant is<\/p>\n
entitled to appropriate the amount given as<\/p>\n
advance.      The trial court on an appreciation of<\/p>\n
the materials granted a decree for return of the<\/p>\n
advance amount and it is against that decision<\/p>\n
the defendants have come up in appeal.<\/p>\n
      3.   Heard the learned senior counsel for the<\/p>\n
appellants as well as the young counsel for the<\/p>\n
respondent.      The crux of the matter depends upon<\/p>\n
the question who has committed the breach of the<\/p>\n

contract and whether the party had sustained<\/p>\n
damages so as to claim damages over and above<\/p>\n
the    advance    amount  paid  or  whether by   the<\/p>\n
conduct of the plaintiff the defendants had<\/p>\n
sustained      damages  so  as  to  disentitle   the<\/p>\n
plaintiff to ask for return of the amount.<\/p>\n
      4.   The parties certainly had not come to<\/p>\n
the     court   with  the  entire  facts  is   quite<\/p>\n
evident.       The plaintiff submits that on 2.5.93<\/p>\n
on coming to know that there was a liability in<\/p>\n
the property approaches the defendants and ask<\/p>\n
for the documents.       According to the plaintiff<\/p>\n
the defendants promise to come on 3.5.93 to the<\/p>\n
Registrar’s      office   with  the   document   and<\/p>\n
accordingly the plaintiff had gone there and to<\/p>\n
his dismay defendants did not come.        According<\/p>\n
to him he had issued a notice regarding this<\/p>\n
which is marked as Ext.A5.      Though the notice is<\/p>\n

dated 2.5.93 it is sent only on 7.5.93 and the<\/p>\n
defendants      had received it  only  on   9.5.93<\/p>\n
whereas     Ext.A6  is  a  notice issued  by   the<\/p>\n
defendants to the plaintiff dated 4.5.93.   It is<\/p>\n
therefore contended that Ext.A5 notice is only<\/p>\n
sent     after   the  receipt  of  Ext.A6   notice<\/p>\n
suppressing the fact and so it is an indicator<\/p>\n
to show that it was the plaintiff who had<\/p>\n
committed the breach.     Now as per the terms of<\/p>\n
the agreement the plaintiff is liable to pay<\/p>\n
balance amount and get the document registered<\/p>\n
on or before 3.5.93.    As per the stipulations in<\/p>\n
the agreement defendants are bound to measure<\/p>\n
the property to find out the exact extent and if<\/p>\n
it is on the increase more amount to be paid and<\/p>\n
if it is on a lesser side reduce the amount. It<\/p>\n
is also very clearly stated that the defendants<\/p>\n
have to discharge the liability on the property<\/p>\n

on    or   before   3.5.93.   So  it  is  in   this<\/p>\n
background we have to analyze who would have<\/p>\n
committed       the breach.    The  defendant   had<\/p>\n
admitted that there was a liability with the co-<\/p>\n
operative      bank by  mortgaging  this  property.<\/p>\n
Admittedly the defendant had not taken any steps<\/p>\n
to liquidate that loan before the crucial date<\/p>\n
3.5.93. As observed by the Court below if there<\/p>\n
had been measurement of property and it has been<\/p>\n
recorded it would have found a place in Ext.A6<\/p>\n
notice.     It is also absent there.  Therefore the<\/p>\n
two ingredients necessary to be satisfied by the<\/p>\n
defendants are not complied.        It is in this<\/p>\n
background when the evidence of plaintiff is<\/p>\n
analyzed that he approached the defendants for<\/p>\n
the purpose of getting document and that the<\/p>\n
defendants      fail to  come  to  the  Registrar’s<\/p>\n
office receives significance.     It is also to be<\/p>\n

borne in mind after all the agreement is one or<\/p>\n
sale of immovable property.      The time fixed for<\/p>\n
sale of immovable property need not always be<\/p>\n
the essence of the contract.          Therefore the<\/p>\n
inaction of this side or that side has resulted<\/p>\n
in the contract being broken. A person who<\/p>\n
wanted to purchase the property will purchase<\/p>\n
the property only on satisfaction regarding the<\/p>\n
correct extent of the property as well as the<\/p>\n
fact    that    there  is  no   encumbrance  on the<\/p>\n
property.         So the positive acts were to be<\/p>\n
done by the defendants.        Instead of doing the<\/p>\n
same what the defendants had done is that they<\/p>\n
have executed an agreement Ext.B1 with a third<\/p>\n
party for the purchase of another property and<\/p>\n
had     paid    Rs.15,000\/-  as  advance   and that<\/p>\n
transaction also did not materialize. When it is<\/p>\n
found that it is at the fault of the defendants<\/p>\n

that the contract has not gone into it has to be<\/p>\n
stated it is for them to return the advance<\/p>\n
amount.\n<\/p>\n
      5.   So far as the damages is concerned since<\/p>\n
there is no evidence to show that on account of<\/p>\n
the     non-happening   of    the  transaction the<\/p>\n
plaintiff has suffered any damages the Court<\/p>\n
below did not rightly grant him damages as well.<\/p>\n
So what the Court has done is to direct the<\/p>\n
defendants      to  pay back   the  amount  to the<\/p>\n
plaintiff for the reason it was the defendants<\/p>\n
who had committed the breach of the contract.<\/p>\n
In this case there is no unjust enrichment for<\/p>\n
the plaintiff for the reason the amount which he<\/p>\n
had advanced only is ordered to be paid back to<\/p>\n
him. Therefore from these materials I do not see<\/p>\n
any     ground   to  interfere  with  the  decision<\/p>\n
rendered      by  the trial   court. Therefore the<\/p>\n

appeal lacks merits and the same is dismissed<\/p>\n
but under the circumstances without any order as<\/p>\n
