The ACR in<br \/>\nquestion for the year 2006-07 read as under:\n<\/p>\n<p id=\"p_3\"> You<br \/>\nare not interested in teaching and taking regular classes.  Your<br \/>\nattitude has not been found in the interest of the Institute.<br \/>\nRequires to improve administrative capability.\n<\/p>\n<p id=\"p_4\">3.<br \/>\n\tAbove remarks are communicated to the petitioner, as Head of<br \/>\nDepartment of Panchkarma, Institute of Post Graduate Teaching and<br \/>\nResearch in Ayurveda at Gujarat Ayurveda University, Jamnagar, by<br \/>\nletter dated 10.10.2007 of office of the Director of the Institute.<br \/>\nThereafter, in reply to letter dated 21st October 2007 of<br \/>\nthe petitioner, the Director replied that the remarks conveyed for<br \/>\nthe ACR for the year 2006-07 were observational remarks and there was<br \/>\nno need to provide any reasons\/grounds for the same; and that the<br \/>\npetitioner has to submit his reply to the Honourable Vice Chancellor,<br \/>\nthe reviewing officer for ACR of Head of the Departments, through the<br \/>\nDirector.  Thereafter, the Director informed the petitioner by letter<br \/>\ndated 12.12.2007 that reply of the petitioner was considered by the<br \/>\nHonourable Vice Chancellor and explanation given by him was  not<br \/>\nfound relevant enough ; and hence, the entries made in the ACR for<br \/>\nthe year 2006-07 stood as they were.\n<\/p>\n<p id=\"p_5\">4.\tAforesaid<br \/>\nremarks in the ACR and the decision of the Vice Chancellor confirming<br \/>\nthe remarks are under challenge on the grounds that the remarks were<br \/>\nbaseless, motivated and vague.  It was submitted by learned counsel<br \/>\nMr.Anjaria that, according to the Rules of the Administrative<br \/>\nDepartment of respondent no.1 University, adverse entries in the ACRs<br \/>\nwere required to be communicated within 30 days and the reporting<br \/>\nofficer was required to maintain ephemeral roll.  Both these<br \/>\nrequirements were admittedly not fulfilled.  Then the rules also<br \/>\nrequire that, if, after several years of confidential reports being<br \/>\nnot adverse, adverse remarks were suddenly made in a given year, the<br \/>\nreporting officer has to substantiate such departure by special note<br \/>\nand supporting material.  That condition was also not fulfilled and<br \/>\nsuch violation of the Rules by the respondent could not be denied.<br \/>\nLearned counsel, Mr.Kakkad, appearing for the respondent relied upon<br \/>\nirrelevant material and statements made in the affidavit in reply of<br \/>\nthe Registrar of University, to submit that there were many<br \/>\ncomplaints against the petitioner and that the adverse remarks were<br \/>\njustified.\n<\/p>\n<p id=\"p_6\">5.\tIt<br \/>\nwas clear from the contentions of rival parties that in recording and<br \/>\nconfirming adverse remarks in the ACRs of the petitioner for the year<br \/>\n2006-07 express Rules of the respondent University were clearly<br \/>\nviolated, and hence, such adverse remarks could not be sustained.<br \/>\nAccordingly, adverse remarks in the annual confidential report of the<br \/>\npetitioner for the year 2006-07 are hereby quashed.\n<\/p>\n<p id=\"p_7\">6.\tAs<br \/>\nregards the second prayer in respect of appointment to the Post of<br \/>\nDean, it was clear that provisions of Regulation 2 for the<br \/>\nappointment of the Dean left the authorities with the discretion of<br \/>\nconsidering ACRs as well as performance of the officer.   Even<br \/>\notherwise, the prayer for such appointment was made by way of interim<br \/>\nrelief pending hearing and final disposal of the petition and that<br \/>\nprayer, in the nature of things, did not survive, as fairly conceded<br \/>\nby learned counsel, Mr.Anjaria.
