Justice M.SASIDHARAN NAMBIAR\n\n Dated :08\/04\/2010\n\n O R D E R\n          M.SASIDHARAN NAMBIAR,J.\n\n           ---------------------------------------------\n             CRL.M.C.NO.1129 OF 2010\n           ---------------------------------------------\n               Dated      8th      April 2010\n\n\n                          O R D E R\n<\/pre>\n<p id=\"p_1\">         Petitioner was the seventh accused<\/p>\n<p>in C.P.52\/2001 on the file of                            Judicial<\/p>\n<p>First Class Magistrate, Taliparamba. Case<\/p>\n<p>against the petitioner and fourth accused<\/p>\n<p>was split up and the case as against other<\/p>\n<p>accused  were      committed               to      the   Sessions<\/p>\n<p>court and taken on file as S.C.89\/2003. By<\/p>\n<p>Annexure A4 judgment, those accused were<\/p>\n<p>acquitted by the Sessions Judge. Case as<\/p>\n<p>against the petitioner is now pending as<\/p>\n<p>C.P.23\/2002    before           Judicial             First  Class<\/p>\n<p>Magistrate, Taliparamba. Petition is filed<\/p>\n<p>under  <a href=\"\/doc\/1679850\/\" id=\"a_1\">Section       482<\/a>        of       Code        of  Criminal<\/p>\n<p>Procedure to quash the proceedings pending<\/p>\n<p>before the    learned Magistrate against him<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">Crmc 1129\/10               2<\/span><\/p>\n<p>contending      that  consequent  to  the  order  of<\/p>\n<p>acquittal as against the co-accused         and the<\/p>\n<p>settlement arrived at       with second respondent,<\/p>\n<p>it    is    not  in  the  interest  of  justice  to<\/p>\n<p>continue the prosecution.\n<\/p>\n<p id=\"p_1\">            2. Second respondent appeared through<\/p>\n<p>a counsel and filed an affidavit stating that<\/p>\n<p>entire      disputes   with  the   petitioner  were<\/p>\n<p>settled and hence the case as against            the<\/p>\n<p>petitioner is to be quashed.\n<\/p>\n<p id=\"p_2\">            3.   Learned  counsel appearing for the<\/p>\n<p>petitioner,      second   respondent   and  learned<\/p>\n<p>Public Prosecutor were heard.\n<\/p>\n<p id=\"p_3\">            4.   Learned  counsel appearing for the<\/p>\n<p>petitioner submitted that Annexure A4      judgment<\/p>\n<p>itself      shows  that  when  the  co-accused  were<\/p>\n<p>tried,      there  was  a  settlement  between  the<\/p>\n<p>second respondent and the other witnesses and<\/p>\n<p>none of them supported the prosecution case and<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">Crmc 1129\/10              3<\/span><\/p>\n<p>the affidavit filed by the second respondent<\/p>\n<p>establishes that      even if petitioner is to be<\/p>\n<p>tried, there is no likelihood of a successful<\/p>\n<p>prosecution     as   second   respondent  has   no<\/p>\n<p>subsisting grievance against the petitioner. It<\/p>\n<p>is therefore, submitted that the case is to be<\/p>\n<p>quashed.\n<\/p>\n<p id=\"p_4\">            5. Offences   alleged   against    the<\/p>\n<p>petitioner are under <a href=\"\/doc\/872363\/\" id=\"a_1\">Sections 143<\/a>, <a href=\"\/doc\/1154131\/\" id=\"a_2\">147<\/a>, <a href=\"\/doc\/791362\/\" id=\"a_3\">148<\/a>,<\/p>\n<p><a href=\"\/doc\/661069\/\" id=\"a_4\">341<\/a>, <a href=\"\/doc\/697591\/\" id=\"a_5\">342<\/a>, <a href=\"\/doc\/1264755\/\" id=\"a_6\">326<\/a> and <a href=\"\/doc\/647828\/\" id=\"a_7\">307<\/a>     read with <a href=\"\/doc\/999134\/\" id=\"a_8\">Section 149<\/a> of<\/p>\n<p>Indian Penal Code, apart from <a href=\"\/doc\/42436223\/\" id=\"a_9\">Section 3(2)(v)<\/a><\/p>\n<p>of     Scheduled   Caste   and  <a href=\"\/doc\/25085007\/\" id=\"a_10\">Scheduled   Tribes<\/p>\n<p>(Prevention of Atrocities) Act<\/a>. As held by the<\/p>\n<p>Apex court in <a href=\"\/doc\/1157676\/\" id=\"a_11\">Manoj Sharma     v. State<\/a> (2008 (4)<\/p>\n<p>KLT 417 (SC)) consequent to the settlement of<\/p>\n<p>the disputes between the parties, all offences<\/p>\n<p>cannot be quashed.     <a href=\"\/doc\/455468\/\" id=\"a_12\">Section 307<\/a> of Indian Penal<\/p>\n<p>Code is one such offence. It is not an offence<\/p>\n<p>purely personal in nature as against the second<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">Crmc 1129\/10               4<\/span><\/p>\n<p>respondent. Hence the case cannot be quashed as<\/p>\n<p>sought for. If there is no evidence against the<\/p>\n<p>petitioner,      learned  Sessions  Judge  may  only<\/p>\n<p>acquit him. Hence the case cannot be quashed.<\/p>\n<p id=\"p_5\">            6. Learned counsel submitted that in<\/p>\n<p>that     event   direction  may  be  issued  to  the<\/p>\n<p>learned Magistrate to release the petitioner on<\/p>\n<p>bail. When an accused surrenders and files an<\/p>\n<p>application for bail,        Magistrate is expected<\/p>\n<p>to    pass    orders  in  the  application  without<\/p>\n<p>delay. I find no reason to believe that the<\/p>\n<p>Magistrate      is unaware of the provisions of law<\/p>\n<p>or the decisions of this court or the Apex<\/p>\n<p>court or that the Magistrate will not act in<\/p>\n<p>accordance with law.
