This Writ Appeal is filed under Section 4 of the Karr1’ataka
\nHigh Court Act<\/a>, praying to set aside the order passedg”in’-the<\/p>\n
Writ Petition No.43139\/2001 dated 4.11.2008 and et.c_:_.g’ .  ‘ A.  V<\/p>\n
This Appeal coming on for Final Disposal   <\/p>\n
B.S.Patil. J., delivered the following:\n<\/p>\n
JUDGMEN’:\u00a3?__<\/p>\n
1. Appellant–Bank is challenging the  ‘dated-if<\/p>\n
04.11.2006 passed by the .1earned.mSinglea pgJu.dg”e.’__ByEthe order
\nunder challenge, the writ   1-gspondent herein
\nis allowed. A direction is”  to accept the
\napplication   the writ petitioner
\nand to  benefits from the date of
\nsuch  > 1<\/p>\n
2. The   as a Senior Assistant under<\/p>\n
_v the appeliant–Ba’1’lk_V_.VV SA Scheme called State Bank of Mysore<\/p>\n
‘ff<etire_rnent Scheme was introduced on 27.01.2001<\/p>\n
 of voluntary retirement to the employees of<\/p>\n
 the Bank on the terms and conditions stipulated therein. One<\/p>\n
 the conditions of the Scheme contained in Clause 10[j) was<\/p>\n
  increspect of employees who were Office bearers \/ Directors<\/p>\n
 'of\/the State Bank of Mysore Employees Housing Co–operative<\/p>\n
 ty Limited\/State Bank of Mysore Co–operative Credit<\/p>\n

Society\/ State Bank of Mysore Consumer Co–operative Socieqr,
\nthe acceptance of their application for voluntary retirement
\nshall be subject to producing No Objection\/No Due Certi\ufb01cate<\/p>\n
from the respective organisation. According to the._”ap_’p.ell–ant–<\/p>\n
Bank, as the respondent was a Director of fer<\/p>\n
Mysore Employees Housing Co–operative_ Soc_i’ety”‘_and_als” \u00bb up <\/p>\n
he was not issued with No Due\/No :’Obje_’c’tion’tiCe’r1i\ufb01cai.\u00a75..ypyithe<\/p>\n
said Society as on the last datefixedllforll filingitheapplicationC’<\/p>\n
for voluntary retirement, he was___not:eligible.”to–  the bene\ufb01t.<\/p>\n

3. The appe1lant~bank  a communication<\/p>\n
dated    respondent stating that the No
\nObjection the Honorary Secretary could<\/p>\n
not be. accepted as..the’v.same was required to be signed by the<\/p>\n
  orzany” o”tl*1’er person authorised by the Board of<\/p>\n
 thelS*ociety. This communication was challenged in<\/p>\n
WlP,,.l\u00a7Io.9VO5\u00a7”\u00a7}{T2il)01. The said writ petition was dismissed. Writ<\/p>\n
 Cx_Appea1*~l\u00a7lo;..1776\/2001 filed against the said order, wherein the<\/p>\n
 of Clause 100) of the Scheme was also challenged came<\/p>\n
  tolgbe disposed of on 06.08.2001 directing the appellant bank to<\/p>\n
 pass appropriate orders on the application filed by the<\/p>\n
respondents within a stipulated time. It is necessary to refer to<\/p>\n

the said order passed by the Division Bench which is produced
\nat Annexure–E2. The Division bench while referring to the
\nrepresentation dated 10.06.2001 submitted by the respondent<\/p>\n
to the Bank stating that he had resigned from the post .iof.l_O–ffice<\/p>\n
bearer\/Director of the Society and hence there <\/p>\n
consideration of his application without  gNoV_ <\/p>\n
Due\/No Objection Certi\ufb01cate, has h_e1d_fin:Vparagraph?-l3,_,Qf”ithe<\/p>\n
said order that from the wordinggof the. Rule it:uwas\u00ab–..Clear <\/p>\n
only at the stage of acceptance”-of’ the application filed for
\nvoluntary retirement the’–\u00ab.1z\\i’o_l3lue,gf’Objection Certi\ufb01cate Was<\/p>\n
to be produced. lt,_has been:._fu.rtlier,ppointedlout that a rational<\/p>\n
interpretation  necessarily indicate that if in<\/p>\n
the rneanwhilet  had ceased to be an Office bearer,<\/p>\n
 then,,._%;thei’~ requirerrientpiof producing No Due\/No Objection<\/p>\n
 (A’.ert.ifi<:a_te:.wovu–ld_ not arise, nor would there be any bar to the<\/p>\n
  point of time of the application for Voluntary<\/p>\n
V _ retire;me1*1t.as"llit was at the stage of acceptance alone that the<\/p>\n
0  .rparticular "certificate was required to be produced. In the light<\/p>\n
 -_of._the\u00b0above observations, the Division Bench found that it was<\/p>\n
 unnecessary to consider the validity of the Rule which was<\/p>\n
” challenged before it and disposed of the appeal in terms stated<\/p>\n

4. This order passed by the Division Bench has attained
\n\ufb01nality. It is thereafter that the appe11ant–bank claims to have
\ngot certain clarification from the Society to the effect that the<\/p>\n
resignation submitted by the respondent on 19.03.2jO\u00a3l:”i”–.VVthe<\/p>\n
post of Director and to the post of Honorary <\/p>\n
accepted. Based on such clarifi_cation  ffroin the . pg <\/p>\n
Society, the appellant–bank passed the <\/p>\n
rejecting the request made by’~the respondent.’ fQ;….yol’untai*yf’<\/p>\n
retirement.  _ K _ V\n<\/p>\n
5. The said order dated  questioned by the<\/p>\n
responclventffbefore   Judge in the writ petition.
\nThe sarne has been A:.fja1loiwe’d\u00ab.directing the bank to accept the<\/p>\n
application filed_fby..the’respondent seeking voluntary retirement<\/p>\n
‘ V’ to’ gra.nt’vr–consec\u00ab;iien’tiaI terminal benefits. This order is now<\/p>\n
 cfialglellgiedgjinfth:is:..Appea1.\n<\/p>\n
69 A “-.lLearn”e;d counsel for the appellant contends that the order<\/p>\n
-V passed.  the learned Single Judge is unsustainable as the<\/p>\n
if dtproductioln of No Due Certi\ufb01cate by the respondent was a<\/p>\n
mandatory requirement and mere submission of resignation<\/p>\n
 “Without its acceptance by the Society of which he was a<\/p>\n
if Director could not have the effect of terminating his position as<\/p>\n

a Director in the Society. According to him, as the resignation
\nsubmitted had been rejected by the Board of Directors of the
\nSociety, the respondent was required to produce the_.l\\_lo Due<\/p>\n
Certificate. –_\n<\/p>\n
7. Learned Counsel for the respondent has SJ’E:1’\u00b0O1],:0;lv;’)7._._l:’t3:.fl1J[C(i<\/p>\n
the contentions urged placing reliance on the..\ufb01ndings:’1’ecord’cd <\/p>\n
and the reasons assigned by the leaicnedsiiagle   ll, <\/p>\n
8. Having carefully considered theV’con’tentio’n’sj_urgedjlbyihe:<\/p>\n
learned counsel for the parties on  of the materials
\non record, We find that._,_t’n.e a’ppelAlVan.tuhas not made out any<\/p>\n
valid and jiistifiable interfere with the order passed<\/p>\n
by the learned Singlea The order passed by the Division<\/p>\n
 Benc},\u00a7igon~O6.0\u00e9\u00a7.’2,fl):Cl_l  attained finality. As adverted to by<\/p>\n
 1.18:*ElDUVC.’A.\ufb01’l.f;;A”DiViSlOI1 Bench has found after interpreting the<\/p>\n
iR1.1le–._that:ltj:e requirement of producing the No Due Certi\ufb01cate<\/p>\n
V _ would arise only at the stage of acceptance of the application for<\/p>\n
yoliintary’ ‘retirement and as the respondent– employee had<\/p>\n
  ‘ceased to be an Office bearer as on the date the application was<\/p>\n
 -retlguired to be accepted, production of No Due Certi\ufb01cate did<\/p>\n
” not arise and therefore, there was no bar for acceptance of the<\/p>\n
Zpplication for Voluntary retirement. In the light of the clear<\/p>\n

observations and directions issued in the order passed by the
\nDivision Bench and in the absence of the bank placing any
\nmaterial before the Division Bench showing that the resignation<\/p>\n
submitted by the respondeni:–empioyee had been*’*i’ej_ec_t_ed,;:Vthe<\/p>\n
appe11ant–bank. cannot be permitted to  $_uch<\/p>\n
contention now. The Bank was not justified in into 3<\/p>\n
any correspondence with the Societyafter suffering an orderfbyp<\/p>\n
the Division Bench on O6.08.20C)’i<1:"i.\n<\/p>\n
9. Moreover. the learned Single’-Judge has rightly? referred to<\/p>\n
the effect of Section V  of 2{_'[}i\u00a2\u00e9”v\u00ab_Ka’ri3.ataka Co-operative<\/p>\n
Societies Act<\/a>.  .aeXtraeti11g the same and holding that a<\/p>\n
member may resign_ his “membership in writing under his hand<\/p>\n
 anddieivivered to Chief Executive, whereupon his seat shall<\/p>\n
 on the expiry of 15 days from the date of such<\/p>\n
f’deIi{r_\u00a2p;yv”‘einlessfvsrithdrawn eariier. As rightly heid by the<\/p>\n
V . learned Judge, there was nothing to show that the<\/p>\n
   {resignation submitted by the respondent–emp1oyee was rejected<\/p>\n
  f and’ the same was communicated to the writ petitioner.<\/p>\n
 ‘”8”.f In the Eight of the judgment rendered by the Division<\/p>\n
is Bgnch referred to herein above and the provisions contained<\/p>\n

under Section 29-B of the Karnataka Co–operative Societies Act,
\n1959, we find that the order passed by the learned Single Judge
\ndoes not call for interference. Hence, the writ appeal being<\/p>\n
devoid of merits is dismissed.\n<\/p>\n
