Justice J.M.JAMES\n\n Dated :16\/10\/2006\n\n O R D E R\n                           J.M.JAMES, J.\n\n                             --------------\n\n                          B.A. 5856\/2006\n\n                           ------------------\n\n  DATED THIS THE 16TH DAY OF OCTOBER, 2006\n\n\n\n\n                             O R D E R\n<\/pre>\n<p>             The   petitioner   is   accused   of   the   offence<\/p>\n<p>punishable   under   Sections   450,   377   and  511   of  376   IPC,<\/p>\n<p>in   crime   No.250\/2006   of   Paravur   Police   Station.     It   is<\/p>\n<p>alleged   that  the   petitioner  had   trespassed   into  the   house<\/p>\n<p>and   attempted  to   commit   rape   on   the   victim,   a   girl   aged<\/p>\n<p>about   17   years,   a   neighbour   and   relative   of   the<\/p>\n<p>complainant.   The  examination  of the  victim was done by<\/p>\n<p>the   local   doctor.     It   show   that   there   were   two   healed<\/p>\n<p>abrasions     below   the   right   breast,   one   on   the   upper<\/p>\n<p>abdomen, and one abrasion below the right clavicle.   The<\/p>\n<p>chemical   analysis   report   is   not   available.     The   petitioner<\/p>\n<p>remains   in   judicial   custody   from   15.9.2006.     Hence   this<\/p>\n<p>application under Section 439 Cr.P.C.\n<\/p>\n<p>      2.     After   hearing   both   the   counsel   as   well   as   the<\/p>\n<p>prosecution and considering the stage of the investigation,<\/p>\n<p>I grant bail and release the petitioner from jail, subject to<\/p>\n<p>B.A.5856\/2006<\/p>\n<p><span class=\"hidden_text\">                                     2<\/span><\/p>\n<p>the following conditions:-\n<\/p>\n<blockquote><p>         (a).    The petitioner shall execute a bond<\/p>\n<p>         for   Rs.25,000\/-,           with   two   solvent<\/p>\n<p>         sureties,   each   for   the   like   sum,     to   the<\/p>\n<p>         satisfaction  of the  Judicial  Magistrate  of<\/p>\n<p>         First Class, Paravur.\n<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>         (b).
