Learned counsel for the petitioner   <\/p>\n<p>SI.No.27, in the list enclosed to  <\/p>\n<p>the name of the petitioner,  ejf a n <\/p>\n<p>measuring 30&#8242; x 15&#8242; by the  of<br \/>\nRs.:300\/&#8211; per sq. foot<br \/>\nthe value to Rs.3e0\/-  es, boundaries<br \/>\nof the said  tI1Ae:t&#8217;*?.t11e&#8230;:V.\u00a7ist respondent<br \/>\nthough   did not do so<br \/>\ndespite V  In addition,<\/p>\n<p>that F\u00a7s.\u00bb9_,57t5\/  over to the 1st respondent,<\/p>\n<p>  did not execute the Sale Deed<\/p>\n<p> Government order dated 1 1-05-2006<\/p>\n<p>V dd _ Annexulvg-&#8220;B*&#8221;.\n<\/p>\n<p id=\"p_3\">&#8221;   Although learned counsel for the 1st<\/p>\n<p>&#8221;   submits that the petitioner did not respond<\/p>\n<p>  fto various letters addreesed to him in the matter of<\/p>\n<p>allotment of the site and execution of the Sale 13%,<\/p>\n<p>M<\/p>\n<p>nevertheless when asked to produce the  ~ V.<\/p>\n<p>that records are not made available. Leam   <\/p>\n<p>hastens to add that the petitioner   <\/p>\n<p>approach the 1st respo11dent_.t_o consitier   &#8216;V  L\u00bb<\/p>\n<p>the petitioner establishes &#8216;he is&#8217;   same<br \/>\nperson as the allottee,\u00bb  atf\u00a3t no:\ufb02\ufb01iesVvL&#8217;arould  action<br \/>\ni11accordanceWitVh1aw._V_V_ [&#8216;  &#8216; 2 X  <\/p>\n<p>5&#8243;  _   of &#8220;&#8216;staf:ement of objections<br \/>\nrefuting\ufb01le  eefitioner, there is no reason to<\/p>\n<p>disbe\ufb01eve me    in the petition. If the<\/p>\n<p> * ie.n.aHotiied&#8211;~the site, there can be no indolence<\/p>\n<p>   the 1st respondent in the matter of<\/p>\n<p> by execution of the Sale Deed<\/p>\n<p> receiving the sale consideration. If the 1st<\/p>\n<p>  respondent truly issued letters to the petitioner over the<\/p>\n<p>  iiallotalaent of the site, there was no reason as to why<\/p>\n<p> &#8216; ethose records are not made available to the Court.<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">5<\/span><\/p>\n<p id=\"p_4\">6. In the circumstances, there is no necessity\u00e9pdto<\/p>\n<p>direct the petitioner to approach the  .<\/p>\n<p>establish his identity to claim themsite a;ms:setmm.t &#8216; to V<\/p>\n<p>The petitioner has made out a case fo_r}sstie_ of <\/p>\n<p>mandamus directing the 1st&#8217;d.res_pontient.t_od&#8217; the<br \/>\nSale Deed of the sa\ufb01d site _inoVVV:Ai1is&#8221;&#8211;.favoi1r,&#8212;of_.eonrse,<\/p>\n<p>subject to the petitioner&#8221; of the value of<\/p>\n<p>the said it A &#8221; the other legal<\/p>\n<p>req:_11re&#8217; men1:s\u00a7&#8217; _ &#8216;<\/p>\n<p>7, % gwnjt p\u00e9ezign is ordered accordingly.
