L.B.DABHI, APP for\nRespondent(s) : 1, \n========================================= \n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE A.M.KAPADIA\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE BANKIM.N.MEHTA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 03\/02\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p id=\"p_1\">(Per<br \/>\n: HONOURABLE MR.JUSTICE A.M.KAPADIA)<\/p>\n<p>RULE.\n<\/p>\n<p id=\"p_1\">\tMr.\n<\/p>\n<p id=\"p_2\">\tL.B.Dabhi, learned APP appears and waives service of notice of Rule<br \/>\n\ton behalf of the Respondent &#8211; State of Gujarat.\n<\/p>\n<p id=\"p_3\">\tHaving<br \/>\n\tregard to the facts of the case, the Application is taken up for<br \/>\n\thearing today.\n<\/p>\n<p id=\"p_4\">By<br \/>\n\tfiling instant Application, the Applicant &#8211; accused has prayed for<br \/>\n\tsuspension of sentence and to release him on Regular Bail during the<br \/>\n\tpendency and final hearing of the above numbered Criminal Appeal.<br \/>\n\tAlternatively, it is also prayed to to list the above numbered<br \/>\n\tCriminal Appeal on final hearing<br \/>\n\tboard.\n<\/p>\n<p id=\"p_5\">\tAt the<br \/>\n\ttime of hearing of this Application, Ms. Sadhana Sagar, learned<br \/>\n\tAdvocate for the Applicant &#8211; accused does not press this<br \/>\n\tApplication so far as it relates to the prayer for suspension of<br \/>\n\tsentence and to release the Applicant &#8211; accused on regular<br \/>\n\tbail during the pendency and final hearing of the above numbered<br \/>\n\tCriminal Appeal in view of the fact that since the paper book is<br \/>\n\tready and received by the Registry.   She, therefore requested that<br \/>\n\tAppeal may be notified on final hearing board.\n<\/p>\n<p id=\"p_6\">\tMr.\n<\/p>\n<p id=\"p_7\">\tL.B.Dabhi, learned APP for the Respondent &#8211; State of Gujarat<br \/>\n\thas no objection if appropriate order is passed in this regard.\n<\/p>\n<p id=\"p_8\">\tSince the<br \/>\n\tprayer for suspension of sentence and to release the Applicant<br \/>\n\tconvict on regular bail during pendency and final hearing of the<br \/>\n\tabove numbered Criminal Appeal is not pressed for, no order is<br \/>\n\trequired to be passed.  However, Registry is directed to notify the<br \/>\n\tabove numbered Criminal Appeal on final hearing board in seriatim.\n<\/p>\n<p id=\"p_9\">\tApplication<br \/>\n\tstands disposed of accordingly.
