Justice J.B.KOSHY\n\n Dated :30\/07\/2007\n\n O R D E R\n                        J.B.KOSHY, J.\n                  -------------------------\n                   Crl.R.P.No.516 OF 2000\n                  -------------------------\n                    Dated 30th July, 2007\n\n                            ORDER\n<\/pre>\n<p id=\"p_1\">         On the allegation that the cheque issued by the<\/p>\n<p>petitioner for Rs.20,000\/= was dishonoured for insufficiency<\/p>\n<p>of funds, first respondent filed a complaint under <a href=\"\/doc\/1823824\/\" id=\"a_1\">Section<\/p>\n<p>138<\/a> of the Negotiable Instruments Act before the trial court.<\/p>\n<p>The defence of the accused was that he has not issued the<\/p>\n<p>cheque even though it was from his account maintaining for<\/p>\n<p>`Kavitha Printers&#8217;.   It is also submitted that his brother<\/p>\n<p>Phalgunan might have issued the cheque to the proprietor of<\/p>\n<p>Shalimar Paper Mart and that was misused by the complainant.<\/p>\n<p>Therefore, a definite defence was taken by the revision<\/p>\n<p>petitioner before the court.    But, the revision petitioner<\/p>\n<p>did not adduce any evidence. He did not even examine his<\/p>\n<p>brother or disputing the signature file petition to send the<\/p>\n<p>cheque for opinion of handwriting expert.      In the above<\/p>\n<p>circumstances, after considering the evidence of complainant,<\/p>\n<p>the court found that the cheque issued by the petitioner was<\/p>\n<p>dishonoured for insufficiency of funds.   It is also noticed<\/p>\n<p>by the trial court that reply notice was not produced.    In<\/p>\n<p>the appeal proceedings notice was produced, but, that was not<\/p>\n<p>accepted by the court.  I am of the opinion that even though<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">Crl.R.P.516\/2000               2<\/span><\/p>\n<p>reply was produced, since the contentions were not proved,<\/p>\n<p>there is no purpose in remanding the matter as he had<\/p>\n<p>ample opportunity to examine Phalgunan and also opportunity<\/p>\n<p>to prove that the signature in the cheque was         forged.<\/p>\n<p>But, no effort was made by him.      Whereas, complainant has<\/p>\n<p>asserted that the petitioner has executed the cheque in<\/p>\n<p>presence of his household.       In the above circumstances,<\/p>\n<p>concurrent conviction made by the courts below cannot be<\/p>\n<p>interfered.      With  regard  to  the sentence,  six  months<\/p>\n<p>imprisonment was imposed by the trial court.      In appeal,<\/p>\n<p>sentence was reduced to simple imprisonment for two months.<\/p>\n<p>First respondent is interested in getting back his money<\/p>\n<p>than sending the revision petitioner in prison.    Taking all<\/p>\n<p>these facts and circumstances, I reduce the sentence to<\/p>\n<p>simple imprisonment for three days and a compensation of<\/p>\n<p>Rs.25,000\/=.      If  the  compensation amount  is  realised,<\/p>\n<p>Rs.20,000\/= shall be given to the complainant.     In default<\/p>\n<p>of    payment   of compensation,  petitioner  has  to  suffer<\/p>\n<p>imprisonment for two months.     Since now <a href=\"\/doc\/1823824\/\" id=\"a_1\">Section 138<\/a> matter<\/p>\n<p>is compoundable, I give two months time to settle the<\/p>\n<p>matter.      If the matter is compounded and settled between<\/p>\n<p>the parties, they can approach this court for recording the<\/p>\n<p>settlement.      Otherwise, the modified sentence shall be<\/p>\n<p>executed by the trial court.
