JUSTICE MAHESH BHAGWATI<\/p>\n<p>Mr. Rajesh Kumar, for the petitioner.\n<\/p>\n<p id=\"p_1\">Mr. Amit Punia, Public Prosecutor for the State.\n<\/p>\n<p id=\"p_2\">Mr. Manish Gupta, for the complainant.\n<\/p>\n<p id=\"p_3\">\t\tThis order governs the disposal of  second bail application filed under <a href=\"\/doc\/1290514\/\" id=\"a_1\">Section 439<\/a> of Cr.P.C. by Shri Rajesh Kumar Advocate on behalf of the applicant Prabhudayal pertaining to F.I.R. No. 184\/2008 at police station Sadar, Jaipur City (South), in the offence under <a href=\"\/doc\/1436241\/\" id=\"a_1\">Section 420<\/a>, <a href=\"\/doc\/988620\/\" id=\"a_2\">406<\/a>, <a href=\"\/doc\/1985627\/\" id=\"a_3\">467<\/a>, <a href=\"\/doc\/556166\/\" id=\"a_4\">468<\/a> and <a href=\"\/doc\/1897847\/\" id=\"a_5\">120-B<\/a> of IPC.\n<\/p>\n<p id=\"p_4\">2.\t\tHeard the learned counsel for the petitioner, learned counsel for the complainant and learned Public Prosecutor appearing for the State and perused the material on record.\n<\/p>\n<p id=\"p_5\">3.\t\tLearned counsel for the petitioner has contended that the petitioner has been falsely implicated and is in no way connected the commission of the offence of the instant case. He is an innocent person. He has been in custody for quite a long time, hence, he may granted indulgence of bail.\n<\/p>\n<p id=\"p_6\">4.\t\tLearned Public Prosecutor appearing for the State as also learned counsel for the complainant have opposed the bail application.\n<\/p>\n<p id=\"p_7\">5.\t\tHaving considered the submissions made at the bar and scanned the relevant material on record, I without expressing any opinion on the merits of the case, do not feel inclined to grant bail to the petitioner and the same deserves to be dismissed.\n<\/p>\n<p id=\"p_8\">6.\t\tIn the result, the second bail petition filed under <a href=\"\/doc\/1290514\/\" id=\"a_6\">Section 439<\/a> of Cr.P.C. on behalf of the accused-petitioner Prabhudayal stands dismissed.\n<\/p>\n<p id=\"p_9\">(MAHESH BHAGWATI),J.\n<\/p>\n<p id=\"p_10\">Mak\/-\n<\/p>\n<p id=\"p_11\">s-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Rajasthan High Court Prabhu Dayal vs State on 23 October, 2009 IN THE HIGH COURT OF JUDICATURE FOR RAJASTHAN AT JAIPUR BENCH JAIPUR ORDER S.B.
