When was it<br \/>\n      made?\n<\/p>\n<p id=\"p_3\">   2) Whether the green line was removed from MCD or it has been stolen?\n<\/p>\n<p id=\"p_4\">   3) Whether the report regarding the same has been registered by MCD? Provide the photocopy of<br \/>\n      the same.\n<\/p>\n<p id=\"p_5\">   4) What step has been taken by MCD against the illegal activities for the same.\n<\/p>\n<p id=\"p_6\">   5) Which department of the Delhi municipal corporation is responsible for the same. Provide the<br \/>\n      information.\n<\/p>\n<p id=\"p_7\">   6) Provide the name, designation, mobile no. of the responsible person in the department for the<br \/>\n      removal, theft and disappear of the same.\n<\/p>\n<p id=\"p_8\">   7) Whether any complaint regarding the same has been made by any officer, worker or by native.<br \/>\n      Provide the photocopy for the same.\n<\/p>\n<p id=\"p_9\">PIO Reply:-\n<\/p>\n<p id=\"p_10\">The appellant was provide the point wise solution to his query:-\n<\/p>\n<p id=\"p_11\">   1) In view to point 1:- the information is not available for the same because it is not concerned<br \/>\n      with the department<br \/>\n   The reply was same for the all queries asked by the appellant.\n<\/p>\n<p id=\"p_12\">First Appeal:-\n<\/p>\n<p id=\"p_13\">Reply was unsatisfactory.\n<\/p>\n<p id=\"p_14\">Ground of the First Appeal:\n<\/p>\n<p id=\"p_15\">The appellant was provided with false and unsatisfactory reply.<br \/>\n Order of the FAA:\n<\/p>\n<p id=\"p_16\">Not Ordered<\/p>\n<p>Ground of the Second Appeal:\n<\/p>\n<p id=\"p_17\">Reply was unsatisfactory<\/p>\n<p>Relevant Facts emerging during Hearing:<br \/>\nThe following were present<br \/>\nAppellant: Mr. Rajender Gupta;\n<\/p>\n<p id=\"p_18\">Respondent: Absent;\n<\/p>\n<p id=\"p_19\">        The appellant shows that he received an order from the FAA on 29\/04\/2011 in which it is states<br \/>\nthat, &#8220;specific reply has not been provided to the appellant. The said matter of the RTI application<br \/>\npertains to EE(M-II), DDH, EE(Project-I) the same should be transferred to the concerned PIO. They<br \/>\nwill provide the information within a period of 15 days from the date of issue of this letter.&#8221; The<br \/>\nAppellant states that after the order of the FAA he received a reply from Dy. Director (Horticulture)<br \/>\nShahdara North that the matter does not pertain to his department on 05\/05\/2011.\n<\/p>\n<p id=\"p_20\">It appears that EE(M-III) and EE(Project-I) has not provided any information to the Appellant. The<br \/>\nAppellant had filed the first appeal on 03\/02\/2011 but the FAA Mr. D. P. Ture heard the matter only<br \/>\non 19\/04\/2011 and passed an order on 29\/04\/2011. It thus appears that the FAA did not discharge his<br \/>\nduty under the <a href=\"\/doc\/671631\/\" id=\"a_1\">RTI Act<\/a> within the time mandated in the <a href=\"\/doc\/671631\/\" id=\"a_1\">RTI Act<\/a>. The Commission directs FAA Mr.<br \/>\nTure to explain and showcause why the Commission should not recommend disciplinary action<br \/>\nagainst him for not doing his duty as per the provisions of <a href=\"\/doc\/671631\/\" id=\"a_2\">RTI Act<\/a>. The Commission also directs Mr.<br \/>\nTure to ensure that whoever has the information sends it to the Appellant before 05 June 2011.\n<\/p>\n<p id=\"p_21\">Decision:\n<\/p>\n<p id=\"p_22\">The Appeal is allowed.\n<\/p>\n<p id=\"p_23\">      The Commission directs Mr. D. P. Ture to ensure that the information is sent to<br \/>\nthe Appellant before 05 June 20110.\n<\/p>\n<p id=\"p_24\">The Commission also directs Mr. D. P. Ture to present himself before the Commission<br \/>\n13 June 2011 at 04.00PM with his written submission to showcause why disciplinary<br \/>\nactions should not be recommended against him for not doing his duty as per the<br \/>\nprovisions of <a href=\"\/doc\/671631\/\" id=\"a_3\">RTI Act<\/a>.\n<\/p>\n<p id=\"p_25\">Mr. D. P. Ture will also identify the officers responsible for the delay in providing the<br \/>\ninformation to the Appellant.
