(Oral)\n<\/pre>\n<p id=\"p_1\">            This writ petition has been filed with a prayer to quash orders<\/p>\n<p>dated 12.12.2007 (P1) and 9.1.2008 (P2), vide which, the Collector directed<\/p>\n<p>the petitioners to make payment towards deficient Stamp fee affixed by<\/p>\n<p>them on sale deed, vide which, they had purchased 12 bighas and 16 biswas<\/p>\n<p>of land. Further challenge is to order dismissing their appeal on 10.2.2009<\/p>\n<p>(P3).\n<\/p>\n<p id=\"p_1\">            Heard counsel for the petitioners.\n<\/p>\n<p id=\"p_2\">            It is not in dispute that the petitioners purchased property,<\/p>\n<p>mentioned above, for an amount of Rs.17 lacs 25 thousands showing it as<\/p>\n<p>agricultural land. The sale deed was impounded as per provisions of <a href=\"\/doc\/74910796\/\" id=\"a_1\">Section<\/p>\n<p>47-A<\/a> of the Indian Stamp Act, 1899. The matter was sent to the Collector,<\/p>\n<p>for enquiry, to decide, as to whether deficient Stamp fee has been affixed or<\/p>\n<p>not. Upon notice, the petitioners put in appearance. Except filing written<\/p>\n<p>statement, no further evidence was led by them.\n<\/p>\n<p id=\"p_3\">            Provisions of <a href=\"\/doc\/74910796\/\" id=\"a_1\">Section 47-A<\/a> of the Act reads thus:-<br \/>\n<span class=\"hidden_text\" id=\"span_1\"> Civil Writ Petition No.8248 of 2009                                     2<\/span><\/p>\n<p>            &#8220;47-A. Instruments under-valued how to be dealt with &#8211; (1) If<\/p>\n<p>            the Registering Officer appointed under the <a href=\"\/doc\/1489134\/\" id=\"a_2\">Registration Act<\/a>,<\/p>\n<p>            1908, while registering any instrument transferring any<\/p>\n<p>            property has reason to believe that the value of the property or<\/p>\n<p>            the consideration, as the case may be, has not been truly set<\/p>\n<p>            forth in the instrument, he may after registering such<\/p>\n<p>            instrument, refer the same to the Collector for determination of<\/p>\n<p>            the value or consideration as the case may be, and the<\/p>\n<p>            property duty payable thereon.\n<\/p>\n<p id=\"p_4\">            (2) On receipt of reference under sub-section (1), the Collector<\/p>\n<p>            shall, after giving the parties a reasonable opportunity of<\/p>\n<p>            being heard and after holding an enquiry in such manner as<\/p>\n<p>            may be prescribed by rules made under this Act, determine the<\/p>\n<p>            value or consideration and the duty as aforesaid and the<\/p>\n<p>            deficient amount of duty, if any, shall be payable by the reason<\/p>\n<p>            liable to pay the duty.&#8221;\n<\/p>\n<p id=\"p_5\">            It is contention of the petitioners that before determining price<\/p>\n<p>of the land purchased, no enquiry was conducted by the Collector. This<\/p>\n<p>Court feels that argument raised is liable to be rejected. <a href=\"\/doc\/74910796\/\" id=\"a_3\">Under the Act<\/a>,<\/p>\n<p>Rules known as Haryana Stamp (Prevention of Undervaluation of<\/p>\n<p>Instruments) Rules, 1978 were framed. Rule 4 reads as under:-<\/p>\n<blockquote id=\"blockquote_1\"><p>            &#8220;Rule 4. Assessment of Duty.- (1) On receipt of reference<\/p>\n<p>            under sub-section (1) of <a href=\"\/doc\/74910796\/\" id=\"a_4\">Section 47-A<\/a>, the Collector shall serve<\/p>\n<p>            on the person or persons concerned a notice in form I,<\/p>\n<p>            requiring him on a date and at a place to be specified therein<\/p>\n<p>            either to attend in person or through an authorized agent to<br \/>\n<span class=\"hidden_text\" id=\"span_1\"> Civil Writ Petition No.8248 of 2009                                        3<\/span><\/p>\n<p>            produce or to cause to be produced any evidence on which<\/p>\n<p>            such person or persons may reply in his support.<\/p>\n<p>            (2) The Collector, after taking such evidence as the person or<\/p>\n<p>            persons may produce and after making such enquiry as he may<\/p>\n<p>            deem proper, shall determine the value of property or<\/p>\n<p>            consideration as the case may be, and assess the amount of<\/p>\n<p>            deficient duty recoverable from the person concerned.<\/p>\n<p>            (3) If the person or persons fails or fail to attend in response to<\/p>\n<p>            the notice served under sub-rule (1), the Collector shall<\/p>\n<p>            proceed ex parte and assess the deficient amount of duty, if<\/p>\n<p>            any, to the best of his judgment.&#8221;<\/p><\/blockquote>\n<p id=\"p_6\">\n<p id=\"p_7\">            Reading of the above said provision indicates that a person<\/p>\n<p>concerned (purchaser), is entitled to get a notice from the Collector, stating<\/p>\n<p>date of appearance and asking him to produce any evidence on record to<\/p>\n<p>rebut averments made against him in that notice. Rule further mandates that<\/p>\n<p>the Collector after taking note of such evidence, as may be produced by the<\/p>\n<p>person concerned and after making enquiry, shall determine value of the<\/p>\n<p>property and assess amount of deficient stamp duty, if any.<\/p>\n<p id=\"p_8\">            It is not in dispute that vide notice, the petitioners were directed<\/p>\n<p>to put in appearance and produce evidence in their favour. After putting in<\/p>\n<p>appearance, the petitioners failed to appear on two dates and were ordered<\/p>\n<p>to be proceeded ex-parte. Even in this writ petition, nothing has been<\/p>\n<p>brought on record, in the shape of khasra girdawari\/ jamabandi to show that<\/p>\n<p>the land was ever used for agricultural purpose. It has been found, as a<\/p>\n<p>matter of fact and not even disputed by the petitioners that on one portion of<\/p>\n<p>the land, Rice Sheller is in existence. By referring to that fact, counsel<\/p>\n<p>states that rest of the land cannot be treated as commercial in nature. This<br \/>\n<span class=\"hidden_text\" id=\"span_2\"> Civil Writ Petition No.8248 of 2009                                       4<\/span><\/p>\n<p>Court feels that the argument raised is not justified. To run a Sheller, huge<\/p>\n<p>vacant area is needed to store paddy, without which, it is not possible to<\/p>\n<p>operate a Sheller.
