Justice S.SIRI JAGAN\n\n Dated :25\/01\/2011\n\n O R D E R\n                             S.SIRI JAGAN, J.\n\n                      ==================\n\n                        W.P.(C).No.2460 of 2011\n\n                      ==================\n\n              Dated this the 25th day of January, 2011\n\n                             J U D G M E N T\n<\/pre>\n<p id=\"p_1\">      The petitioner is an employee of the Kerala State Electricity<\/p>\n<p>Board. He was suspended on being accused of offences under the<\/p>\n<p><a href=\"\/doc\/1331755\/\" id=\"a_1\">Prevention of Corruption Act<\/a> on 13.11.2003. He was reinstated on<\/p>\n<p>16.4.2005. While so, by Ext.P3 order dated 19.3.2007, the scales of<\/p>\n<p>pay of the employees of the Board were revised with effect from<\/p>\n<p>1.8.2003. The petitioner submits that consequently, the petitioner is<\/p>\n<p>entitled to revised subsistence allowance for the period of suspension.<\/p>\n<p>The petitioner relies on Ext.P7 judgment of this Court in W.P.(C).<\/p>\n<p>No.34424\/2003 in support of the proposition that in cases of wage<\/p>\n<p>revision retrospectively with effect from a date prior to the suspension,<\/p>\n<p>the subsistence allowance also has to be recomputed in accordance<\/p>\n<p>with the revised wages.\n<\/p>\n<p id=\"p_1\">      2.    I have heard the learned counsel for the petitioner.<\/p>\n<p id=\"p_2\">      3.    I am not inclined to exercise my discretionary jurisdiction<\/p>\n<p>in favour of the petitioner in view of the unexplained delay and laches.<\/p>\n<p>Admittedly, the petitioner was suspended from service on 13.11.2003<\/p>\n<p>and he was reinstated on 16.4.2005. The wage revision came into<\/p>\n<p>force retrospectively by Ext.P3 order dated 19.3.2007. Almost four<\/p>\n<p>years are already over thereafter. Even Ext.P7 judgment is dated<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">w.p.c.2460\/11                        2<\/span><\/p>\n<p>27.5.2008 and the petitioner has not chosen to approach this Court<\/p>\n<p>within a reasonable time after that judgment also. The petitioner has<\/p>\n<p>approached this Court only on 24.1.2011.
