Mr.Patel further<br \/>\n\tsubmitted that as the name was not shown, he could not remain<br \/>\n\tpresent and, therefore, his client may suffer or it may show lack of<br \/>\n\this bonafide. He further submitted that the power to review is not<br \/>\n\tprovided, however, the Court may consider the interest of justice<br \/>\n\texercising the inherent powers under Section 482.\n<\/p>\n<p id=\"p_4\">Having<br \/>\n\theard learned counsel, Mr.Sunil C. Patel for the applicant and<br \/>\n\tlearned A.P.P., Mr.H.L. Jani for the respondent-State, it is well<br \/>\n\taccepted that in criminal jurisprudence as provided in<a href=\"\/doc\/445276\/\" id=\"a_1\"> the Criminal<br \/>\n\tProcedure Code<\/a>, there is no provision for review and provisions of<br \/>\n\t<a href=\"\/doc\/789330\/\" id=\"a_1\">Section 362<\/a> of Code of Criminal<br \/>\n\tProcedure, 1973 are more than clear.\n<\/p>\n<p id=\"p_5\">However,<br \/>\n\tas observed by the Hon&#8217;ble Apex Court in case of  <a href=\"\/doc\/484465\/\" id=\"a_2\">Smt. Sooraj<br \/>\n\tDevi v. Pyare Lal and another<\/a><br \/>\n\treported in AIR 1981 SC 736, the exercise<br \/>\n\tof inherent jurisdiction under <a href=\"\/doc\/1679850\/\" id=\"a_3\">Section 482<\/a> of Code of Criminal<br \/>\n\tProcedure, 1973 is barred when there is a clerical or arithmetical<br \/>\n\terror, which is an error occasioned by the accidental slip or<br \/>\n\tomission of the Court. Therefore, having regard to the facts and<br \/>\n\tcircumstances, in the interest of justice, the oral Judgment dated<br \/>\n\t04.03.2009 passed in Criminal Revision Application No.354 of 2001 is<br \/>\n\trecalled, and accordingly, Criminal Revision Application No.354 of<br \/>\n\t2001 is ordered to be restored to the file for fresh hearing before<br \/>\n\tthe Court taking up such matters.\n<\/p>\n<p id=\"p_6\">\tThe<br \/>\n\tregistry is directed to place the aforesaid Criminal Revision<br \/>\n\tApplication No.354 of 2001 before the Hon&#8217;ble the Chief Justice for<br \/>\n\tappropriate orders in this regard.\n<\/p>\n<p id=\"p_7\">\tAccordingly,<br \/>\n\tthe present Criminal Misc. Application No.8468 of 2009 stands<br \/>\n\tallowed.
