SAGHIR AHMAD\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p id=\"p_1\">\t\t\t O R D E R<br \/>\n     This appeal, by special leave, arises from the judgment<br \/>\nof the\tdivision Bench\tof the\tHigh court of Delhi, made on<br \/>\nMay 30, 1991 in R.F.A. NO.167\/86.\n<\/p>\n<p id=\"p_1\">     The admitted  facts are that notification under Section<br \/>\n4(1)  of  the  land  <a href=\"\/doc\/7832\/\" id=\"a_1\">Acquisition  Act<\/a>,\t1864  was  published<br \/>\nacquiring certain  lands for  public purpose.  Therein rival<br \/>\nclaims came  to be  made by  Gaon  Sabha,  Tekhand  and\t the<br \/>\nrespondents claiming  title to\tthe compensation.  Since the<br \/>\nLand Acquisition  officer\/collector was unable to decide the<br \/>\ntitle to receive the compensation on reference under <a href=\"\/doc\/2587\/\" id=\"a_1\">section<br \/>\n30<\/a> of  the Act, the District court by award and decree dated<br \/>\nFebruary 22,  1986 held\t that the  land\t in  question  stood<br \/>\nvested in  the Gaon  Sabha under <a href=\"\/doc\/1789527\/\" id=\"a_2\">Section 7<\/a> read with Section<br \/>\n154 of\tthe Delhi  Land Reforms\t Act (for short, the `Act&#8217;).<br \/>\nTherefore, it  is entitled  to the  compensation of the land<br \/>\nacquired by  the Union of India. Dissatisfied therewith, the<br \/>\nrespondents filed  the above  appeal. The  High Court in the<br \/>\nimpugned judgment  has held  that &#8220;Gair\t Mumkin Pahar&#8221;\tis a<br \/>\ncultivable land\t and, therefore, by operation of explanation<br \/>\nto <a href=\"\/doc\/1789527\/\" id=\"a_3\">Section  7<\/a>, it  stands excluded  from the  vesting in the<br \/>\nGaon Sabha. Resultantly, the respondents being the owners of<br \/>\nthe property  are entitled  to the  compensation. Thus, this<br \/>\nappeal by special leave.\n<\/p>\n<p id=\"p_2\">     Initially, Shri  M.C. Dhingra, learned counsel for some<br \/>\nof the respondents, as brought to our notice that since this<br \/>\nCourt had  dismissed similar  special leave  petitions, this<br \/>\nappeal does not merit consideration. We find no force in the<br \/>\ncontention. This  Court, by  then, had already granted leave<br \/>\nin this\t appeal, but  unfortunately, that was not brought to<br \/>\nthe notice  of the  respective\tBenches\t including  the\t one<br \/>\npresided over  by one  of us  (K. Ramaswamy,  J.), when\t the<br \/>\nmatters had  come up. As a consequence, without any speaking<br \/>\norder some  special leave petitions came to be dismissed. In<br \/>\nview of\t the settled legal position by a catena of decisions<br \/>\nof this\t Court that  the dismissal of special leave petition<br \/>\nwithout speaking order does not constitute res judicata, the<br \/>\nquestion of law is at large to be gone into. Accordingly, We<br \/>\nreject the  objection and  we have heard the counsel on both<br \/>\nsides on merits.\n<\/p>\n<p id=\"p_3\">     Shri Wasim A. Qadri, learned counsel for Union of India<br \/>\nand Gaon  Sabha, in  a pains  taking investigation  and neat<br \/>\npresentation,  has   brought  to  our  notice  the  relevant<br \/>\nprovisions of  the Act\tand the\t decision of  this Court  in<br \/>\n<a href=\"\/doc\/499652\/\" id=\"a_4\">Hatti vs. Sunder Singh<\/a> [(1971) 2 SCR 163] and contended that<br \/>\nthe object  of the  Act and the Delhi Land Reforms, 1954 was<br \/>\nto extinguish  the pre-existing\t right, title  and  interest<br \/>\nheld  by  bhumidar,  sirdar,  tenant,  proprietor  etc.\t and<br \/>\nconferment of  new rights in them. It is also envisaged that<br \/>\nall other  lands shall\tstand vested  in the  Gaon Sabha  by<br \/>\noperation of  <a href=\"\/doc\/7832\/\" id=\"a_5\">Section 154<\/a>  of the Act read with <a href=\"\/doc\/1789527\/\" id=\"a_6\">Section 7<\/a> of<br \/>\nthe Act.  The respondents  are not  bhumidars. The  land  in<br \/>\nquestion has  been recorded  in the revenue records as &#8220;gair<br \/>\nmumkin pahar&#8221;,\tin other  words, it is an uncultivable waste<br \/>\nland. It  is not  excluded from the definition of waste land<br \/>\nas explained  in explanation  to <a href=\"\/doc\/1789527\/\" id=\"a_7\">Section  7<\/a> of\tthe  Act.  A<br \/>\nreading of  the relevant  provision of <a href=\"\/doc\/66420479\/\" id=\"a_8\">Sections 5<\/a>, <a href=\"\/doc\/1789527\/\" id=\"a_9\">7<\/a>, <a href=\"\/doc\/291273\/\" id=\"a_10\">11<\/a> and<br \/>\n<a href=\"\/doc\/7832\/\" id=\"a_11\">154<\/a> of\tthe Act\t read with the definitions of `land&#8217; defined<br \/>\nin  <a href=\"\/doc\/740483\/\" id=\"a_12\">Section  3(13)<\/a>,  `holding  defined\tin  <a href=\"\/doc\/740483\/\" id=\"a_13\">Section  3(11A)<\/a>,<br \/>\n`khudkhast&#8217; defined in <a href=\"\/doc\/740483\/\" id=\"a_14\">Section 3(12A)<\/a> and `proprietor&#8217; under<br \/>\n<a href=\"\/doc\/740483\/\" id=\"a_15\">Section 3(17)<\/a>  of the  Act, would  clearly indicate that the<br \/>\nrespondents are\t not bhumidars\tin respect  of\tgair  mumkin<br \/>\npahar. As  a consequence, the land stands vested in the Gaon<br \/>\nSabha under  <a href=\"\/doc\/1789527\/\" id=\"a_16\">Section 7<\/a>\tread with <a href=\"\/doc\/7832\/\" id=\"a_17\">Section 154<\/a> of the Act. On<br \/>\nthe other  hand, Shri  Dhingra and Shri L.C. Chechi, learned<br \/>\ncounsel for  the respondents  contended that by operation of<br \/>\nthe comprehensive  definition of `waste land&#8217; in explanation<br \/>\nto <a href=\"\/doc\/1789527\/\" id=\"a_18\">Section  7<\/a> of  the Act read with the object of conferment<br \/>\nof right  under <a href=\"\/doc\/291273\/\" id=\"a_19\">Section\t 11<\/a> read  with <a href=\"\/doc\/66420479\/\" id=\"a_20\">Section 5<\/a> of the Act,<br \/>\nthe respondents are bhumidars. As a consequence, the land is<br \/>\na cultivable land which confers them title to the land under<br \/>\nthe  Act.   It\tis   also    further  contended\t that  in  a<br \/>\nrepresentative suit  for a declaration that this gair mumkin<br \/>\npahar is  cultivable land was declared to be so by the civil<br \/>\nCourt. The  Deputy Commissioner&#8217;s finding under the Act that<br \/>\nit is  a waste land is not correct. On an appeal against the<br \/>\ndecree, the High Court remitted the matter with an option to<br \/>\nthe Deputy  Commissioner had  not decided  that it  is\tgair<br \/>\nmumkin pahar.  As a consequence, the vesting order passed by<br \/>\nthe  Deputy   Commissioner  is\tnon  est.  The\tHigh  Court,<br \/>\ntherefore, had\trightly gone  into the\tquestion. In support<br \/>\nthereof, the  learned counsel  placed reliance on a judgment<br \/>\nof the\tlearned single\tjudge in a second appeal. It is also<br \/>\ncontended that\tthe view  taken by the Division Bench of the<br \/>\nHigh Court  in that  behalf is\tcorrect in  law. It does not<br \/>\nwarrant interference.\n<\/p>\n<p id=\"p_4\">     Having  regard   to  the  respective  contentions,\t the<br \/>\nquestion that  arise for  consideration is  :  whether\tgair<br \/>\nmumkin pahar  land is  cultivable  land\t coming\t within\t the<br \/>\nmeaning of explanation to <a href=\"\/doc\/1789527\/\" id=\"a_21\">Section 7<\/a> so as to exclude it from<br \/>\nthe operation  of the  main part  of <a href=\"\/doc\/1789527\/\" id=\"a_22\">Section  7<\/a> of  the Act?<br \/>\n<a href=\"\/doc\/740483\/\" id=\"a_23\">Section 3(13)<\/a> defines `land; thus:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>     &#8220;(15) &#8220;land&#8221; except in <a href=\"\/doc\/663245\/\" id=\"a_24\">Sections 22<\/a>,<br \/>\n     <a href=\"\/doc\/31609\/\" id=\"a_25\">23<\/a>\t and  <a href=\"\/doc\/1485112\/\" id=\"a_26\">24<\/a>,  means  land\theld  or<br \/>\n     occupied  for   purposes  connected<br \/>\n     with agriculture,\thorticulture  or<br \/>\n     animal\thusbandry      including<br \/>\n     pisciculture  and\tpoultry\t farming<br \/>\n     and includes&#8230;&#8221;<\/p><\/blockquote>\n<p id=\"p_5\">     Admittedly, the lands in question have been recorded in<br \/>\nthe revenue  recorded as  gair mumkin  pahar. Therefore, the<br \/>\nlands cannot be held or occupied or used  in connection with<br \/>\nagriculture,  horticulture,   animal   husbandry   including<br \/>\npisciculture and poultry farming etc.<br \/>\n     `Holding&#8217; has  been defined  under <a href=\"\/doc\/740483\/\" id=\"a_27\">Section 3(11)<\/a> of the<br \/>\nAct means:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>     &#8220;(a)&#8230;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>     (b) in  respect of\t proprietors,  a<br \/>\n     parcel or\tparcels of  land held as<br \/>\n     sir or khud-khast.&#8221;<\/p><\/blockquote>\n<p id=\"p_6\">     `khudkhast&#8217; has been defined under <a href=\"\/doc\/740483\/\" id=\"a_28\">Section 3(12A)<\/a> means<br \/>\nland (other  than Sir) cultivated by a proprietary either by<br \/>\nhimself or by servants or by hired labour,&#8230;\n<\/p>\n<blockquote id=\"blockquote_3\"><p>     &#8220;(a) at  the commencement\tof  this<br \/>\n     Act, or  (b) at any time during the<br \/>\n     period of\tfive  years  immediately<br \/>\n     before  the  commencement\tof  this<br \/>\n     Act,  whether  or\tnot  it\t was  so<br \/>\n     cultivated\t at  such  commencement,<br \/>\n     provided that  it has  not, at  any<br \/>\n     time   after    having   been    so<br \/>\n     cultivated\t been\tlet  out   to  a<br \/>\n     tenant&#8221;.<\/p><\/blockquote>\n<p id=\"p_7\">     Therefore, it  is clear  from the above provisions that<br \/>\nthe gair  mumkin pahar\tis not\ta  land\t cultivated  by\t the<br \/>\nproprietor and so it is not a khud-khast land.\n<\/p>\n<p id=\"p_8\">     <a href=\"\/doc\/66420479\/\" id=\"a_29\">Section 5<\/a> of the Act defines Bhumidar thus :<br \/>\n     &#8220;5.   Bhumidhar&#8211;\t  Every\t  person<br \/>\n     belonging to  any of  the following<br \/>\n     classes shall  be a  Bhumidhar  and<br \/>\n     shall  have   all\trights\t and  be<br \/>\n     subject  to   all\tthe  liabilities<br \/>\n     conferred\t or   imposed\tupon   a<br \/>\n     Bhumidhar by  or  under  this  Act,<br \/>\n     namely:\n<\/p>\n<p id=\"p_9\">     (a) a  proprietor\tholding\t Sir  or<br \/>\n     Khudkhast\t land\ta   proprietor&#8217;s<br \/>\n     grover holder,  an occupancy tenant<br \/>\n     under  Section   5\t of  the  Punjab<br \/>\n     Tenancy Act,  1887, paying\t rent at<br \/>\n     revenue rates  or a  person holding<br \/>\n     land   under    Patta   Dawami   or<br \/>\n     Istamrari with  rights of\ttransfer<br \/>\n     by\t  sale,\t   who\t are\tdeclared<br \/>\n     Bhumidhars on  the commencement  of<br \/>\n     this Act:\n<\/p>\n<p id=\"p_10\">     (b) every\tclass of  tenants  other<br \/>\n     than those\t referred to  in  clause\n<\/p>\n<p id=\"p_11\">     (a) and subtenants who are declared<br \/>\n     to in clause (a) and subtenants who<br \/>\n     are  declared   Bhumidhars\t on  the<br \/>\n     commencement of this Act ; or\n<\/p>\n<p id=\"p_12\">     (c) every\tperson\twho,  after  the<br \/>\n     commencement  of\tthis   Act,   is<br \/>\n     admitted to  land as  Bhumidhar  or<br \/>\n     who acquires Bhumidhar rights under<br \/>\n     any provisions of the Act.&#8221;\n<\/p>\n<p id=\"p_13\">     Resultantly, the  respondents are not bhumidhars, since<br \/>\nthey did  not hold  the land  as proprietor  and, therefore,<br \/>\nshall not have proprietary right in gair mumkin pahar.\n<\/p>\n<p id=\"p_14\">     part B  of the  Act postulates  acquisition of  certain<br \/>\nrights of  proprietors. <a href=\"\/doc\/1789527\/\" id=\"a_30\">Section 7<\/a> under this part postulates<br \/>\nthe rights  of proprietary  in waste lands. pasture lands of<br \/>\ncommon utility\tetc. to\t vest in Gaon Sabha and compensation<br \/>\nto be paid for the&#8230;\n<\/p>\n<blockquote id=\"blockquote_4\"><p>     &#8220;(1) All  rights of  an  individual<br \/>\n     proprietor\t     or\t     proprietors<br \/>\n     pertaining to  waste lands. grazing<br \/>\n     or\t collection  of\t forest\t produce<br \/>\n     from forest  or fish from fisheries<br \/>\n     lands of  common utility,\tsuch  as<br \/>\n     customary\tcommon\t pasture  lands,<br \/>\n     cremation or  burial grounds, abide<br \/>\n     sites pathways, public wells, tanks<br \/>\n     and water\tchannels, or  khalihans,<br \/>\n     whether  covered\tby  an\texisting<br \/>\n     contract between such proprietor or<br \/>\n     proprietors and any other person or<br \/>\n     not, shall\t with  effect  from  the<br \/>\n     commencement   of\t this\tAct   be<br \/>\n     terminated in  accordance with  the<br \/>\n     provision of  sub-section\t(2)  and<br \/>\n     the said  contracts, if  any, shall<br \/>\n     become void  with effect  from such<br \/>\n     commencement.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_5\"><p>     provided that where such land was a<br \/>\n     result of consolidation of holdings<br \/>\n     made  available  for  use\tfor  any<br \/>\n     purposes other  than those referred<br \/>\n     to in  this subsection,  land  kept<br \/>\n     aside  in\texchange  thereof,  land<br \/>\n     kept aside\t in exchange thereof, as<br \/>\n     a\tresult\tof  such  consolidation,<br \/>\n     shall for\tthe purposes of this Act<br \/>\n     be deemed\tto  be\tland  originally<br \/>\n     meant for\tpurposes referred  to in<br \/>\n     this sub-section.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_6\"><p>     Explanation &#8212;  for the  purpose of<br \/>\n     this sub-section&#8211;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_7\"><p>     (i)  &#8220;waste   land&#8217;  shall\t include<br \/>\n     cultivable and  uncultivable  waste<br \/>\n     area or  the village  including any<br \/>\n     land  in\tthe  bed   of  a  river,<br \/>\n     occupied  or   held  by   f  river,<br \/>\n     occupied  or   held  by   an  Asami<br \/>\n     referred to in <a href=\"\/doc\/166819243\/\" id=\"a_31\">Section 6(a)(iii)<\/a> of<br \/>\n     the  Act  except  the  uncultivated<br \/>\n     area&#8212;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_8\"><p>     (a)  included  in\tthe  holding  of<br \/>\n     such proprietor proprietors, or\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_9\"><p>     (b)  used for  purposes  other than<br \/>\n     those mentioned  in clause (143) of<br \/>\n\t  <a href=\"\/doc\/740483\/\" id=\"a_32\">Section 3<\/a>  at any  time before<br \/>\n     the 26th day of October, 1956 or\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_10\"><p>     (c)  acquired    by    bona    fide<br \/>\n     purchaser for  value  at  any  time<br \/>\n     before the\t 28th  day  of\tOctober,<br \/>\n     1958 for  purpose other than  those<br \/>\n     mentioned in clause (13) of Section\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_11\"><p>     3.&#8221;<\/p><\/blockquote>\n<p id=\"p_15\">     Conjoint  reading\t of  <a href=\"\/doc\/1789527\/\" id=\"a_33\">Section   7<\/a>   read\t  with\t the<br \/>\nexplanation, it\t emerges that  unless the  waste land stands<br \/>\nexcluded from  <a href=\"\/doc\/1789527\/\" id=\"a_34\">Section 7<\/a>,  the rights  of the proprietors in<br \/>\nwaste lands,  posture lands  or community utility lands etc.<br \/>\nshall vest  in Gaon  Sabha. The\t waste land  included in the<br \/>\nholding of  the proprietor  stands excepted  from the  waste<br \/>\nland contemplated by <a href=\"\/doc\/1789527\/\" id=\"a_35\">Section 7<\/a>.\n<\/p>\n<p id=\"p_16\">     <a href=\"\/doc\/291273\/\" id=\"a_36\">Section  11<\/a>   of  the   Act  provides   declaration  of<br \/>\nBhumidhari Rights  in favour  of  proprietors  and  superior<br \/>\nclass of  tenants, compensation and revenue.<br \/>\nSubsection (1) provides that;\n<\/p>\n<blockquote id=\"blockquote_12\"><p>     &#8220;(1) Subject  to the  provisions of<br \/>\n     <a href=\"\/doc\/742973\/\" id=\"a_37\">Section 10<\/a>, the Deputy Commissioner<br \/>\n     shall declare  as Bhumidhar persons<br \/>\n     holding   the    following\t  lands,<br \/>\n     namely:-\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_13\"><p>     (a)  Khudkhast    land\tor     a<br \/>\n     proprietor&#8217;s grover  in the  tracts<br \/>\n     to which  the Punjab  Tenancy  Act,<br \/>\n     1887 was  applicable or Sir land or<br \/>\n     khudkhast land  or\t a  proprietor&#8217;s<br \/>\n     grove in  the tracts  to which  the<br \/>\n     Agra   Tenancy   Act,   1901,   was<br \/>\n     applicable:\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_14\"><p>     (b)  land held by occupancy tenants<br \/>\n     under  Section   5\t of  the  Punjab<br \/>\n     Tenancy Act,  1887, with  right  of<br \/>\n     transfer by sale; and\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_15\"><p>     (c)  land held  under patta  Dawami<br \/>\n     or Istamrari  by tenants with right<br \/>\n     of transfer by sale.&#8221;<\/p><\/blockquote>\n<p id=\"p_17\">     By operation of <a href=\"\/doc\/291273\/\" id=\"a_38\">Section 11<\/a>, all the lands including the<br \/>\nholding\t  of the  Bhumidhar etc.  shall be  declared to be a<br \/>\nBhumidhar right.  It is,  thus, clear  that by\toperation of<br \/>\n<a href=\"\/doc\/66420479\/\" id=\"a_39\">Section 5<\/a> read with the definition of khudkhast land and the<br \/>\nexplanation to\twaste land  under <a href=\"\/doc\/1789527\/\" id=\"a_40\">Section  7<\/a> of the Act, the<br \/>\nlands not  having been\theld by\t Bhumidhars,  it  cannot  be<br \/>\ntreated to  be a  waste land  for the  purpose of  exclusion<br \/>\nunder the explanation from the purview of <a href=\"\/doc\/1789527\/\" id=\"a_41\">Section 7<\/a> of the<br \/>\nAct.\n<\/p>\n<p id=\"p_18\">     what would\t be  the  consequence  has  been  stated  in<br \/>\n<a href=\"\/doc\/7832\/\" id=\"a_42\">Section 154<\/a>  of the  Act is  to be  seen. <a href=\"\/doc\/7832\/\" id=\"a_43\">Section  154<\/a> reads<br \/>\nthus:\n<\/p>\n<blockquote id=\"blockquote_16\"><p>     &#8220;154. Vesting of certain lands etc.<br \/>\n     in\t Gaon\tSabha  &#8212;   (1)\t On  the<br \/>\n     commencement of this Act&#8211;<br \/>\n     (1) all lands whether cultivable or<br \/>\n     otherwise, except land for the time<br \/>\n     being comprised  in any  holding or<br \/>\n     grove,<br \/>\n     xxxxxxxxxxxxxxxxxxxxxxxxxxxx<br \/>\n     situate in a Gaon Sabha Area, shall<br \/>\n     vest in Gaon Sabha.&#8221;<\/p><\/blockquote>\n<p id=\"p_19\">     Thus, it  could be\t seen that  except the\tland for the<br \/>\ntime being  comprised in any holding or a grove, rest of all<br \/>\nlands whether  cultivable or otherwise vest in the Gaon from<br \/>\nthe date of the commencement of the Act.\n<\/p>\n<p id=\"p_20\">     This question  also no  longer res integra. In  Hatti&#8217;s<br \/>\ncase  (supra),\t this  Court  has  gone\t into  the  relevant<br \/>\nprovisions of the Act and held thus:\n<\/p>\n<blockquote id=\"blockquote_17\"><p>     &#8220;<a href=\"\/doc\/1792838\/\" id=\"a_44\">Sections 6<\/a>,  <a href=\"\/doc\/291273\/\" id=\"a_45\">11<\/a>, <a href=\"\/doc\/1857501\/\" id=\"a_46\">13<\/a> and <a href=\"\/doc\/7832\/\" id=\"a_47\">154<\/a> of the<br \/>\n     Act read together, thus, show that,<br \/>\n     after  the\t Act  came  into  force,<br \/>\n     proprietors of agricultural land as<br \/>\n     such ceased  to exist.  if any land<br \/>\n     was  part\t of  a\t holding  of   a<br \/>\n     proprietor, he became a Bhumidar of<br \/>\n     it. if  it was part of a holding of<br \/>\n     some other person, such as a tenant<br \/>\n     or a  sub-tenant  etc.,  he  became<br \/>\n     either a  Bhumidar\t  or  an  Asami,<br \/>\n     whereupon\t the   rights\tof   the<br \/>\n     proprietor\t in  that  land\t ceased,<br \/>\n     Land, which  were\tnot  holding  of<br \/>\n     either the\t proprietor or any other<br \/>\n     person, vested  in the  Gaon Sabha.<br \/>\n     In the  case of  proprietors, their<br \/>\n     rights in\tthe  land  continued  to<br \/>\n     exist only\t in respect  of holdings<br \/>\n     which, under  the definition,  must<br \/>\n     have  been\t  either  their\t sir  or<br \/>\n     khudkasht at  the\tcommencement  of<br \/>\n     the Act.  If  it  was  not\t sir  or<br \/>\n     khudkasht of a proprietor, it would<br \/>\n     not    be\t  his\t holding    and,<br \/>\n     consequently, such\t land would vest<br \/>\n     in the  Gaon  Sabha  under\t <a href=\"\/doc\/7832\/\" id=\"a_48\">Section<br \/>\n     154<\/a>, the  result of  which would be<br \/>\n     that the  rights of  the proprietor<br \/>\n     would be extinguished&#8221;.<\/p><\/blockquote>\n<p id=\"p_21\">     As stated\tearlier, indisputably in the revenue records<br \/>\nthe land in question had been recorded as gair mumkin pahar.<br \/>\nUnder those circumstances, this gair mumkin pahar land which<br \/>\nwas  not   held\t by  the  respondents  as  khudkhastdars  as<br \/>\nproprietors thereof.  As a consequence, the land shall stand<br \/>\nvested in  the Gaon  Sabha. It\tis true\t that in the earlier<br \/>\ncivil  suit   filed  in\t a  representative  capacity  for  a<br \/>\ndeclaration, the  High Court has gone into the question, but<br \/>\nthe entire  matter was\tleft at\t large stating that &#8220;it does<br \/>\nnot mean  that the  Deputy Commissioner\t Cannot redecide the<br \/>\nmatter. in  fact, he  should reconsider\t the matter and hear<br \/>\nthe parties  to determine whether the order is in accordance<br \/>\nwith law&#8230;  However, I would also like to clarify that this<br \/>\ndoes not  by any  means end  the matter&#8221;.  Thus, there is no<br \/>\nconcluded finding  recorded by\tthe High Court in the second<br \/>\nappeal with  regard to\tthe nature of the land. On the other<br \/>\nhand, the  matter was  kept at\tlarge. At  that\t stage,\t the<br \/>\nacquisition proceedings were initiated. As a consequence, no<br \/>\nfurther action has been taken by the Deputy commissioner.<br \/>\nConsequently,  the   entire  issue  was\t at  large.  Obvious<br \/>\ntherefore, that when there was conflict of decisions between<br \/>\ntow learned  single Judges, the Division Bench has gone into<br \/>\nthe question. But, it had not properly considered the effect<br \/>\nof the provisions of the Act and came to the conclusion that<br \/>\nthe explanation\t of `waste  land&#8217; under\t <a href=\"\/doc\/1789527\/\" id=\"a_49\">Section 7<\/a>  includes<br \/>\ncultivable, waste  and gair mumkin pahar is cultivable waste<br \/>\nland and  the respondents  became owners  of  the  land\t and<br \/>\nentitled  to   the  compensation.   In\tview  of  the  above<br \/>\ndiscussion, the view taken by the division. Bench is clearly<br \/>\nin error. Accordingly, we set aside the judgment of the High<br \/>\nCourt and confirmed that of the District Court.\n<\/p>\n<p id=\"p_22\">     The  appeal   is  accordingly    allowed,\tbut  in\t the<br \/>\ncircumstances, without costs.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Union Of India &amp; Anr vs Sher Singh &amp; Ors on 7 February, 1997 Bench: K.
