Rule stands discharged  qua<br \/>\n\tapplicants No.1 and 2.\n<\/p>\n<p id=\"p_2\">This<br \/>\n\tapplication is filed under <a href=\"\/doc\/1290514\/\" id=\"a_1\">Section 439<\/a> of the Code of Criminal<br \/>\n\tProcedure in connection with First Information Report registered as<br \/>\n\tI-C.R. No.65\/2011 with Gadhada Police Station,  for the offences<br \/>\n\tpunishable u\/s. 307, 325, 324, 323, 504, 34 and 417<a href=\"\/doc\/1569253\/\" id=\"a_1\"> of Indian Penal<br \/>\n\tCode<\/a> &amp; u\/s. 135 of the B.P. Act.\n<\/p>\n<p id=\"p_3\">Learned<br \/>\n\tCounsel appearing for the applicants submits that<br \/>\n\tconsidering the role attributed to applicants No.3 and 4 vis-a-viz<br \/>\n\tthe nature of injuries at this stage, their case may be  considered<br \/>\n\tfor regular bail.\n<\/p>\n<p id=\"p_4\">Heard<br \/>\n\tlearned APP Mrs. Manisha L. Shah for the respondent-State.\n<\/p>\n<p id=\"p_5\">Having<br \/>\n\theard learned Counsels for the parties and perusing the record of<br \/>\n\tthe case and taking into consideration the facts of the case, nature<br \/>\n\tof allegations, role attributed to the applicants, by imposing<br \/>\n\tsuitable conditions, I deem it just and proper to enlarge the<br \/>\n\tapplicants No.3 and 4 and  on bail.\n<\/p>\n<p id=\"p_6\">Learned<br \/>\n\tCounsels for the parties do not press for further reasoned order.\n<\/p>\n<p id=\"p_7\">In<br \/>\n\tthe facts and circumstances of the case, the application is allowed<br \/>\n\tand the applicant No.3 &#8211; Rambhai Nathabhai Dholakia and<br \/>\n\tapplicant No.4 &#8211;  Kanubhai Vihabhai Dholakia are ordered to be<br \/>\n\treleased on bail in connection with First Information Report<br \/>\n\tregistered as I-C.R. No.65\/2011 with Gadhada Police Station, on<br \/>\n\texecuting a bond of Rs.5,000\/- (Rupees Five Thousand Only) each with<br \/>\n\tone surety of the like amount to the satisfaction of the Trial Court<br \/>\n\tand subject to the conditions that they shall;\n<\/p>\n<p id=\"p_8\">a)<br \/>\n\tnot take undue advantage of liberty or misuse liberty;\n<\/p>\n<p id=\"p_9\">b)<br \/>\n\tnot act in a manner injurious to the interest of the prosecution;\n<\/p>\n<p id=\"p_10\">c)<br \/>\n\tsurrender their passports, if any, to the lower court within a week;\n<\/p>\n<p id=\"p_11\">d)<br \/>\n\tnot leave the State of Gujarat without prior permission of the<br \/>\n\tSessions Judge concerned;\n<\/p>\n<p id=\"p_12\">e)<br \/>\n\tmark presence at the concerned Police Station on the first Sunday of<br \/>\n\tevery month between 10.00 a.m. and 3.00 p.m. for three months only;\n<\/p>\n<p id=\"p_13\">f)<br \/>\n\tfurnish the present address of their residence to the Investigating<br \/>\n\tOfficer and also to the Court at the time of execution of the bond<br \/>\n\tand shall not change the residence without prior permission of this<br \/>\n\tCourt;\n<\/p>\n<p id=\"p_14\">The<br \/>\n\tauthorities will release the applicants only if not required in<br \/>\n\tconnection with any other offence for the time being.\n<\/p>\n<p id=\"p_15\">If<br \/>\n\tbreach of any of the above conditions is committed, the Sessions<br \/>\n\tJudge concerned will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p id=\"p_16\">Bail<br \/>\n\tbond to be executed before the lower court having jurisdiction to<br \/>\n\ttry the case.\n<\/p>\n<p id=\"p_17\">At<br \/>\n\tthe trial, the Trial Court shall not be influenced by the<br \/>\n\tobservations of preliminary nature, qua the evidence at this stage,<br \/>\n\tmade by this Court while enlarging the applicants on bail.\n<\/p>\n<p id=\"p_18\">Rule<br \/>\n\tmade absolute.
