DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 08\/07\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p id=\"p_1\">This<br \/>\n\tapplication is filed under <a href=\"\/doc\/1290514\/\" id=\"a_1\">Section 439<\/a> of the Code of Criminal<br \/>\n\tProcedure in connection with First Information Report registered as<br \/>\n\tI-C.R. No.35\/2011 with Savarkundla Rural Police Station, Amreli for<br \/>\n\tthe offences punishable under <a href=\"\/doc\/409589\/\" id=\"a_1\">Sections 304<\/a> and <a href=\"\/doc\/37788\/\" id=\"a_2\">34<\/a> of Indian Penal<br \/>\n\tCode.\n<\/p>\n<p id=\"p_1\">Learned<br \/>\n\tCounsel appearing for the applicants submit that the investigation<br \/>\n\tis on verge of completion and cause of death is cardio-respiratory<br \/>\n\tfailure and at this stage, no material points out the offences<br \/>\n\talleged as such  and hence, the applicants may be enlarged on bail.\n<\/p>\n<p id=\"p_2\">Heard<br \/>\n\tlearned APP Mrs. Manisha L. Shah for the respondent-State.\n<\/p>\n<p id=\"p_3\">Having<br \/>\n\theard learned Counsels for the parties and perusing the record of<br \/>\n\tthe case and taking into consideration the facts of the case, nature<br \/>\n\tof allegations, role attributed to the applicants, by imposing<br \/>\n\tsuitable conditions, I deem it just and proper to enlarge the<br \/>\n\tapplicants on bail.\n<\/p>\n<p id=\"p_4\">Learned<br \/>\n\tCounsels for the parties do not press for further reasoned order.\n<\/p>\n<p id=\"p_5\">In<br \/>\n\tthe facts and circumstances of the case, the application is allowed<br \/>\n\tand the applicants are ordered to be released on bail in connection<br \/>\n\twith First Information Report registered as I-C.R. No.35\/2011 with<br \/>\n\tSavarkundla Rural Police Station, Amreli, on executing a bond of<br \/>\n\tRs.5,000\/- (Rupees Five Thousand Only) each with one surety of the<br \/>\n\tlike amount to the satisfaction of the Trial Court and subject to<br \/>\n\tthe conditions that they shall;\n<\/p>\n<p id=\"p_6\">a) not take undue advantage of liberty<br \/>\n\tor misuse liberty;\n<\/p>\n<p id=\"p_7\">b) not act in a manner injurious to<br \/>\n\tthe interest of the prosecution;\n<\/p>\n<p id=\"p_8\">c) surrender their passports, if any,<br \/>\n\tto the lower court within a week;\n<\/p>\n<p id=\"p_9\">d) not leave the State of Gujarat<br \/>\n\twithout prior permission of the Sessions Judge concerned;\n<\/p>\n<p id=\"p_10\">e) mark presence at the concerned<br \/>\n\tPolice Station on the first Sunday of every month between 10.00 a.m.<br \/>\n\tand 3.00 p.m. for three months only;\n<\/p>\n<p id=\"p_11\">f) furnish the present address of<br \/>\n\ttheir residence to the Investigating Officer and also to the Court<br \/>\n\tat the time of execution of the bond and shall not change the<br \/>\n\tresidence without prior permission of this Court;\n<\/p>\n<p id=\"p_12\">The<br \/>\n\tauthorities will release the applicants only if not required in<br \/>\n\tconnection with any other offence for the time being.\n<\/p>\n<p id=\"p_13\">If<br \/>\n\tbreach of any of the above conditions is committed, the Sessions<br \/>\n\tJudge concerned will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p id=\"p_14\">Bail<br \/>\n\tbond to be executed before the lower court having jurisdiction to<br \/>\n\ttry the case.\n<\/p>\n<p id=\"p_15\">At<br \/>\n\tthe trial, the Trial Court shall not be influenced by the<br \/>\n\tobservations of preliminary nature, qua the evidence at this stage,<br \/>\n\tmade by this Court while enlarging the applicants on bail.\n<\/p>\n<p id=\"p_16\">Rule<br \/>\n\tmade absolute.
