No.32956 of 2004 (W)\n             ---------------------------------\n           Dated, this the 22nd day of December, 2009\n\n                           J U D G M E N T\n<\/pre>\n<p id=\"p_1\">     Challenge in the writ petition is against Exts.P6, P11 &amp; P13.<\/p>\n<p id=\"p_1\">     2.    Although, these orders are challenged in its entirety,<\/p>\n<p>when the matter was argued, the learned counsel for the petitioner<\/p>\n<p>confines his submissions regarding the punishment that was<\/p>\n<p>imposed and therefore, only to the extent it is relevant the facts<\/p>\n<p>stated in the writ petition are referred to.\n<\/p>\n<p id=\"p_2\">     3.    The    petitioner    entered   service of   the  erstwhile<\/p>\n<p>Cardamom Board, presently known as the Spices Board, the 1st<\/p>\n<p>respondent herein, as a Junior Field Officer. He earned promotions<\/p>\n<p>as   Field  Officer,    Senior   Field   Officer, Assistant   Director<\/p>\n<p>(Development) and Deputy Director (Development). While working<\/p>\n<p>at Gauahati, he was issued Ext.P4 memo of charges, which led to an<\/p>\n<p>enquiry, the report of which is Ext.P6. The report was accepted and<\/p>\n<p>he was issued Ext.P9 show cause notice proposing to impose<\/p>\n<p>punishment of compulsory retirement. He submitted Ext.P10 reply<\/p>\n<p>WP(C) No.32956\/2004<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                  -2-<\/span><\/p>\n<p>and finally, he was issued Ext.P11 order imposing a punishment of<\/p>\n<p>reduction to the post of Senior Field Officer and debarring<\/p>\n<p>promotion permanently.      He filed Ext.P12 appeal before the 3rd<\/p>\n<p>respondent.    The appeal was disposed of by Ext.P13, where the<\/p>\n<p>order in Ext.P11 debarring him permanently from promotion was<\/p>\n<p>modified and was confined to five years. It is challenging Exts.P6,<\/p>\n<p>P11 &amp; P13, this writ petition was filed.\n<\/p>\n<p id=\"p_3\">      4.    Contention raised by the learned counsel for the<\/p>\n<p>petitioner is that under Regulation 7 of the Spices Board Service<\/p>\n<p>(Classification,  Control   and  Appeal)   Regulations, 1992,     the<\/p>\n<p>punishment that could be imposed is reduction to a lower-time<\/p>\n<p>scale of pay, grade or post. According to the petitioner, at the time<\/p>\n<p>when punishment was imposed on him, he was occupying the post<\/p>\n<p>of Deputy Director (Development).       The post of Deputy Director<\/p>\n<p>(Development) is the promotion post of Assistant Director<\/p>\n<p>(Development), which in turn is the promotion post of Senior Field<\/p>\n<p>Officer. The contention raised is that even if reduction to a lower<\/p>\n<p>grade or post could be imposed, it could be imposed only to the<\/p>\n<p>immediate lower post and not to any other post. This contention of<\/p>\n<p>WP(C) No.32956\/2004<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                      -3-<\/span><\/p>\n<p>the petitioner is sought to be substantiated referring to the Apex<\/p>\n<p>Court judgment in Ram Prakash Agnihotri v. District Judge U.P. and<\/p>\n<p>Others (1991 Supp (1) SCC 190), and the judgment of this Court in<\/p>\n<p><a href=\"\/doc\/934858\/\" id=\"a_1\">Sreekantan Nair v. Hindustan Latex Ltd<\/a>. (2001(1) KLT 447).<\/p>\n<p id=\"p_4\">     5.     On the other hand, the learned standing counsel for the<\/p>\n<p>respondent Board placed reliance on the Apex Court judgment in<\/p>\n<p><a href=\"\/doc\/1372653\/\" id=\"a_1\">Nyadar Singh v. Union of India &amp; Others<\/a> (AIR 1988 SC 1979) and<\/p>\n<p>contended that Rules permit reduction to any lower post. It is the<\/p>\n<p>correctness of this issue, which calls for examination.<\/p>\n<p id=\"p_5\">     6.     The Rule in question, is Rule 7 of the Spices Board<\/p>\n<p>Service (Classification, Control and Appeal) Regulations, 1992 and<\/p>\n<p>Clause (vi) of the Rule 7 reads thus:-\n<\/p>\n<blockquote id=\"blockquote_1\"><p>     &#8220;(vi)  Reduction to a lower time-scale of pay, grade or post which<br \/>\n     shall ordinarily be a bar to the promotion of the Board&#8217;s employee<br \/>\n     to the time-scale of pay, grade or post from which he was<br \/>\n     reduced, with or without further directions regarding conditions of<br \/>\n     restoration to the grade or post from which the Board&#8217;s employee<br \/>\n     was reduced and his seniority and pay on such restoration to that<br \/>\n     grade or post;&#8221;<\/p><\/blockquote>\n<p id=\"p_6\">\n<p id=\"p_7\">     7.     Therefore, this Rule enables the disciplinary authority to<\/p>\n<p>impose a major penalty of reduction to a lower time-scale of pay,<\/p>\n<p>WP(C) No.32956\/2004<br \/>\n<span class=\"hidden_text\" id=\"span_2\">                                -4-<\/span><\/p>\n<p>grade or post. The question is whether the reduction could be to<\/p>\n<p>any post lower than the immediate lower post. Similar Rule came up<\/p>\n<p>for consideration before the Apex Court in the judgment relied on<\/p>\n<p>by the learned counsel for the petitioner, where it has been held<\/p>\n<p>that reduction of rank can only be to the next lower rank in the<\/p>\n<p>hierarchy and and not beyond that. Similar view has been taken by<\/p>\n<p>this Court in the judgment in Sreekantan Nair&#8217;s case referred to<\/p>\n<p>above, where in paragraph 4, it has been held that reduction can<\/p>\n<p>only be to a lower grade\/post and not to any lower grade\/post. It<\/p>\n<p>was further held that it is widely understood in service law while<\/p>\n<p>imposing penalty of reduction in rank, that it shall be only to the<\/p>\n<p>next post below. So viewed, the contention of the petitioner that he<\/p>\n<p>could not have been reduced to the post of Senior Field Officer<\/p>\n<p>deserves acceptance.\n<\/p>\n<p id=\"p_8\">     8.    However,   the   learned  standing   counsel    for  the<\/p>\n<p>respondent Board relied on the Apex Court judgment reported in<\/p>\n<p><a href=\"\/doc\/1372653\/\" id=\"a_2\">Nyadar Singh v. Union of India &amp; Others<\/a> (AIR 1988 SC 1979). In my<\/p>\n<p>view that judgment does not admit of the interpretation that is<\/p>\n<p>sought to be claimed by the learned counsel for the petitioner. On<\/p>\n<p>WP(C) No.32956\/2004<br \/>\n<span class=\"hidden_text\" id=\"span_3\">                                   -5-<\/span><\/p>\n<p>the other hand, it is to be noticed that it was after referring to this<\/p>\n<p>judgment also, that this Court has held in Sreekantan Nair&#8217;s case<\/p>\n<p>that reduction can only be to a lower grade\/post.<\/p>\n<p id=\"p_9\">      9.    Therefore, Exts.P11 &amp; P13 to the extent the petitioner is<\/p>\n<p>reduced to the post of Senior Field Officer deserves interference and<\/p>\n<p>is set aside. It is directed that the reduction will be only to the post<\/p>\n<p>of Assistant Director (Development).
