No.309 of 2011\n           NILESH KUMAR @ NILESH SINGH,S\/O- SRI GOPAL SINGH, R\/O-\n           BARO RAMPUR, P.S.- GARHARA, (BARAUNI), DISTRICT-\n           BEGUSARAI.\n                                         Versus\n                               THE STATE OF BIHAR\n                                       -----------\n<\/pre>\n<p id=\"p_1\">3   08.04.2011                Rule confined to question of sentence only.<\/p>\n<p id=\"p_1\">                              Learned A.P.P. waives notice on behalf of the<\/p>\n<p>                 State.\n<\/p>\n<p id=\"p_2\">                              Heard. With the consent of the parties, the<\/p>\n<p>                 application is being finally disposed of at this stage.<\/p>\n<p id=\"p_3\">                              Petitioner is aggrieved by the judgment and<\/p>\n<p>                 order dated 11.2.2011 passed by learned Addl. Sessions<\/p>\n<p>                 Judge-II, Begusarai on Cr. Appeal No. 130\/2010 whereby<\/p>\n<p>                 the judgment and order of conviction recorded by learned<\/p>\n<p>                 Trial Court in Tr. No. 472\/2010 has been affirmed with<\/p>\n<p>                 modification in sentence.\n<\/p>\n<p id=\"p_4\">                              As per the prosecution case, the petitioner was<\/p>\n<p>                 dotted and arrested by the police personnel on 18.8.2009.<\/p>\n<p>                 On search, he was found possessed with one country made<\/p>\n<p>                 pistol and one .315 bore live cartridges. Accordingly, he was<\/p>\n<p>                 put on trial wherein 04 prosecution witnesses were<\/p>\n<p>                 examined besides exhibiting different documents. On a<\/p>\n<p>                 consideration of the evidence on record, learned Trial Court<\/p>\n<p>                 found him guilty under Section 25(1-B)a and 26 of the <a href=\"\/doc\/1934415\/\" id=\"a_1\">Arms<\/p>\n<p>                 Act<\/a> and sentenced to under R.I. for 03 years              with fine<\/p>\n<p>                 having default clause under each head\/count. Aggrieved<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                     2<\/span><\/p>\n<p>over the said judgment and order of conviction, he preferred<\/p>\n<p>appeal which was dismissed with modification in sentence.<\/p>\n<p>Instead of R.I. for 03 years with fine under each head, he<\/p>\n<p>was sentenced to undergo R.I. for one year and six months<\/p>\n<p>under each head\/count having default clause.<\/p>\n<p id=\"p_5\">             Learned counsel for the petitioner submits that<\/p>\n<p>petitioner has remained in custody since 18.8.2009. It is<\/p>\n<p>submitted that the trial consumed more than a year.<\/p>\n<p>Thereafter the appeal remained pending for 02 years.<\/p>\n<p>Fighting criminal litigation for these years have telling effects<\/p>\n<p>on the mental and economical condition of a litigant. It is<\/p>\n<p>submitted that the petitioner is fairly young person and<\/p>\n<p>earning member for his whole family. Petitioner deserves a<\/p>\n<p>lesser quantum of sentence.\n<\/p>\n<p id=\"p_6\">             Learned APP, on the other hand, submits that<\/p>\n<p>there is concurrent findings of guilt recorded by the two<\/p>\n<p>Courts below which do not require interference on merit. It is<\/p>\n<p>contended that from the Trial Court judgment, it appears that<\/p>\n<p>petitioner has some criminal history.\n<\/p>\n<p id=\"p_7\">             Having considered the submissions advanced<\/p>\n<p>on behalf of the parties, this Court finds that the petitioner<\/p>\n<p>had to fight criminal litigation for more than a year. His<\/p>\n<p>appeal remained pending for close to 02 years. Petitioner,<\/p>\n<p>therefore, had to suffer the ordeals\/rigours of trial. It further<\/p>\n<p>appears from the submissions advanced before the Trial<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                              3<\/span><\/p>\n<p>      Court that he is an earning member of the family. Having<\/p>\n<p>      regard to all these facts appearing from record, this Court is<\/p>\n<p>      satisfied that a lesser quantum of sentence than what has<\/p>\n<p>      been imposed by the learned Lower Appellate Court, in the<\/p>\n<p>      facts and circumstances of the case, would subserve the<\/p>\n<p>      cause of justice.\n<\/p>\n<p id=\"p_8\">                    Accordingly, while upholding the conviction<\/p>\n<p>      recorded by learned Trial Court and duly affirmed by the<\/p>\n<p>      learned Lower Appellate Court, the sentence awarded under<\/p>\n<p>      <a href=\"\/doc\/73862\/\" id=\"a_1\">Sections 25<\/a>(1-B)a and 26(i) of the <a href=\"\/doc\/1934415\/\" id=\"a_2\">Arms Act<\/a> is reduced to<\/p>\n<p>      R.I.   for   16   months        under   each   head\/count.      Other<\/p>\n<p>      part(s)\/condition(s)       of    the    sentence    shall    remain<\/p>\n<p>      intact\/unaltered.\n<\/p>\n<p id=\"p_9\">                    With     this     modification   in   sentence,     the<\/p>\n<p>      application is dismissed.\n<\/p>\n<p id=\"p_10\">                    Let the order be communicated through fax on<\/p>\n<p>      depositing appropriate fee by the petitioner.<\/p>\n<p id=\"p_11\">                                 ( Kishore K.
