The 1st party-petitioners have preferred this revision<\/p>\n<p>                             application against the order dated 29.11.2001 passed by<\/p>\n<p>                             the learned Sub-Divisional Magistrate, Majhaul in Case<\/p>\n<p>                             No.1623 (Misc.) of 1981 by which the possession over the<\/p>\n<p>                             land in dispute has been declared under <a href=\"\/doc\/1405190\/\" id=\"a_1\">Section 145<\/a><\/p>\n<p>                             Cr.P.C. in favour of the 2nd party-opposite party.<\/p>\n<p id=\"p_24\">                                     The land in dispute is appertaining to Mauza-<\/p>\n<p>                             Purpathar in Tauzi No.1233, Khata No.38, Plot Nos.24,<\/p>\n<p>                             26, 33, 114, 115, 127 and 128 measuring 4 Bighas, 8<\/p>\n<p>                             Kathas and 8 Dhurs, but on the spot these lands are<\/p>\n<p>                             meansuring 4 Bighas 11 Kathas and 8 dhoors.<\/p>\n<p id=\"p_25\">                                     The facts rising to this application are that an<\/p>\n<p>                             application was filed by the petitioner (original) on<\/p>\n<p>                             10.09.1981 before the learned Sub-Divisional Magistrate,<br \/>\n Patna High Court CR. REV. No.174 of 2002 dt.22-09-2011                              3<\/p>\n<p>                      Majhaul to initiate a proceeding under <a href=\"\/doc\/930621\/\" id=\"a_1\">Section 144<\/a> Cr.P.C.<\/p>\n<p>                      On which, a report was called for from the concerned<\/p>\n<p>                      police station. After receipt of the report, the Sub-<\/p>\n<p>                      Divisional Magistrate initiated a proceeding under <a href=\"\/doc\/930621\/\" id=\"a_2\">Section<\/p>\n<p>                      144<\/a> Cr.P.C. on 16.09.1981 and subsequently, it was<\/p>\n<p>                      converted into a proceeding under <a href=\"\/doc\/1405190\/\" id=\"a_3\">Section 145<\/a> Cr.P.C. on<\/p>\n<p>                      14.11.1981.\n<\/p>\n<p id=\"p_26\">                              The case of the 1st party petitioner is that the land in<\/p>\n<p>                      dispute alongwith other lands were sold in auction on rent<\/p>\n<p>                      suit and purchased by the then landlords Sri Jagarnath<\/p>\n<p>                      Prasad Singh and Sri Balbhadra Prasad Singh, resident of<\/p>\n<p>                      village-Nayanagar, vide Case No.93\/1910 and Case<\/p>\n<p>                      No.48\/1911. The auction sale was confirmed by the 1 st<\/p>\n<p>                      court of Munsif, Begusarai on 21.07.1911 and delivery of<\/p>\n<p>                      possession was affected over the lands in dispute and other<\/p>\n<p>                      lands on 16.11.1911. Both the auction purchasers<\/p>\n<p>                      partitioned their lands privately including the lands in<\/p>\n<p>                      dispute, which, were allotted to the share of Jagarnath<\/p>\n<p>                      Prasad Singh, who came in possession of the same. After<\/p>\n<p>                      the death of Jagarnath Pd. Singh, his only son Ramautar<\/p>\n<p>                      Singh inherited the disputed land and came in possession<\/p>\n<p>                      thereof. The said Ramautar Singh settled the disputed<br \/>\n Patna High Court CR. REV. No.174 of 2002 dt.22-09-2011                           4<\/p>\n<p>                      lands by virtue of Hukumnana dated 1st Asin, 1356 F.S. in<\/p>\n<p>                      favour of Smt. Chandani Devi, wife of the petitioner and<\/p>\n<p>                      since then she is coming in exclusive possession of the<\/p>\n<p>                      same. She was paying rent to the ex-landlords and after<\/p>\n<p>                      vesting of Zamindari her name was mutated in the revenue<\/p>\n<p>                      records of the Anchal and she is paying rent regularly and<\/p>\n<p>                      rent receipts in proof of the payment of rent were regularly<\/p>\n<p>                      issued in her favour.\n<\/p>\n<p id=\"p_27\">                              The case of the 2nd party-opposite party is that the<\/p>\n<p>                      lands, in question, were recorded in the name of their<\/p>\n<p>                      ancestors in the cadastral survey and after the death of the<\/p>\n<p>                      recorded tenants, they have inherited the lands being their<\/p>\n<p>                      heirs and claimed to be in possession thereof. They have<\/p>\n<p>                      further claimed that the recorded tenants have executed<\/p>\n<p>                      several mortgage deeds with respect to the lands in dispute<\/p>\n<p>                      in favour of the relatives of the petitioner as well as in<\/p>\n<p>                      favour of the then landlords. The Ex-landlord of the Tauzi<\/p>\n<p>                      had submitted the name of the recorded tenant in the<\/p>\n<p>                      Jamabandi return submitted at the time of vesting of<\/p>\n<p>                      Jamindari and later rent receipts were also issued vide<\/p>\n<p>                      Mutation Case No.3\/15 of 1980-81 (Annexure-B to the<\/p>\n<p>                      counter affidavit of the opposite party). Thus the opposite<br \/>\n Patna High Court CR. REV. No.174 of 2002 dt.22-09-2011                             5<\/p>\n<p>                      party claimed their possession over the disputed lands on<\/p>\n<p>                      the basis of redemption of mortgaged as well as on the<\/p>\n<p>                      basis of recent mutation order passed in their favour.<\/p>\n<p id=\"p_28\">                              Both the parties adduced their oral as well as<\/p>\n<p>                      documentary evidence in support of their respective claims<\/p>\n<p>                      before the learned Magistrate. The learned Magistrate has<\/p>\n<p>                      found and declared the possession of the 2nd party over the<\/p>\n<p>                      land in dispute vide order dated 22.04.1988 (Annexure-C<\/p>\n<p>                      to the counter affidavit of the opposite party). The<\/p>\n<p>                      petitioner challenged the aforesaid order dated 22.04.1988<\/p>\n<p>                      passed by the learned Executive Magistrate in Cr. Rev.<\/p>\n<p>                      No.243\/88,        which      was   dismissed   on   30.03.1994<\/p>\n<p>                      confirming the order of the learned Magistrate (Annexure-<\/p>\n<p>                      D to the counter affidavit of the opposite party).<\/p>\n<p>                      Thereafter, the petitioner challenged both the orders of<\/p>\n<p>                      learned Executive Magistrate as well as the learned<\/p>\n<p>                      Additional         Sessions        Judge-V,    Begusarai    in<\/p>\n<p>                      Cr.W.J.C.No.554\/94 before the Patna High Court, which<\/p>\n<p>                      was allowed vide order dated 4.07.1995 and the case was<\/p>\n<p>                      remanded to the learned Magistrate with direction that he<\/p>\n<p>                      will afford an opportunity to the parties to prove their<\/p>\n<p>                      documents and thereafter he will dispose of the proceeding<br \/>\n Patna High Court CR. REV. No.174 of 2002 dt.22-09-2011                              6<\/p>\n<p>                      in accordance with law (Annexure-E to the counter<\/p>\n<p>                      affidavit). The opposite party filed S.L.P. in the Hon&#8217;ble<\/p>\n<p>                      Supreme Court vide S.L.P. (Cr.) No.356\/96, which was<\/p>\n<p>                      later on dismissed (Annexure-G to the counter affidavit).<\/p>\n<p>                      In the meantime, the petitioner filed a petition in Misc.<\/p>\n<p>                      Case No.1523\/81 under <a href=\"\/doc\/1405190\/\" id=\"a_4\">Section 145<\/a> Cr.P.C. before the<\/p>\n<p>                      learned     S.D.M.,       Majhaul,   Begusarai.   The   learned<\/p>\n<p>                      Magistrate passed an order on 23.01.1996 against the<\/p>\n<p>                      opposite party and declared the possession of the petitioner<\/p>\n<p>                      (Annexure-H to the counter affidavit). The opposite party<\/p>\n<p>                      challenged the aforesaid order dated 23.01.1996 vide Cr.<\/p>\n<p>                      Rev. No.14\/97 before the learned Sessions Judge, which<\/p>\n<p>                      was heard and allowed vide order dated 30.07.1999 by the<\/p>\n<p>                      learned Additional Sessions Judge, F.T.C.VII, Begusarai<\/p>\n<p>                      and remanded the case before the learned S.D.M. for<\/p>\n<p>                      disposal in accordance with law. The learned S.D.M.,<\/p>\n<p>                      Majhaul passed the order on 29.01.2001 in favour of the<\/p>\n<p>                      opposite party, which has been challenged in this criminal<\/p>\n<p>                      revision.\n<\/p>\n<p id=\"p_29\">                              Heard the learned counsel for the petitioner and the<\/p>\n<p>                      learned counsel for the opposite party.<\/p>\n<p id=\"p_30\">                              The learned counsel for the petitioner submits that<br \/>\n Patna High Court CR. No.174 of 2002 dt.22-09-2011                          7<\/p>\n<p>                      the learned Magistrate has not considered the oral as well<\/p>\n<p>                      as documentary evidence properly. He has further<\/p>\n<p>                      submitted that in a proceeding under <a href=\"\/doc\/1405190\/\" id=\"a_5\">Section 145<\/a> Cr.P.C. a<\/p>\n<p>                      Magistrate has to peruse the documents and affidavits filed<\/p>\n<p>                      in the case. The word &#8216;perused&#8217; of course means to<\/p>\n<p>                      examine critically.\n<\/p>\n<p id=\"p_31\">                               In support of his contention, he has relied upon a<\/p>\n<p>                      decision in the case of Bhola Kumar and Ors. Vs.<\/p>\n<p>                      Bhubneshwar Singh reported in 1968 BLJR 327.<\/p>\n<p id=\"p_32\">                              The learned counsel for the 2nd party-opposite party<\/p>\n<p>                      has submitted that it is apparent from the impugned order<\/p>\n<p>                      that the learned Magistrate has considered the evidence<\/p>\n<p>                      adduced on behalf of both the parties. The documents have<\/p>\n<p>                      also been exhibited and marked as Exhibits on behalf of<\/p>\n<p>                      both the parties. The 1st party-petitioners have produced<\/p>\n<p>                      nine witnesses and the 2nd party has adduced seven<\/p>\n<p>                      witnesses. The learned Magistrate has considered the oral<\/p>\n<p>                      as well as documentary evidence adduced on behalf of<\/p>\n<p>                      both the parties and has come to the conclusion that the<\/p>\n<p>                      second party opposite party are in possession of the land in<\/p>\n<p>                      dispute and their possession has been declared and it has<\/p>\n<p>                      also been made clear that the order will remain in force<br \/>\n        Patna High Court CR. REV. No.174 of 2002 dt.22-09-2011                          8<\/p>\n<p>                             until any order is passed by any competent court.<\/p>\n<p id=\"p_33\">                                     After hearing the learned counsel for both the<\/p>\n<p>                             parties and on perusal of the record, it appears that the<\/p>\n<p>                             contention of the learned counsel for the 2nd party opposite<\/p>\n<p>                             party is correct. The learned Magistrate has considered the<\/p>\n<p>                             oral as well as documentary evidence adduced on behalf of<\/p>\n<p>                             both the parties and has come to the conclusion that the<\/p>\n<p>                             second party opposite party is in possession of the land in<\/p>\n<p>                             dispute.\n<\/p>\n<p id=\"p_34\">                                     Considering the facts and circumstances stated<\/p>\n<p>                             above, I do not find any ground to interfere with the<\/p>\n<p>                             impugned order.
