It is the case of respondent No.2 herself that about 31 years<br \/>\nbefore, she was driven away from the marital home and she was<br \/>\nresiding with her son   Shri Navinbhai Kantilal Patel at her<br \/>\nparental home at village Kherva; that on 15.01.2006, when she had<br \/>\ngone to Halvad to her relatives&#8217; place for some social work, she<br \/>\nnoticed an invitation card which was of applicant No.1, stating<br \/>\ntherein that marriage of son of Pushpaben and Kantilal Jadvjibhai<br \/>\nPatel   applicants herein is scheduled on 19.01.2006.  Therefore,<br \/>\ncomplaint was filed under <a href=\"\/doc\/508426\/\" id=\"a_2\">Sections 494<\/a>, <a href=\"\/doc\/538436\/\" id=\"a_3\">498-A<\/a> and <a href=\"\/doc\/112749\/\" id=\"a_4\">114<\/a> of the Indian<br \/>\nPenal Code.\n<\/p>\n<p id=\"p_3\">3.\tThe<br \/>\nlearned advocate for the applicants submitted that in the year 1977,<br \/>\nrespondent No.2 had filed maintenance application, stating there in<br \/>\nthat applicant No.1 and applicant No.2 had married and were living as<br \/>\nhusband and wife; that in the year 1986, respondent No.2 filed<br \/>\nenhancement application, seeking increase in the maintenance amount,<br \/>\ntherein also, it was stated that applicant No.1 had married to<br \/>\napplicant No.2 and they have three children.  Again in the year 1998,<br \/>\nrespondent No.2 filed enhancement application, again stating the<br \/>\nabove facts.  Not only that, in the year 1987, respondent No.2 filed<br \/>\na criminal complaint against the present applicants, alleging this<br \/>\nvery offence\/s in which the applicants were acquitted.\n<\/p>\n<p id=\"p_4\">\tOn<br \/>\nthe face of it, respondent No.2   original complainant has not<br \/>\nstated anything about the material except the invitation card, on the<br \/>\nbasis of which she drew conclusion that applicant Nos.1 and 2 are<br \/>\nmarried to each other.  The fact that respondent No.2 had filed<br \/>\nvarious applications and also a complaint against the applicants,<br \/>\ngoes to show that the complaint in question is not a bonafide one and<br \/>\nthe same is filed only with a view to harass the applicants.\n<\/p>\n<p id=\"p_5\">4.\tIn<br \/>\nthe result, the application is allowed.  The complaint being Inquiry<br \/>\nCase No.1 of 2006 pending in the Court of learned Judicial<br \/>\nMagistrate, Halvad and complaint being M.Case No.1 of 2006 registered<br \/>\nbefore Halvad Police Station are quashed and set aside.
