P.\n                                    ---\n3. 5.9.2011<\/pre>\n<p id=\"p_1\">:     This application for grant of anticipatory bail in connection<br \/>\n            with Chainpur P.S. Case No. 211 of 2010 corresponding to G.R.<br \/>\n            Case     No.   2345     of   2010    registered    under    <a href=\"\/doc\/695990\/\" id=\"a_1\">Sections<br \/>\n            364<\/a>\/<a href=\"\/doc\/1560742\/\" id=\"a_1\">302<\/a>\/<a href=\"\/doc\/1133601\/\" id=\"a_2\">325<\/a>\/<a href=\"\/doc\/555306\/\" id=\"a_3\">504<\/a>\/<a href=\"\/doc\/386021\/\" id=\"a_4\">201<\/a> and <a href=\"\/doc\/1897847\/\" id=\"a_5\">120B<\/a> I.P.C., pending in the court of<br \/>\n            Chief Judicial Magistrate, Palamau at Daltonganj, has been filed<br \/>\n            on behalf of petitioners, named above.\n<\/p>\n<p id=\"p_1\">                   It reveals from the complaint that all the accused persons<br \/>\n            reached to the house of the complainant on a Commandar Jeep<br \/>\n            and on the pretext that daughter-in-law of the informant is lying ill,<br \/>\n            took Jalaluddin with them who is the husband of accused<br \/>\n            Hashbur Khatoon. When the informant tried to know whereabouts<br \/>\n            of the son Jalauddin, he could learn that he is traceless and he<br \/>\n            has not gone to Mumbai. When the informant went to the house<br \/>\n            of accused persons he was assaulted and sustained fracture<br \/>\n            injury on his hand.\n<\/p>\n<p id=\"p_2\">                   It is submitted that Hashbun Khaton who is daughter-in-law<br \/>\n            of the present informant, has lodged a case against the informant<br \/>\n            and his son and other relatives under <a href=\"\/doc\/538436\/\" id=\"a_6\">Section 498A<\/a> I.P.C. The<br \/>\n            informant has lodged this case after delay of 7 months only to<br \/>\n            create pressure against his daughter-in-law to withdraw the case.<br \/>\n            No such incident, as disclosed in the F.I.R., has ever taken place.\n<\/p>\n<p id=\"p_3\">                   Learned counsels appearing for the State as well as the<br \/>\n            informant have opposed the prayer and submitted that the<br \/>\n            witnesses examined in paragraphs 9, 10, 11, 13, 14 and 15 of the<br \/>\n            case diary have supported the prosecution case.\n<\/p>\n<p id=\"p_4\">                   I have gone through the F.I.R., the case diary and the<br \/>\n      documents placed before me. It is apparent that relation between<br \/>\n     two families was not cordial and Jalaluddin (son of the informant)<br \/>\n     was living in her in-laws&#8217; house and he was insisted to sell his<br \/>\n     land and bring money. Since the son of the informant is still<br \/>\n     traceless and there is direct allegation against these petitioners<br \/>\n     that they had forcibly taken the victim with them, I do not find this<br \/>\n     case is fit to be considered under <a href=\"\/doc\/1783708\/\" id=\"a_7\">Section 438<\/a> Cr.P.C.<br \/>\n     Accordingly, the prayer for anticipatory bail stands rejected.\n<\/p>\n<p id=\"p_5\">                                                  (D.N.
