Justice K.T.SANKARAN\n\n Dated :28\/10\/2010\n\n O R D E R\n                 K.T.SANKARAN, J.\n          ------------------------------\n             W.P.(C).No.32690 OF 2010\n          ------------------------------\n      Dated this the 28th day of October, 2010\n\n\n\n\n                     JUDGMENT\n<\/pre>\n<p id=\"p_1\">    The petitioner is working as HSA in Narokkav<\/p>\n<p>High School, Edakkara, Malappuram District under<\/p>\n<p>the management of the first respondent.       It is<\/p>\n<p>stated that the petitioner has secured B.Sc. and<\/p>\n<p>B.Ed.  qualifications    from  the   University   of<\/p>\n<p>Calicut.  He  passed  M.Sc.   in  Mathematics   from<\/p>\n<p>Vinayaka Mission University in Tamil Nadu in the<\/p>\n<p>year  2009  under   Distance   Education   Programme<\/p>\n<p>conducted by that University.  It is stated that in<\/p>\n<p>all States  except  Kerala, the Degree conferred by<\/p>\n<p>Vinayaka   Mission   University    is    recognized.<\/p>\n<p>However, the petitioner got information that the<\/p>\n<p>University of Calicut did not recognize the Degrees<\/p>\n<p>conferred  by    Vinayaka   Mission  University   on<\/p>\n<p>Distance Education Programme, as equivalent to the<\/p>\n<p>Degree of the University of Calicut.<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">W.P.(C).No.32690 OF 2010  2<\/span><\/p>\n<p id=\"p_1\">    2.    The    petitioner apprehends  that   when<\/p>\n<p>vacancies of Higher Secondary School Teachers arise<\/p>\n<p>on sanctioning the same, he may not be considered<\/p>\n<p>for  appointment     on the ground that  the  Post-<\/p>\n<p>Graduate Degree secured by him was not on the basis<\/p>\n<p>of a regular course of study. The petitioner relies<\/p>\n<p>on Ext.P1 circular issued by the Kerala Public<\/p>\n<p>Service Commission in the year 2005 stating that<\/p>\n<p>for appointment to all posts including posts of<\/p>\n<p>teachers,    qualification  acquired  on   Distance<\/p>\n<p>Education could be recognized.\n<\/p>\n<p id=\"p_2\">\n<p id=\"p_3\">    3. Sri.P.C.Sasidharan, learned Standing Counsel<\/p>\n<p>appearing for the Calicut University submitted that<\/p>\n<p>the Degree conferred by Vinayaka Mission University<\/p>\n<p>on the basis of Distance Education Programme is not<\/p>\n<p>recognized by Calicut University.<\/p>\n<p id=\"p_4\">    4. After having heard the   learned counsel for<\/p>\n<p>the petitioner and the learned Standing Counsel<\/p>\n<p>appearing for the University, I am of the view that<\/p>\n<p>the Writ Petition is anticipatory in nature.     At<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">W.P.(C).No.32690 OF 2010  3<\/span><\/p>\n<p>present, there is no occasion for considering the<\/p>\n<p>question whether the petitioner is qualified to be<\/p>\n<p>appointed    as   Higher Secondary School  Teacher.<\/p>\n<p>Secondly, if the petitioner is aggrieved by non<\/p>\n<p>consideration for appointment by the Manager, he<\/p>\n<p>has an effective alternative remedy to approach the<\/p>\n<p>educational authorities or the Government as the<\/p>\n<p>case may be, as per the provisions of Chapter XXXII<\/p>\n<p>of the Kerala Education Rules.\n<\/p>\n<p id=\"p_5\">\n<p>    In the facts and circumstances mentioned above,<\/p>\n<p>I do not think it is necessary to entertain the<\/p>\n<p>Writ Petition at this stage.
