Justice S.SIRI JAGAN\n\n Dated :21\/08\/2008\n\n O R D E R\n                         S.SIRI JAGAN, J.\n\n                  ==================\n\n                    W.P.(C).No.4614 of 2008\n\n                  ==================\n\n             Dated this the 21st day of August, 2008\n\n                         J U D G M E N T\n<\/pre>\n<p id=\"p_1\">     The petitioner has executed certain works on behalf of the<\/p>\n<p>Kerala State Electricity Board. Although the work has been<\/p>\n<p>completed and the project dedicated to the nation on<\/p>\n<p>16.12.2005, the amount due to the petitioner for the work has<\/p>\n<p>not been paid yet. At the same time, the petitioner is called upon<\/p>\n<p>to go on renewing the bank guarantee in lieu of retention money<\/p>\n<p>towards guarantee for satisfactory completion of the work.<\/p>\n<p>According   to   the  petitioner,  this  is  totally  unjust   and<\/p>\n<p>unreasonable in so far as after dedicating the work to the nation<\/p>\n<p>on 16.12.2005, the respondents cannot have any grievance<\/p>\n<p>regarding satisfactory completion of the work. The petitioner also<\/p>\n<p>refers to Ext.P4, wherein the KSEB themselves have certified that<\/p>\n<p>the work undertaken by the petitioner has been successfully<\/p>\n<p>completed to their satisfaction and the project is under operation.<\/p>\n<p>On 8.2.2008, while admitting the writ petition, a stay was<\/p>\n<p>granted on condition that the bank guarantee mentioned in<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">w.p.c.4614\/08                     2<\/span><\/p>\n<p>Ext.P6 would be kept alive by the petitioner.       The same was<\/p>\n<p>extended till 31.8.2008. According to the petitioner, the<\/p>\n<p>respondents are now insisting on further extending the bank<\/p>\n<p>guarantee simply on the ground that they are yet to finalise the<\/p>\n<p>bills.\n<\/p>\n<p id=\"p_1\">      2.     The learned Standing Counsel appearing for the<\/p>\n<p>Electricity Board, on instructions, submits that the matter would<\/p>\n<p>be finalised within one month. Although I find considerable merit<\/p>\n<p>in the contentions of the petitioner, I dispose of this writ petition<\/p>\n<p>with a direction to the petitioner to renew the bank guarantee for<\/p>\n<p>one more month from 31.8.2008. The respondents shall finalise<\/p>\n<p>the bills for the work within that period.
