Singh<br \/>\n                    Mr. S.K.Pandey<br \/>\nFor the respondents : Mr. J.P.Karn, AAG 9\n<\/p>\n<p id=\"p_1\">                                 &#8212;\n<\/p>\n<p id=\"p_2\">                             PRESENT<\/p>\n<p>                      Hon&#8217;ble the Chief Justice<br \/>\n                                 And<br \/>\n                   Hon&#8217;ble Mr. Justice Barin Ghosh\n<\/p>\n<p id=\"p_3\">                                  &#8212;\n<\/p>\n<p id=\"p_4\">Dated, the      11th July, 2008<\/p>\n<p>              The counsel for the petitioner prays for withdrawal of<\/p>\n<p>this writ petition with liberty to the petitioner to approach the State<\/p>\n<p>Government for redressal      of   the grievance, particularly,   with<\/p>\n<p>regard to the anomalies in the rate of additional tax between the<\/p>\n<p>owners of motor vehicles       having 205&#8243; wheel base       and those<\/p>\n<p>between 114&#8243; -167&#8243; wheel base during the period 16th July, 2002 to<\/p>\n<p>17th April, 2006 and other incidental reliefs.<\/p>\n<p id=\"p_5\">2.           Our attention has been invited to the order passed by this<\/p>\n<p>court in group of writ petitions being CWJC. No. 16260 of 2007;<\/p>\n<p><a href=\"\/doc\/911874\/\" id=\"a_1\">Ram Pravesh Singh vs. The State of Bihar &amp; Ors<\/a>., and other cases<\/p>\n<p>passed on 4th March, 2008. The said order reads thus:<\/p>\n<blockquote id=\"blockquote_1\"><p>      &#8220;After we have heard the matter for some time, Mr. Ram<br \/>\n      Balak Mahto, senior advocate, Mr. Badri Narayan Singh,<br \/>\n      Mr. Uma Kant Shukla and other counsels representing the<br \/>\n      petitioners seek permission to withdraw the writ<br \/>\n      applications with liberty to the petitioners to seek redressal<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                    2<\/span><\/p>\n<p>      of their grievances before the State Government pointing<br \/>\n      out the anomalies in the rate of additional tax between the<br \/>\n      owners of the motor vehicles having 205&#8243; wheel base and<br \/>\n      those of between 114&#8243; &#8211; 167&#8243; wheel base during the period<br \/>\n      16th July, 2002 to 17th April, 2006 resulting from<br \/>\n      enactment       of Bihar       Motor Vehicles      Taxation<br \/>\n      (Amendment) Act, 2002 <a href=\"\/doc\/1054471\/\" id=\"a_1\">(Bihar Act<\/a> 6 of 2003). Further<br \/>\n      liberty sought for is to pray before the State Government<br \/>\n      to provide the benefits as given by notifications No.2518<br \/>\n      and 2520 dated 1.7.2004 with retrospective effect as also<br \/>\n      for waiver of the penalty in case it is held that they are<br \/>\n      liable to pay the additional tax.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>      Needless to state that in case such prayers are made to the<br \/>\n      State Government within six weeks, it shall consider the<br \/>\n      same in accordance with law within six months from today.<br \/>\n      Till the decision on the representations          is taken,<br \/>\n      petitioners, as directed by the interim order dated<br \/>\n      31.1.2008, shall pay road tax at the rate of Rs.267\/- per<br \/>\n      seat per quarter without any penalty for the period between<br \/>\n      16.7.2002 and 17.4.2006.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>      On payment of tax and additional tax, as aforesaid, tax<br \/>\n      token shall be issued to the petitioners.<br \/>\n      All the writ applications are permitted to be withdrawn<br \/>\n      with liberty aforesaid.&#8221;\n<\/p><\/blockquote>\n<p id=\"p_6\">3.         For the self-same reasons as afore noticed, this writ<\/p>\n<p>petition is allowed to be withdrawn with liberty as prayed.<\/p>\n<p id=\"p_7\">4.           Needless        to        say that until the decision on the<\/p>\n<p>representation,   the petitioner shall pay road tax       at the rate of<\/p>\n<p>Rs. 267\/- per seat per quarter without any penalty for the period<\/p>\n<p>between 16.7.2002 and 17.4.2006.<\/p>\n<p id=\"p_8\">5.         We order accordingly.\n<\/p>\n<p id=\"p_9\">\n<p id=\"p_10\">                               R.M.
