Learned Advocate Mr.<br \/>\n\tDA Joshi for petitioners submitted that the petitioners seek to<br \/>\n\tchallenge arbitrary action of taking decision by the respondent<br \/>\n\tUniversity for de-registering the petitioners in Doctorate (Ph.D.)<br \/>\n\tCourse and to issue appropriate writ, order or directions directing<br \/>\n\trespondent authorities to continue the registration and admissions<br \/>\n\tof petitioners in Doctorate (Ph.D.) Course in the University.<br \/>\n\tAccording to petitioners, they have been registered in Ph.D. Course<br \/>\n\twith the respondent university. They have paid their respective fees<br \/>\n\ttowards the registration of their admission. Their registration has<br \/>\n\tbeen secured by respondent NO.3   Reader of the University. It is<br \/>\n\tsubmitted that the respondent university is following the terms and<br \/>\n\tconditions and guidelines issued by the UGC. According to<br \/>\n\tpetitioners, University has prepared a Ph. D. Ordinance. It is<br \/>\n\tsubmitted that petitioner no.1 had deposited his registration fees<br \/>\n\tin first term i.e. on or before 31st August, 2008. Rest<br \/>\n\tof petitioners have deposited their registration  fees in second<br \/>\n\tterm i.e. on or before 31st January, 2009. It is<br \/>\n\tsubmitted that on 30.12.2009, letter issued by respondent university<br \/>\n\talong with Demand Draft of amount of Rs.500.00 was received by<br \/>\n\tpetitioners stating that  as per the new rules prepared by UGC,<br \/>\n\tall the procedure of admission of all the students have been stopped<br \/>\n\tand, therefore, your registration fees are not accepted.  According<br \/>\n\tto petitioners, petitioner no.1 had registered in the first term in<br \/>\n\tthe academic year of 2008-2009 and petitioner nos.2 to 4 had<br \/>\n\tregistered in the second term in the academic year of 2008-2009, and<br \/>\n\talso deposited synopsis of the course before the last date for<br \/>\n\tsubmission of the same. Petitioner Nos.2 to 4 had registered in the<br \/>\n\tsecond term in the academic year of 2008-2009. Petitioner Nos. 2 to<br \/>\n\t4 had also deposited their registration fees on or before 31st<br \/>\n\tJanuary, 2009 and also deposited synopsis of the course before the<br \/>\n\tlast date for submission of the same. Petitioners have not received<br \/>\n\tTitle Clearance Certificate from the University till December, 2009.<br \/>\n\tPetitioner No.2 wrote a letter to University narrating the facts<br \/>\n\tthat the students of the university who have submitted synopsis in<br \/>\n\tthe term of November, 2008 have got title clearance certificate from<br \/>\n\tthe respective universities. Petitioner no.2 has not got<br \/>\n\tcertificate, therefore, requested for the same urgently on<br \/>\n\t16.12.2009 and pointed out the discrimination amongst students those<br \/>\n\twho have submitted registration form in July, 2009 and synopsis have<br \/>\n\talso been submitted, their title clearance has been made in<br \/>\n\tDecember, 2009. Learned Advocate Mr. Joshi also showed list of such<br \/>\n\tstudents, those who have been cleared by respondent university.\n<\/p>\n<p id=\"p_1\">In<br \/>\n\tview of the aforesaid facts, let petitioner may approach to<br \/>\n\trespondent university and point out facts that students those who<br \/>\n\thave submitted registration form duly filled up in July, 2009 and<br \/>\n\tsynopsis have also been supplied, such students have received title<br \/>\n\tclearance in December, 2009 and comparing to those students,<br \/>\n\tpetitioners have filled up registration form and also supplied<br \/>\n\tsynopsis in November, 2008 and yet, their title clearance has not<br \/>\n\tbeen made by respondent university. Therefore, let such<br \/>\n\trepresentation is to be made by petitioners within period of ten<br \/>\n\tdays from date of receiving copy of present order.\n<\/p>\n<p id=\"p_2\">After<br \/>\n\treceiving such representation from petitioners, it is directed to<br \/>\n\tVice Chancellor Dr. Kiran K. Shah, Hemchandracharya North Gujarat<br \/>\n\tUniversity, Patan (North Gujarat) to consider such representation<br \/>\n\tmade by petitioner and also examine grievance of petitioner that<br \/>\n\tstudents those who have submitted registration form and synopsis<br \/>\n\tsubsequent to petitioners, their title clearance has been made but<br \/>\n\tin respect to petitioners, that has not been given.
