Usha Devi And Another\nRespondent :- State Of U.P.And Another\nPetitioner Counsel :- T.K.Mishra,Mahesh Kumar Tripathi\nRespondent Counsel :- Govt Advocate\n\nHon'ble Rajesh Dayal Khare,J.\n<\/pre>\n<p id=\"p_1\">Heard learned counsel for the applicants and the learned<br \/>\nAGA for the State.\n<\/p>\n<p id=\"p_1\">The present 482, <a href=\"\/doc\/445276\/\" id=\"a_1\">Cr.P.C<\/a>. application has been filed for<br \/>\nquashing the proceedings of Complaint Case No. 74 of 2009<br \/>\n(Usha &amp; another v Nirmala) under <a href=\"\/doc\/329571\/\" id=\"a_1\">Sections 392<\/a>, <a href=\"\/doc\/838469\/\" id=\"a_2\">452<\/a> and<br \/>\n<a href=\"\/doc\/555306\/\" id=\"a_3\">504<\/a> IPC, PS Prem Nagar, District Jhansi pending before the<br \/>\nAdditional Sessions Judge\/Special Judge D.P. Area, Jhansi<br \/>\nalso for quashing of the summoning order dated 24.X.2009.<br \/>\nIt is said that the present prosecution against the applicant is<br \/>\na counter blast to the proceedings initiated against opposite<br \/>\nparty no. 2, copy of which has been annexed as annexure<br \/>\nno. 1 to the accompanying affidavit, which is nothing but<br \/>\ngross misuse of the Court.\n<\/p>\n<p id=\"p_2\">From the perusal of the material on record and looking into<br \/>\nthe facts of the case at this stage it cannot be said that no<br \/>\noffense is made out against the applicants. All the<br \/>\nsubmission made at the bar relates to the disputed question<br \/>\nof fact, which cannot be adjudicated upon by this Court<br \/>\nunder <a href=\"\/doc\/1679850\/\" id=\"a_4\">Section 482<\/a> Cr.P.C. At this stage only prima facie<br \/>\ncase is to be seen in the light of the law laid down by<br \/>\nSupreme Court in cases of R.P. Kapur Vs. State of Punjab,<br \/>\nA.I.R. 1960 S.C. 866, State of Haryana Vs. Bhajan Lal,<br \/>\n1992 SCC (Cr.) 426, State of Bihar Vs. P.P.Sharma, 1992<br \/>\nSCC (Cr.) 192 and lastly Zandu Pharmaceutical Works Ltd.<br \/>\nVs. Mohd. Saraful Haq and another (Para-10) 2005 SCC<br \/>\n(Cr.) 283. The disputed defence of the accused cannot be<br \/>\n considered at this stage. Moreover, the applicants have got<br \/>\nright of discharge under <a href=\"\/doc\/1572967\/\" id=\"a_5\">Section 239<\/a> or 227\/228 <a href=\"\/doc\/445276\/\" id=\"a_6\">Cr.P.C<\/a>. as<br \/>\nthe case may through a proper application for the said<br \/>\npurpose and they are free to take all the submissions in the<br \/>\nsaid discharge application before the Trial Court.\n<\/p>\n<p id=\"p_3\">The prayer for quashing the aforesaid proceedings and<br \/>\nquashing of summoning order of the aforesaid case is<br \/>\nrefused.\n<\/p>\n<p id=\"p_4\">However, it is directed that the applicants shall appear and<br \/>\nsurrender before the court below within 30 days from today<br \/>\nand apply for bail, their prayer for bail shall be considered<br \/>\nand decided in view of the settled law laid by this Court in<br \/>\nthe case of Amrawati and another Vs. State of U.P.<br \/>\nreported in 2004 (57) ALR 290 as well as judgement passed<br \/>\nby Hon&#8217;ble Apex Court reported in 2009 (3) ADJ 322 (SC)<br \/>\nLal Kamlendra Pratap Singh Vs. State of U.P. For a period<br \/>\nof 30 days from today or till the disposal of the application for<br \/>\ngrant of bail whichever is earlier, no coercive action shall be<br \/>\ntaken against the applicants.
