The<\/p>\n<p>prayer in this petition filed under <a href=\"\/doc\/1679850\/\" id=\"a_1\">Section 482<\/a> of Cr.P.C. is to<\/p>\n<p>quash Annexure-II complaint in C.C.No.1241\/04.\n<\/p>\n<p id=\"p_1\">      2.    The statement of facts alleged in this petition are as<\/p>\n<p>follows:\n<\/p>\n<p id=\"p_2\">C.C.No.1241\/04 is pending before the Court of J.F.C.M.-I,<\/p>\n<p>Hosdurg and it was instituted on the basis of a complaint filed by<\/p>\n<p>the first respondent on 21.8.2003 alleging offence under <a href=\"\/doc\/538436\/\" id=\"a_1\">Section<\/p>\n<p>498A<\/a> IPC, copy of which is produced as Annexure-II. The learned<\/p>\n<p>Magistrate recorded the sworn statement of the complainant and<\/p>\n<p>took cognizance of the case against the petitioner as the sole<\/p>\n<p>accused. It is further alleged in this petition that Annexure II<\/p>\n<p>complaint filed against the petitioner herein by the first<\/p>\n<p>respondent is not sustainable for the reason that an earlier<\/p>\n<p>complaint has been filed by the first respondent against her<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">CRL.M.C.No.3844\/05                     -2-<\/span><\/p>\n<p>divorced husband and the petitioner herein, who is the sister-in-law of<\/p>\n<p>the first respondent alleging offence under <a href=\"\/doc\/538436\/\" id=\"a_2\">Section 498A<\/a> IPC, copy of<\/p>\n<p>which is produced as Annexure-I.          That complaint was filed on<\/p>\n<p>28.2.2001 relating to the incident of the year 1999. That complaint<\/p>\n<p>was sent by the learned Magistrate for investigation under <a href=\"\/doc\/833310\/\" id=\"a_3\">Section 156<\/a><\/p>\n<p>(3) <a href=\"\/doc\/445276\/\" id=\"a_4\">Cr.P.C<\/a>. and the police after investigation filed the final report<\/p>\n<p>against the divorced husband only and the petitioner herein was<\/p>\n<p>deleted from the array of the accused as revealed from Annexure-I<\/p>\n<p>complaint.    The learned Magistrate on receipt of that refer report<\/p>\n<p>proceeded against the divorced husband of the first respondent alone<\/p>\n<p>as C.C.No.316\/01.        Subsequently, on 21.8.2003, the present<\/p>\n<p>complaint, which is challenged in this petition, has been filed by the<\/p>\n<p>first respondent, which according to the petitioner, is barred by<\/p>\n<p>limitation. Hence this petition is filed to quash Annexure II complaint<\/p>\n<p>and all further proceedings against the petitioner in C.C.No.1241\/04.<\/p>\n<p id=\"p_3\">      3.    Heard the learned counsel appearing for the petitioner and<\/p>\n<p>the first respondent.\n<\/p>\n<p id=\"p_4\">      4.    The relationship between the parties is admitted. According<\/p>\n<p>to the learned counsel appearing for the petitioner, in pursuance of<\/p>\n<p>Annexure I complaint filed on 28.2.2001 against the petitioner also by<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">CRL.M.C.No.3844\/05                     -3-<\/span><\/p>\n<p>the complainant, the first respondent, the police had investigated the<\/p>\n<p>case under <a href=\"\/doc\/99487\/\" id=\"a_5\">Section 156(3)<\/a> of Cr.P.C. and filed the final report against<\/p>\n<p>the divorced husband alone of the complainant and the petitioner<\/p>\n<p>herein who is the sister-in-law of the complainant was deleted from the<\/p>\n<p>array of the accused. On receipt of that refer report, the learned<\/p>\n<p>Magistrate proceeded the case against the divorced husband alone as<\/p>\n<p>C.C.No.316\/01. It is also submitted by the learned counsel that the<\/p>\n<p>trial of that case was completed and judgment has been pronounced<\/p>\n<p>by the learned Magistrate acquitting the accused in that case\/the<\/p>\n<p>divorced husband of the first respondent herein.\n<\/p>\n<p id=\"p_5\">      5.   It is submitted by the learned counsel for the first<\/p>\n<p>respondent that though the case against the husband of the first<\/p>\n<p>respondent was ended in acquittal, it cannot be taken as a ground to<\/p>\n<p>quash the present complaint, which was preferred by the first<\/p>\n<p>respondent, as she was dissatisfied with the refer report filed by the<\/p>\n<p>police in respect of the earlier complaint preferred by her against the<\/p>\n<p>petitioner also. Copy of the second complaint preferred by the first<\/p>\n<p>respondent is produced along with this petition as Annexure-II,<\/p>\n<p>wherein it is complained that specific instances were there regarding<\/p>\n<p>the torture made by the petitioner herein against the first respondent<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">CRL.M.C.No.3844\/05                    -4-<\/span><\/p>\n<p>and that she has not received copy of the refer report.        For that<\/p>\n<p>reason, a second complaint has been filed on 21.8.2003.        It is also<\/p>\n<p>submitted by the learned counsel that the learned Magistrate took<\/p>\n<p>cognizance of the case as C.C.No.1241\/04 only after recording the<\/p>\n<p>sworn statement of the complainant and satisfied that sufficient<\/p>\n<p>ingredients are there to attract the offence under <a href=\"\/doc\/538436\/\" id=\"a_6\">Section 498A<\/a> of IPC<\/p>\n<p>against the petitioner herein, which cannot be quashed at this stage.<\/p>\n<p id=\"p_6\">      6.    On a perusal of the allegations in this petition and also on<\/p>\n<p>hearing the argument advanced by both counsel and on a perusal of<\/p>\n<p>the documents produced herein, it is evident that the case of the first<\/p>\n<p>respondent in the second complaint is that she has not received notice<\/p>\n<p>of the refer report and for that reason she has preferred a second<\/p>\n<p>complaint against the petitioner herein which was taken cognizance by<\/p>\n<p>the learned Magistrate and is pending as C.C.No.1241\/04. Whether<\/p>\n<p>sufficient ingredients are there to attract the offence under <a href=\"\/doc\/538436\/\" id=\"a_7\">Section<\/p>\n<p>498A<\/a> of IPC against the petitioner herein will be decided by the learned<\/p>\n<p>Magistrate after considering the evidence to be adduced on the side of<\/p>\n<p>the prosecution and evidence on the defence side if any.             The<\/p>\n<p>petitioner&#8217;s case that there are no chance to convict the petitioner<\/p>\n<p>even after adducing evidence, cannot be taken as a ground to quash<\/p>\n<p><span class=\"hidden_text\" id=\"span_3\">CRL.M.C.No.3844\/05                      -5-<\/span><\/p>\n<p>the proceedings under <a href=\"\/doc\/1679850\/\" id=\"a_8\">Section 482<\/a> of Cr.P.C. The ground that the<\/p>\n<p>divorced husband against whom very nature of the complaint with the<\/p>\n<p>same facts were stated by the first respondent in the earlier complaint,<\/p>\n<p>Annexure-I and was acquitted after trial cannot also be taken into<\/p>\n<p>consideration to allow this petition. Considering these aspects and the<\/p>\n<p>facts of the case which is in dispute, I find that there is no sufficient<\/p>\n<p>ground to invoke the inherent jurisdiction of this Court under <a href=\"\/doc\/1679850\/\" id=\"a_9\">Section<\/p>\n<p>482<\/a>    of Cr.P.C. which has to be exercised only sparingly and with<\/p>\n<p>caution and that too to meet the ends of justice. Hence I find that this<\/p>\n<p>petition is devoid of merits and is liable to be dismissed.<\/p>\n<p id=\"p_7\">      In the result the Crl.M.C. is dismissed.
