Learned Assistant<br \/>\nGovernment Pleader Ms. Manisha Narsinghani places on record  order of<br \/>\nappointment issued by respondent No.3 dated 19.10.2010  bearing No.<br \/>\nEsta\/Visyo\/375\/2010-2011.  With issuance of this appointment order,<br \/>\nthe grievance of the petitioner stands redressed, except on one<br \/>\npoint, i.e. the appointment order was to be given as set out in<br \/>\nCircular dated 3.4.2008 bearing No.Prashini\/K\/08\/3195-3244, on or<br \/>\nbefore 20.4.2008.\n<\/p>\n<p id=\"p_2\">1.1.\t\tLearned<br \/>\nadvocate for the petitioner submitted that the petitioner approached<br \/>\nthis Court immediately, i.e. on 11.11.2008, and Rule was issued, as<br \/>\nreferred to hereinabove, on 19.12.2008 and therefore, the order which<br \/>\nis issued on 19.10.2010,  should be directed to be dated &#8216;20.4.2008&#8217;.<br \/>\nHe candidly submitted that it will not be proper on the part of the<br \/>\npetitioner to insist for financial benefits from the retrospective<br \/>\ndate, i.e. 20.4.2008, but it will be legitimate on the part of the<br \/>\npetitioner to ask for seniority, which is going to have everlasting<br \/>\neffect on her career.\n<\/p>\n<p id=\"p_3\">2.\tThe<br \/>\nsubmission of the learned advocate for the petitioner is found<br \/>\nreasonable  and in light of the fact that it could not be dislodged<br \/>\nby the learned advocate appearing for the contesting respondents, the<br \/>\npetition is allowed with a direction that order dated &#8216;19.10.2010&#8217; be<br \/>\nread as order dated &#8216;20.4.2008&#8217;  for all other purposes, except<br \/>\nactual payment of salary.\n<\/p>\n<p id=\"p_4\">2.1.\t\tWith<br \/>\nthe aforesaid direction(s),the petition is allowed. Rule is made<br \/>\nabsolute.
