The<br \/>\n\tpetitioner shall submit reply within four weeks. The Deputy<br \/>\n\tCollector shall decided the matter afresh after giving opportunity<br \/>\n\tof hearing to the petitioner in accordance with law.\n<\/p>\n<p id=\"p_8\">Ms.\n<\/p>\n<p id=\"p_9\">\tKotecha learned AGP submitted that the reference may be made to the<br \/>\n\tstatement made in the proceedings of Special Civil Application No.<br \/>\n\t3926 of 2006 and allied matter.\n<\/p>\n<p id=\"p_10\">It<br \/>\n\tis hardly required to be clarified that when the order is quashed,<br \/>\n\tthere shall not be any recovery until afresh order is passed by the<br \/>\n\tDeputy Collector. In the event, if petitioner aggrieved by a fresh<br \/>\n\torder, which may be passed by the Deputy Collector, the petitioner<br \/>\n\tmay resort to remedy as may be permissible in law.\n<\/p>\n<p id=\"p_11\">The<br \/>\n\tpetition is allowed to the aforesaid extent.
