JUSTICE KISHORE KUMAR MANDAL)<\/p>\n<p>5   09-11-2011             No body appears on behalf of the petitioner. Mrs. Binita<\/p>\n<p>                 Singh on behalf of Patna Municipal Corporation (for short &#8221; the<\/p>\n<p>                 Corporation&#8221;) is present.\n<\/p>\n<p id=\"p_1\">                           A counter affidavit has been filed on behalf of the<\/p>\n<p>                 Corporation.\n<\/p>\n<p id=\"p_2\">                           Petitioner has filed the present writ petition seeking a<\/p>\n<p>                 direction upon the respondent Corporation to pay him the scale of<\/p>\n<p>                 pay admissible to the post of Assistant. Admittedly, petitioner was<\/p>\n<p>                 initially engaged as Mali on daily wage basis. He was, however,<\/p>\n<p>                 permitted to discharge duties of Routine Clerk. Petitioner earlier<\/p>\n<p>                 approached this Court in C.W.J.C. No. 11776 of 2000 raising<br \/>\n<span class=\"hidden_text\" id=\"span_1\">       Patna High Court CWJC No.1167 of 2007 (5) dt.09-11-2011<\/span><br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                                 2<\/span><\/p>\n<p>                   identical grievance. This Court by order dated 22.11.2000<\/p>\n<p>                   disposed of the writ petition directing the petitioner to file<\/p>\n<p>                   representation which was to be considered and disposed of by the<\/p>\n<p>                   authorities of the Corporation by a reasoned order. Accordingly,<\/p>\n<p>                   the petitioner made representation which was considered and the<\/p>\n<p>                   claim was rejected by order dated 25.7.2003 and duly<\/p>\n<p>                   communicated to the petitioner vide Memo No. 1134             dated<\/p>\n<p>                   31.7.2003 (Annexure-A). Relevant facts in this regard have been<\/p>\n<p>                   stated in paragraph 9 of the counter affidavit. It also appears from<\/p>\n<p>                   perusal of the counter affidavit that the minimum of the basic pay<\/p>\n<p>                   of the post of Routine Clerk for the period the petitioner actually<\/p>\n<p>                   discharged the duty has been paid. The said order (Annexure-A) is<\/p>\n<p>                   not under challenge.\n<\/p>\n<p id=\"p_3\">                             This Court on consideration of pleadings on record and<\/p>\n<p>                   after hearing learned counsel for the respondent Corporation finds<\/p>\n<p>                   no merit in the application.\n<\/p>\n<p id=\"p_4\">                             It is accordingly dismissed.\n<\/p>\n<p id=\"p_5\">\n<p id=\"p_6\">                                             (Kishore K.
