Writ petition was preferred seeking a<br \/>\n        writ  of  mandamus  directing  the  respondents  not   to<br \/>\n        prohibit  or  disallow the manufacture, sale, stocking or<br \/>\n        exhibition of the products  called  &#8220;Spirulina&#8221;,  natural<br \/>\n        betacarotene and multinal by the petitioners and also for<br \/>\n        a  mandamus  directing respondents not to proceed against<br \/>\n        the petitioners on the basis of  Ext.P1  mahazar  pending<br \/>\n        disposal of  the original petition.  Learned single Judge<br \/>\n        disposed  of  the  writ  petition  on  27th  March,  2002<br \/>\n        directing   first  respondent  to  send  samples  to  the<br \/>\n        Government Laboratory.  Counter affidavit has been  filed<br \/>\n        by   the  Government  Pleader  producing  report  of  the<br \/>\n        Government Analyst.   Operative  portion  of  the  report<br \/>\n        reads as follows:\n<\/p>\n<p id=\"p_5\">.SP 1<br \/>\n         &#8220;As  perusing  the  label  details of the above 3@@<br \/>\n        i<br \/>\n                date expired items it is noticed  that  they  are<br \/>\n                dietary supplements  and  not  drugs.   No active<br \/>\n                ingredient is specified on the  label.    Certain<br \/>\n                food   products  have  ingredients  which  posses<br \/>\n                Pharmacological action also.  The ingredients  of<br \/>\n                the  above  items  are not included in any of the<br \/>\n                official Pharmacopoeias available  here.    These<br \/>\n                items  cannot  be  analyzed  and  opined  without<br \/>\n                official monographs.&#8221;\n<\/p>\n<p id=\"p_6\">.SP 2<br \/>\n        Counsel appearing for the writ petitioner submitted  that<br \/>\n        the  above  mentioned  items  are not drugs but only food<br \/>\n        substitutes.  On the other hand,  counsel  appearing  for<br \/>\n        the  Department  submitted  that  they  are drugs and the<br \/>\n        authorities are entitled to proceed  in  accordance  with<br \/>\n        the provisions  of the Drugs and <a href=\"\/doc\/1891720\/\" id=\"a_1\">Cosmetics Act<\/a>, 1940.  We<br \/>\n        make it clear if any proceedings  are  initiated  in  any<br \/>\n        forum  it  is  always open to the writ petitioner to urge<br \/>\n        all  those  contentions  in  that  forum,  including  the<br \/>\n        contention  that  the items seized are not drug and it is<br \/>\n        that forum to  decide  that  issue.
