RAVIKUMAR, J\n          - - - - - - - - - - - - -- - - - - - - - - - - - - - - -\n                  W.P.(C)No. 28168 OF 2010\n          - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n\n       Dated this the 13th day of September, 2010\n\n\n                          J U D G M E N T\n<\/pre>\n<p id=\"p_1\">           The petitioner is a Proprietor of Vishnu Cashew<\/p>\n<p>Company, Kollam.            This writ petition has been filed<\/p>\n<p>challenging Ext.P4 whereby he was called upon to deposit<\/p>\n<p>30% of the assessed amount as per Ext.P1. The said order<\/p>\n<p>was passed by the Tribunal as a condition for admitting the<\/p>\n<p>appeal preferred against Ext.P1 and also for staying the<\/p>\n<p>implementation of the impugned order. According to the<\/p>\n<p>petitioner, earlier under similar circumstances, he had<\/p>\n<p>approached this Court and this Court as per Ext.P5 interfered<\/p>\n<p>with a similar order and taking in to account the financial<\/p>\n<p>position of the company modified the impugned order.<\/p>\n<p>Evidently,    at the time of passing of Ext.P5 order the<\/p>\n<p>respondents have raised serious objections. Ext.P5 order was<\/p>\n<p>passed after considering the rival contentions and admittedly,<\/p>\n<p>as per the same the order whereby the petitioner was directed<\/p>\n<p>to pay 40% of the assessed amount involved in the said writ<\/p>\n<p>petition was modified to the extent of 20% of the amount<\/p>\n<p>assessed. Having perused Exts.P1, P4 and P5 in this writ<\/p>\n<p>WPC.28168\/2010<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                : 2 :<\/span><\/p>\n<p>petition, I am of the view that the petitioner is entitled to a<\/p>\n<p>relief as has been granted to him as per Ext.P5 judgment. In<\/p>\n<p>fact, the learned counsel appearing for the respondents<\/p>\n<p>vehemently opposed the same. However, taking note of the<\/p>\n<p>fact that under similar circumstances this Court has issued<\/p>\n<p>Ext.P5, I find no reason to take a different view in this matter.<\/p>\n<p>Accordingly, this writ petition is disposed of with a direction to<\/p>\n<p>the first respondent to consider Ext.P2 appeal in accordance<\/p>\n<p>with law, on merits. Since the respondents have already been<\/p>\n<p>directed to keep in abeyance all coercive steps till the disposal<\/p>\n<p>of the appeal, by the Tribunal, there is no need to pass an<\/p>\n<p>order to that effect.    Therefore, order in Ext.P5 is modified<\/p>\n<p>only to the extent it directs the petitioner to deposit 30% of<\/p>\n<p>the assessed amount. Accordingly, there will be a direction to<\/p>\n<p>the first respondent to consider the appeal on merits on<\/p>\n<p>condition that the petitioner remits an amount equivalent to<\/p>\n<p>15% of the amount determined as per Ext.P1 proceedings.<\/p>\n<p id=\"p_1\">      This writ petition is disposed of accordingly.<\/p>\n<p id=\"p_2\">                                                 Sd\/-<\/p>\n<pre id=\"pre_1\">\n                                    (C.T.
