Justice V.GIRI\n\n Dated :12\/01\/2009\n\n O R D E R\n                   J.B.KOSHY, Ag.C.J. &amp; V.GIRI, J.\n                      --------------------------------------\n                        W.A.No.2397 of 2006\n                      -------------------------------------\n                      Dated 12th January, 2009\n\n                               JUDGMENT\n<\/pre>\n<p id=\"p_1\">Koshy, Ag.C.J.\n<\/p>\n<p id=\"p_1\">                 Former President of the Edavanakkad Grama<\/p>\n<p>Panchayat filed the writ petition. Ext.P1 no-confidence motion was<\/p>\n<p>moved against him. All the 14 members of the Panchayat Committee<\/p>\n<p>participated in the meeting. Eight persons supported no-confidence<\/p>\n<p>motion and six persons opposed the same. Thereafter, the petitioner<\/p>\n<p>was voted out and subsequently another person was elected as the<\/p>\n<p>President.   Major contention of the petitioner is that authorised<\/p>\n<p>officer of the Election Commission                 was the Block Panchayat<\/p>\n<p>Secretary, but, another person acted as the same. No-confidence<\/p>\n<p>motion ought to have been accepted by the authorised officer, but, in<\/p>\n<p>this case, it was accepted by another officer. It is contended that<\/p>\n<p>authorised officer as stipulated in Section 157 of the Kerala<\/p>\n<p>Panchayat Raj Act is a persona designata and, therefore, he cannot<\/p>\n<p>further authorise another person.           No-confidence motion ought to<\/p>\n<p>have been received by the authorised officer himself. According to<\/p>\n<p>the petitioner, authorised officer was Block Panchayat Secretary<\/p>\n<p>under section 157 of the Kerala Panchayat Raj Act and finding to the<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">W.A.2397\/2006                      2<\/span><\/p>\n<p>contrary and receipt of notice by the Extension Officer (Housing) is<\/p>\n<p>illegal. Counsel for the Election Commission submits that at that time<\/p>\n<p>the Extension Officer (Housing ) was in charge of the Block Panchayat<\/p>\n<p>Secretary. Learned single Judge after calling for the register found<\/p>\n<p>that the above person who accepted the notice was acting as the<\/p>\n<p>Vypeen Block Panchayat Secretary during the relevant time. Learned<\/p>\n<p>Judge also noticed that eight persons favoured the no-confidence<\/p>\n<p>motion and on the facts of this case, no relief can be issued in a writ<\/p>\n<p>petition. We are also told that an election petition is pending. The<\/p>\n<p>election petition can be disposed of according to law untrammelled by<\/p>\n<p>the observations made in the writ petition.
