Baleshwar Paswan S\/o Jagar Paswan\n                                      Versus\n                                The State Of Bihar\n                                     -----------\n<\/pre>\n<p id=\"p_1\">2.   24.10.2011                   The petitioners seek anticipatory bail as they<\/p>\n<p>                   apprehend their arrest in Sahodara P.S. Case No. 35\/2011 for<\/p>\n<p>                   the offences alleged under Sections 7, 4, 5, 35 (1) (A) of the<\/p>\n<p>                   Fertilizer (Control) Order, 1985, and 7 (1) <a href=\"\/doc\/774360\/\" id=\"a_1\">(A) of the Essential<\/p>\n<p>                   Commodities Act<\/a>.\n<\/p>\n<p id=\"p_1\">                                  Learned counsel for the petitioners state and<\/p>\n<p>                   submit that petitioner nos. 1 and 2 are full brothers and along<\/p>\n<p>                   with five other brothers living in jointness, have cultivable<\/p>\n<p>                   land to the extent of 16 bighas for which the quantity of<\/p>\n<p>                   Fertilizers and Urea (73 + 92 bags) had been stored for<\/p>\n<p>                   agricultural purposes and not for the purpose of black<\/p>\n<p>                   marketing or smuggling as alleged.\n<\/p>\n<p id=\"p_2\">                                  It is further stated that petitioner no. 3 and his<\/p>\n<p>                   two laborers (petitioner nos. 4 and 5) have also stored Urea<\/p>\n<p>                   (25 + 18 + 7 bags) for agricultural purposes in respect of 16<\/p>\n<p>                   bighas of land.\n<\/p>\n<p id=\"p_3\">                                  The entire quantity of Fertilizers and Urea has<\/p>\n<p>                   been recovered in course of raid conducted on 19.08.2011<\/p>\n<p>                   from the houses of the petitioners separately. The purpose for<\/p>\n<p>                   which the goods were stored being agricultural purpose is<br \/>\n          sought to be supported with respect of the rent receipts of the<\/p>\n<p>         land and also the purchase invoices.\n<\/p>\n<p id=\"p_4\">                     Learned counsel for the State appears and is<\/p>\n<p>         heard. He is unable to show that the amount of recovery of<\/p>\n<p>         Fertilizers and Urea could be said to be unreasonable,<\/p>\n<p>         considering the aggregate area and extent of cultivable land as<\/p>\n<p>         supported by rent receipts and the purchase invoices.<\/p>\n<p id=\"p_5\">                     In view of the aforesaid facts and circumstances,<\/p>\n<p>         in the event of their arrest or surrender before the court below<\/p>\n<p>         within six weeks from the date of production\/ receipt of a<\/p>\n<p>         copy of this order, let the above named petitioners be released<\/p>\n<p>         on bail on furnishing bail bonds of Rs.10,000\/- (ten<\/p>\n<p>         thousand) each with two sureties of like amount each to the<\/p>\n<p>         satisfaction of learned Chief Judicial Magistrate, Bettiah, West<\/p>\n<p>         Champaran in connection with Sahodara P.S. Case No.<\/p>\n<p>         35\/2011, subject to the conditions as laid down under<\/p>\n<p>         <a href=\"\/doc\/1692057\/\" id=\"a_1\">Section 438(2)<\/a> Cr.P.C.\n<\/p>\n<p id=\"p_6\">\n<pre id=\"pre_1\">Fahad.
